AN ORDINANCE PROHIBITING THE SALE, GIFT OR DISTRIBUTION OF LOTTERY
TICKETS, NOTICESt ADVERTISEMENT, AND DRAWINGS THEREOF, AND PROVID-
ING PENALTIES F~R THE VIOLATION THEREOF.
BE IT ORDAINED by the Common Council of the City of Jeffersonville,
Indiana, that:
Se'ction 1. The sale, gift or distribution of lottery
tickets, notices or advertisement of such lotteries, or drawings
of the same is hereby prohibited.
Section 2. No person, firm or corporation shall sell
or offer to sell for consideration anything whatsoever by the
representation or pretense that a sum of money in an amount un-
known or a thing of value, may, or may not be enclosed within,
or may be found with, or named upon the thing sold, or may or
may not be given to the purchaser in addition to the thing sold,
or by any representation, pretense or device by which the pur-
chaser is informed or induced to believe that money or something
else of value may be won or drawn by chance by reason of such
sale.
Section 3. For the purposes of this ordinance, the
following definitions are made:
(a) A "lottery" is an enterprise wherein for a consid-
eration the participants are. given an opportunity to win a prize,
the award of which is determined by chance even though accompanied
by some skill.
/¢) A "prize" is anything of value given to the winner
as a result of his good fortune.I
· S~ctilo'n'~4. Any person, firm or corporation who violates
any provision of this 'ordinance shall be fined not less than Twenty-
five Dollars ($25.00) nor more than Three Hundred Dollars ($300.00
or imprisoned not more than six (6) months or both.
Section 5. If any provisions of this ordinance or the
application thereof to any person, firm or corporation is held
invalid, the remaining ssctions of this ordinance and the application
thereto shall not be affected by such invalidation.
PASSED AND ADOPTED by ths Common Council of the City of
Jeffersonville, Indiana, this 7th !day of October, 1968.
