HomeMy WebLinkAbout11-02-98COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 2, 1998 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 2nd day of November, 1998. The meeting was called to order by Mayor Thomas R. Galligan, with Deputy Clerk Barbara Hollis at the desk. Mayor Galligan welcomed all in attendance, asking ail those present to stand as Councilperson Ellis asked all to join him in the Lord's Prayer. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons lohn Perkins, Ron Ellis, Barbara Wilson, Andrew Williams III, and Vicki Conlin. Absent: Councilpersons Donna M. Frantz, and Peggy Knight Wilder. Mayor Gailigan presented the minutes of the meeting of October 19, 1998 for consideration by the Council. Councilperson Perkins made the motion to approve the minutes as presented, seconded by Couricilperson Wilson and carried unanimously. Clerk Hollis presented the claim list for consideration by the Council, explaining two additional claims. Following all discussion, Councilperson Perkins made the motion to approve the claims as presented allowing the additionai claim for Clark County Commissioners, tabling the claim tbr Diversified Insurance, seconded by Councilperson Ellis, passing unanimously. Ms. Nellie Knowland asked if there is a city flag. She was told there is a city flag. Mr. David Coyte addressed the Council regarding transportation concerns. The proposed construction on 1-65 will cause more congestion which should be incentive to consider mass transportation. Mr. Coy'to does not feel INDOT is addressing these concerns. A commuter rail service along the existing L & I tracks from downtown Louisville to Hem'yville is suggested. The approximate cost is 25 million which would be done with federal funds with no match required. Mr. Coyte feels this is a win-win situation. Councilperson Williams sees a need for behavior modification if this is to work. Mrl Coyte said rail travel is perceived better than bus service. Mayor Galligan introduced Ms. lana Ecker who has been hired to take the place of Jim Urban. November 2, 1'998 Page 2 of 4 Mayor Galligan reviewed Ms. Ecker's qualifications. Attorney Sedwick Galligan introduced Ordinance No. 98-OR-68, An Ordinance Annexing Contiguous Territory By Voluntary Petition, explaining the area. Mayor Galligan explained the cost will be paid by the developers. The drainage work at Loma Vista is being done by the developers and Indiana American Water Co. Councilperson Ellis explained the Plan Commission position. Following all discussion, Councilperson Ellis made the motion to suspend the rules for Ordinance No. 98-OR- 68, seconded by Councilperson Wilson, passing unanimously. Councilperson Ellis then made the motion to pass Ordinance No. 98-OR-68 on all three readings, seconded by Councilperson Wilson, passing unanimously. Attorney Sedwick Galligan introduced Ordinance No. 98-OR-69, An Ordinance Fixing Basic Salaries Of Elected Officials Of The City Of Jeffersonville, Indiana For The Year 1999. Discussion followed regarding the Councilpersons salary. Following all discussion, Councilperson Perkins made the motion to pass Ordinance No. 98-OR-69 on the first and second reading with the change in the Councilpersons salaries, seconded by Council President Conlin, passing unanimously. Attorney Sedwick Galligan presented and explained Ordinance No. 98-OR-70, An Ordinance Chan~dng The Zoning Map Designation Of A Certain Tract Of Property Located At 1710 East 102 Street From BSC to B-2. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-70, seconded by Councilperson Williams. Council President Conlin explained she will have to abstain fi-om the vote on this Ordinance. Councilperson Williams then withdrew his motion and Councilperson Perkins withdrew his motion. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-70 on the first and second reading seconded by Councilperson Williams, passing on a vote of 4-0-1. Council President Conlin abstained from the vote. Attorney Sedwick Galligan introduced and explained Ordinance No. 98-OR-71, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Located At Highway 62 And Allison Lane From BSC To B-2. Following discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-71, seconded by Council President Conlin, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-71 on all three readings, seconded by Council President Conlin, passing unanimously. Ordinance No. 98-OR-67, An Ordinance Transferring Certain Funds Within Same Department November 2, f998 Page 3 of 4 (Fire) was presented for the third and final reading. Councilperson Ellis said he did ride in the truck that would be replaced by this transfer and agrees it does need to be replaced. This is a safety issue. Council President Conlin made the motion to pass Ordinance No. 98-OR-67 on the third and final reading, seconded by Councilperson Williams, passing unanimously. Chief Smith thanked the Council, asking them to visit at any time. Attorney Sedwick Galligan presented the Agreement Between City Of Jeff'ersonville And Indiana Fraternal Order Of Police Labor Council, Inc. Effective January 1, 1998 Through December 3 l, 1998. Councilperson Perkins made the motion to table the agreement and to hold a workshop to discuss it, seconded by Councilperson Ellis, passing unanimously. Attorney Sedwick Galligan presented Ordinance No. 98-OR-72, An Ordinance Requiring Registration Of General Contractors. This was prepared following a request by the Building Commissioner. Several aspects of the Ordinance were discussed. All are in favor of working on this during a workshop. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-72 on the first and second readings, seconded by Councilperson Wilson, passing unanimously. Ordinance No. 98-OR-73, An Ordinance Transferring Certain Funds Within Same Department (Council) was presented. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-73, seconded by Councilperson Wilson, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-73 on all three readings, seconded by Councilperson Williams, passing unanimously. Ordinance No. 98-OR-74, An Ordinance Transferring Certain Funds Within Same Department (Police Pension) was presented for consideration. Following discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 98-OR-74, seconded by Councilperson Ellis, passing unanimously, Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-74 on all three readings, seconded by Councilperson Ellis, passing unanimously. Following discussion, it was derided to have one Council meeting in December on December 15 at 7:00 o'clock P.M. There will be a workshop on November 16, from 5:00 to 6:00 will be executive session, with public workshop from 6:00 to 6:45. Councilperson Perkins reminded the Council that the next day, as election day, is the 200~ anniversary of Indiana elections. The only polling place 200 years ago was in Vincennes where many November 2, f998 Page 4 of 4 had to travel for days to vote. Councilperson Perkins reminds all to vote tomorrow. Councilperson Ellis questioned the lease for the Civil Ak Patrol and was told the lease has been renewed. Councilperson Williams questioned the status of installing tarps on City trucks. Council President Conlin understands they will cost approximateiy $1,000 each. General discussion followed. Mayor Galligan will be conducting a police shift commander meeting and will emphasize enforcement of the tarp ordinance. Councilperson Williams said Mr. David Coyte is fight about INDOT as their support is lukewarm at best. Ms. Ecker will need strong support to lobby INDOT. Attorney Sedwick Galligan will prepare a Resolution to send to Indianapolis.
