HomeMy WebLinkAbout10-05-98COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA OCTOBER 5, 1998 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 5th day of October, 1998. The meeting was called to order by Cotmcil President Vicky Conlin, with Clerk and Treasurer C. Richard Spencer Jr. at the desk. Council President Conlin asked ail those present to stand as Councilperson Ellis gave the invocation. Council President Conlin asked all those present to join her in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicky Conlin. Absent: None. Council President Conlin presented the minutes of the meeting of September 21, 1998 for consideration by the Council. Councilperson Perkins made the motion to approve the minutes as presented, seconded by Councilperson Ellis and carried unanimously. Clerk and Treasurer Spencer presented the claim list for consideration by the Council. Following all discussion, Council President Conlin made the motion to approve the claims as presented, denying the claim listed under Motor Vehicle payable to Vissing's, seconded by Councilperson Wilson, passing unanimously. Mr. Sam Green, Attorney representing W. Richard Jones and Phyllis A. Stoner, appeared before the Council to request passage of Ordinance No. 98-OR-63, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located In The 1700 Block Of New Albany Charlestown Pike, Jeffersonville, IN From R-2 (Residentiai Vacant Land) to B-3 (Generai Business). Attorney Green explained the area. Councilperson Ellis stated the Plan Commission gave favorable approval to the request and no opposition was voiced. Attorney Galligan explained the property is in the Inner City Road T.I.F. district with plans for commerciai use. Following ail discussion, Councilperson Perkins made the motion to suspend the roles for Ordinance No. 98-OR-63, seconded October 5, 1998 Page 2 of 4 by Councilperson Ellis, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-63 on ail three readings, seconded by Councilperson Williams, passing unanimously. Councilperson Perkins introduced Resolution No. 98-R-29, A Resolution Opposing The Establishment OrA Second Methadone Clinic In The City Of Jeffersonville. Councilperson Perkins explained the State of Indiana has no cert'rficate of need so there is concern this is not the last to come to Jeffersonville as it is a metropolitan area and will get what no others want. Councilperson Perkins made the motion to pass Ordinance No. 98-R-29, seconded by Councilperson Ellis, and opened for discussion. Ms. loanne Blake said the area is plagued by drag deais. The Police do come when they are called. Many meetings have been held and nothing has been resolved. Attorney Galligan said the police patrols have been increased in the area and Mayor Galligan has patrolled the area himself. Mayor Galligan arrived at 7:25 P.M. The enforcement of the nuisance ordinance was discussed. Mayor Gailigan bas asked to have the nuisance ordinance pushed. He does understand the concerns but there is only so much that can be done. All have rights. Some have been arrested. He is trying to do eve~hing he can, it is not a pretty situation. Mayor Galligan explained the situation of the lease of the building. The complaints surrounding River Falls Lounge were discussed. All blotter entries for cail are sent to the A.B.C. Board. Undercover officers are working the area. One property owner has told Mayor Galligan the lease will not be renewed. Attorney Galligan said much of the problem is not the residents or landlords, but visitors to the lounge. Councilperson Perkins said there is a need for a decibel meter and training for its use. A gentleman in the audience said the area being discussed offers food, shelter, alcohol, and drugs of choice. If there is any way to stop this there is a need to focus on it. He knows the administration is doing a good job, but if they don't get pressure they won't get attention. Attorney Gailigan said Indiana higher courts have ruled methadone clinics as health care facilities. Methadone is a controlled substance. Mayor Galligan said it may be possible to look at zoning for the future. Ms. Kathy Stark is opposed to the clinic. Attorney Galligan will prepare an amendment to the nuisance ordinance. The vote to pass Resolution No. 98-R-29 passed unanimously. Cotmcilperson Wilder encourages all to contact their State Legislators requesting the establishment of a certificate of need. Ordinance No. 98-OR-56, An Ordinance Transferring Certain Funds Within Same Department October 5, 1998 Page 3 of 4 (Sanitation) was presented for the third and final reading: Councilperson Frantz made the motion to pass Ordinance No. 98-OR-56 on the third an final reading, seconded by Councilperson Williams, passing on a vote of 6-1. Council President Conlin voted nay. Attorney Galligan presented and explained Ordinance No. 98-OR-64, An Ordinance Amending Certain Portions Of Secti°n 1 Of Ordinance No. 97-OR-33, (Police Department). Following discussion, Council President Conlin made the motion to suspend the rules for Ordinance No. 98-OR-64, seconded by Councilperson Williams, passing unanimously. Council President Conlin then made the motion to pass Ordinance No. 98-OR-64 on all three readings, seconded by Councilperson Williams, passing unanimously. Attorney Galligan presented and explained Ordinance No. 98-OR-65, An Ordinance Amending Certain Portions Of Section I Of Ordinance No. 98-OR-47 (Police Department). Council President Conlin made the motion to suspend the rules for Ordinance No. 98-OR-65, seconded by Councilperson Wilder, passing unanimously. Council President Coniin then made the motion to pass Ordinance No. 98-OR-65, seconded by Councilperson Williams, passing unanimously. Attorney Galligan presented and explained Resolution No. 98-R-30, A Resolution Authorizing Advertisement For An Additional Appropriation (Building Commission). Councilperson Perkins made the motion to pass Resolution No. 98-R-30, seconded by Council President Conlin, passing unanimously. Council President Conlin invited all to attend a ceremony October 6, 1998 at 5:00 P.M. at Dr. Fleming's Building on Spring Street. She then told the Council of a group of students in the Options Program of Greater Clark County Schools that are building a shelter house and going thru the permit process. She encourages all to attend the dedication that will be held the day before Thanksgiving. Councilperson Perkins appreciates the Council considering the Resolution No. 98-R-29 as it was not in the packet. He requests Council President Conlin to meet with Attorney Galligan to compile the list to send copies of the Resolution: CouncilpersonEllis askedifthetarp ordinance hasbeen published. The ordinance hasbeen published. Discussion followed regarding trucks on Market Street. Councilperson Wilder asked if there is an Ordinance regulating door to door sales. Attorney Galligan replied there is a transient merchant permit. Councilperson Wilder is concerned for children October 5, 1998 Page 4 of 4 going door to door. She does not see this as safe. Mayor Galligan has stopped street collections and asks if any are seen to report them if they are not adults wearing safety vests. The only collections made in the streets should be for Special Olympics, and firefighters collecting for the Crusade For Children. He will talk to the schools regarding door to door sales. Councilperson W'tlson has received call about 8~ Street and if it will be repaved following the installation of the water line. Mayor Galligan said 8a Street will be milled and repaved curb to curb. Mayor Galligan reported on the recent tour of the new water plant. This is a nice addition to Jeffersonville. Each Tuesday the Mayor's Youth Council meets at the Library. He initially had reservations about this group but does not have any longer. The youth talk about problems young adults have and how to address them. They are making a lot of progress. This along with the officer at JeffHigh, will make a difference. It is a good program. The group will start coming to Council meetings. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 8:30 P.M., seconded by Council President Conlin, passing unanimously.
