HomeMy WebLinkAbout11-16-98COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 16, 1998 The Common Counc'fl of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 16th day of November, 1998. The meeting was called to order by Mayor Thomas R. Galligan, with Deputy Clerk Barbara Hollis at the desk. Mayor Galligan welcomed all in attendance, asking ail those present to stand as Counc'flperson Williams gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicki Conlin. Absent: None. Mayor Galligan presented the minutes of the me~'mg of November 2, 1998 for consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Councilperson Williams and carded unanimously. Deputy Hollis presented the claim list for consideration by the Council, expla'ming two additional claims. Following discussion regard'mg a Motor Vehicle claim payable to Vissing's Dodge, Counc'flperson Frantz made the motion to approve the claims as presented as well as the additional, deleting the claim to Viss'mg's Dodge for a truck, seconded by Councilperson Ellis. Mayor Galligan explained the truck would be for the Street Commissioner with the trucks in the department passing down. He is trying to get ail drivers good trucks with four-wheel drive. Following comments the motion passed unanimously. Mayor Galligan read a proclamation declaring November 25, Options Day. Mayor Galligan read the names of the students who participated in the building. Mr. Eric Alii, President of Claysburg Community Center Incorporated read a statement commenting on the Community Center being built, requesting the center be staffed from the community. Mr. Campbell, Commissioner of the Housing Authority, explained details are being November 16, 1998 Page 2 of 5 worked on and there will be a meeting with the Housing Authority. Mayor Galligan a~ffeed it is important to have the community represented. There is a need to get all input so the whole community can benefit. Mr. Alli said there will be no discrimination as this is for the community as a whole. Mr. Mike Hutt asked if the city animal shelter van has been taken to Tennessee and (Florida. Mayor Galligan does not know but will find out if this is true. Resolution No. 98-R-32, A Resolution Approving Statement Of Benefits For Purposes Of Property Tax Abatement (North Shore Development LLC) was presented. Councilperson Ellis made the motion to table Resolution No. 98-R-32, seconded by Councilperson Williams, passing unanimously. Attorney Sedwick Galligan presented Ordinance No. 98-OR-75, An Ordinance Amending And Restating Ordinance No. 98-OR-27 Concerning The Construction Of Additions And Improvement To The Sewage Works Of The City Of Jeffersonville; Authorizing The Issuance Of Sewage Works Revenue Bonds, For Such Purpose; Addressing Other Matter Connected Therewith, Including The Issuance Of Notes In Anticipation Of Bonds; And Repealing Ordinances Inconsistent Herewith, stating Mr. Jim Gutting is unable to be here due to illness. Attorney Sedwick Galligan explained this is the same bond ordinance passed earlier this year and the amendments simply change some dates and some insurance. She does have a red line copy if any have any questions. She does ask this be passed on the first reading as Mr. Gutting will attend the next meeting to answer any questions. Council President Conlin made the motion to pass Ordinance No. 98-OR-75, seconded by Councilperson Williams, passing on a vote of 4-2-1. Councilpersons Perkins and Ellis voted nay with Councilperson Wilson abstaining. Attorney Sedwick Galligan presented Ordinance No. 98-OR-70, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Located At 1710 East 10m Street From BSC to B-2. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-70 on the third reading, seconded by Councilperson Ellis, passing on a vote of 6-0-1. Council President Conlin abstained. November 16, 1998 Page 3 of 5 Attorney Sedwick Galligan presented Ordinance No. 98-OR-72, An Ordinance Requiring Registration Of General Contractors for the third reading, saying she has received no communication from anyone. The general consensus of the Council is to make this stronger in the near future. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-72 on the third reading, seconded by Council President Conlin, passing unanimously. Attorney Sedwick Galligan presented and explained Ordinance No. 98-OR-76, An Ordinance Transfening Certain Funds Within Same Department (City Attorney). Councilperson Perkins made the motion to suspend the roles for Ordinance No. 98-OR-76, seconded by Council President Conlin, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-76 on all three readings, seconded by Council President Conlin, passing unanimously. Attorney Sedwick Galligan presented and explained Ordinance No. 98-OR-77, An Ordinance Transferring Certain Funds Within Same Department (Mayor). Council President Conlin made the motion to suspend the rules for Ordinance No. 98-OR-77, seconded by Councilperson Williams, passing unanimously. Council President Conlin then made the motion to pass Ordinance No. 98-OR- 77 on all three readings, seconded by Councilperson Williams, passing unanimously. Ordinance No. 98-OR-78, An Ordinance Transferring Certain Funds Within Same Department (Planning and Zoning) was presented. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-78, seconded by Councilperson Ellis, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-78 on all three readings, seconded by Councilperson Ellis, passing unanimously. Attorney Sedwick Galligan presented Ordinance No. 98-OR-79, An Ordinance Redrawing City Council District Boundaries. Council President Conlin made the motion to table Ordinance No. 98-OR-79, seconded by Councilperson Perkins, passing on a vote of 6-1. Councilperson Wilder voted nay. Ordinance No. 98-OR-80, An Ordinance Transferring Certain Funds Within Same Department (Common Council) was presented and explained. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-80, seconded by Councilperson Williams, passing unanimously. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-80 on all three readings, seconded by Councilperson Ellis, passing unanimously. November 16, 1998 Page 4 of 5 Council President Conlin said the Options Program will dedicate their building on November 25 at noon. She asks all to please attend. The students take great pride in the work they have done. She commends them for what they have done. The Council will meet next Monday (November 23) at 5:00 P.M. in an executive workshop to discuss the F.O.P. agreement. Councilperson Perkins would like to make a motion to have the City provide the same health insurance benefits the City employees have to all retirees beginvJng January 1, 1999. This would be a way to say thank you. The cost to the City would be between $25,000 and $30,000 more per year. Attorney Sedwick Galligan explained this would need to be done as an Ordinance amending the Ordinance in effect. Councilperson Perkins requests Attorney Sedwick Galligan to prepare the amendment for the next meeting. Councilperson Wilder would like to bring up the redistricting Ordinance again before the end of the year. Councilperson Williams would also like to work on this and requests this be on the agenda for the workshop. Councilperson Perkins expressed his concerns and discussion continued. Attorney Sedwick Galligan said there is no Ordinance in the code book that stated if a property owner connects to City sewers, that property owner waives their right against annexation remonstrance. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98- OR-81, An Ordinance Requiring Execution & Recording Of Waiver Of Remonstrance As A Condition For Obtaining A Sewer Tap Permit Outside The Municipal Boundaries Of The City, seconded by Council President Conlin, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-81 on all three readings, seconded by Council President Conlin, passing unanimously. Councilperson Frantz received a call questioning if the City is to maintain the island off Utica Pike at Blanchel Terrace. Attorney Sedwick Galligan will look at the plat book. Mayor Galligan announced the streets are being paved, asking if there are any request.
