HomeMy WebLinkAbout03-16-98COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MARCH 16, 1998 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 16th day of March, 1998. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer C. Richard Spencer Jr. at the desk. Mayor Galligan welcomed all in attendance, asking ail those present to stand as Councilperson Williams gave the invocation. Mayor Gailigan asked ail those present to join him in the pledge of ailegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicky Coniin. Absent: None. Mayor Galligan presented the minutes of the meeting of March 2, 1998 for consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Councilperson Williams and carded unanimously. Clerk and Treasurer Spencer presented the claim list, explaining two additional claims, for consideration by the Council. Following all discussion, Councilperson Perkins made the motion to approve the claims as well as the additional as presented, seconded by Councilperson Wilson, passing unanimously. There was no public comment. Mayor Galligan presented Ordinance No. 98-OR-14, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located At Fronting Brown-Forman Road From Agriculturai To I-1 for the third and final reading. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-14 on the third and final reading, seconded by Council President Conlin, passing unanimously. Mayor Galligan presented OrdinanCe No. 98-OR-15, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located At 4610 Middle Road From Agriculturai March 16, 1998 Page 2 of 6 To I-I for the third and final reading. Councilperson Ellis made the motion to pass Ordinance No. 98-OR-15 on the third and final reading, seconded by Council President Conlin, passing unanimously. Mayor Galligan presented Ordinance No. 98-OR-16, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Located At 5800 Block Of Hamburg Pike From B-2 To B-3 for the third and final reading. Councilperson Perkins asked if there were any comments from the audience. There being no comments, Councilperson Perkins made the motion to pass Ordinance No. 98-OR-16 on the third and final reading, seconded by Councilperson Frantz, passing on a vote of 6-0-1. Councilperson Wilder abstained. Mayor Galligan presented Ordinance No. 98-OR-17, An Ordinance Changing The Zonin Map Designation OrA Certain Tract Of Property Located At 2715 Charlestown Pike, Jeffersonvilh Indiana 47130 From R-2 To B-1. Councilperson Perkins said he will vote against passage ofthi~ Ordinance as he feels it will open the door to others to come to the Council asking for business. The road in this area is narrow. Once rezoning starts it is hard to deny the same use to others. Councilperson Perkins stated he is not against this project, it is a nice project. Councilperson Frantz made the motion to pass Ordinance No. 98-OR-17 on the third and final reading, seconded by Councilperson Wilder, passing of a vote of 6-1 with Councilperson Perkins voting against passage. Mayor Galligan presented Ordinance No. 98-OR-18, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located At 3900/4000 Block Of Charlestown Pike From I-I To R-I, for the third and final reading, asking for any objections. There being no objections, Councilperson Conlin made the motion to pass Ordinance No. 98-OR-18 on the third and final reading, seconded by Councilperson Williams, passing unanimously. Mayor Galligan presented Ordinance No. 98-OR-19, An Ordinance Changing The Zonin Map Designation Of A Certain Tract Of Property Located At 4000 Block Of Coopers Lane Fro~ I-1 To B-3 for the third and final reading. Councilperson Wilson made the motion to pass Ordinance No. 98-OR-19, seconded by Councilperson Ellis, passing unanimously. Mayor Galligan presented Ordinance No. 98-OR-20, An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 97-OR-33 (Building Commission) for the third and final reading. Council President Conlin made the motion to pass Ordinance No. 98-OR-30 on the third March 16, 1998 Page 3 of 6 and final reading, seconded by Councilperson Frantz, passing on a vote of 6-1. Councilperson Ellis voted nay. Mayor Galligan presented Ordinance No. 98-OR-21, An Ordinance Transferring Certain Funds Within Same Department (Building Commission) for the third and final reading. Council President Conlin made the motion to pass Ordinance No. 98-OR-21 on the third and final reading, seconded by Councilperson Frantz, passing on a vote of 6-1. Councilperson Ellis voted in opposition Ms. Lisa Thompson, representing New Directions Housing, told the Council of the 11 homes that were serviced by the Jeffersonville Repair Affair project last year. The group will be approaching the County Commissioners to request help for those in need in the County. Ms. Thompson expressed gratitude for all the Council has done in the past, asking for assistance again this year. Planning Director Urban said the group is making great strides in upgrading the conditions of home in Jeffersonville. Councilperson Ellis offered to volunteer his help with the program. Ms. Thompson appreciates all volunteers. This year the program will take place June 20. The Council volunteering as a team was discussed. The City does have a team. Attorney Sedwick Galligan presented and explained Resolution No. 98-R-10, A Resolution Of The Common Council Of The City Of Jeffersonville, Indiana, Authorizing The Submittal Of The CFF Application To The Indiana Department Of Commerce And Addressing Related Matters. Following discussion, Councilperson Perkins made the motion to pass Resolution No. 98-R-10 seconded by Councilperson Williams, passing unanimously. Mayor Galligan reported he received a call complaining there is not enough parking m Spring Street in the downtown area. It has taken a lot of effort to get to this. Another traffic problem is the new Sonic Restaurant. Attorney Sedwick Galligan presented Ordinance No. 98-OR-23, An Ordinance Of Additional Appropriation (Motor Vehicle, Sanitation, and General Fund). Street Commissioner Irvin said the intention is to purchase a packer, dump truck, salt spreader/snow plow, and a pick up truck, saying the City has already saved by picking up the trash. These purchases will help save money in the long mn. Mayor Galligan said these will be used primarily for yard waste and white goods which Rumpke never did pick up. Commissioner Irvin said he will prove at the end of the year that at least $100,000 March 16, 1998 Page 4 of 6 will be saved. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-23 on the first and second reading, seconded by Council President Conlin, passing unanimously. Mayor Galligan presented Ordinance No. 98-OR-24, An Ordinance Transferring Certain Funds Within Same Department. Clerk and Treasurer Spencer explained the transfer will be used as match funds for the extension of Court Avenue. Mayor Galligan explained the project. Councilperson Perkins has supported this project for 12 years. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-24 on the first and second readings, seconded by Councilperson Williams, passing unanimously. Council President Conlin said it was the consensus of the Council during a workshop they are not going to sign the Interlocal Agreement For Solid Waste District. The Council is not opposed to recycling, they are opposed to the nonassurance that eye,body in the County will recycle. The Council does not want to end up with a shortfall that will cost the taxpayers of the City, at the minimum, $150,000. Councilperson Perkins agrees with all Council President Conlin said, adding this is a classic case of double taxation for City residents. He is in favor of recycling, not double taxation. CouncilpersonPerkins madethe motionto pass Resolution No. 98-K-11, AResolution Approving The Interlocal Agreement For Solid Waste District, seconded by Councilperson Wilder failing on a unanimous vote. Council President Conlin noted in the phone book, on page 19, is a list of mandatory curbsi& recycling areas of Clarksville, Charlestown, Jeffersonville, Sellersburg, and Oak Park area. The Council will hold a workshop on the 234 of March at 5:30. A letter regarding Haven House will be discussed at this workshop. The agenda was reviewed. It is hoped to start neighborhood meetings in April. Councilperson Frantz asked what is being done about Hoke's as she is receiving complaints again. Mayor Galligan said the Building Commission Office is dealing with this. Councilperson Williams has received calls from residents of Claysburg Towers saying they are being billed for cable services they are not receiving. Councilperson Perkins is receiving the same calls from residents at Clark Arms. Councilperson Ellis said three rate increases in one year is deplorable. March 16, 1998 Page 5 of 6 Councilperson Wilder appreciates the amount of information she has received from the Fire Department. Most Department Heads are helpful. Mayor Galligan reviewed a recent banquet at the American Legion. Councilperson Perkins reported a problem in the 1000 block of East Th and East Court. There is need for a retaining wall. This was discussed. Councilperson Ellis received a call from a lady on Nachand Lane complaining of sewage being blown into her bathroom during sewer cleaning. Mayor Galligan has a hard time understanding this saying the home either has a blocked vent or no vent. He suggests calling the Building Commissioner Office for an inspection. Council President Conlin said Municipal Government Week will be held May 11-15. Activities are being planned. Mayor Galligan reported he and Attorney Sedwick Galligan attended the National League of Cities Conference. His favorite topic of CSO and storm water came up. He will copy information to give to the Council. A group from the State of Indiana talked with Senator Lugar about funding. The homeless situation was discussed. Mayor Galligan reported that the ISTEA Tea return to Indiana was 81% and is now up to 94%. The meetings went well. In the next approximate four weeks curbs will be put in on Center and Louise Streets. Storm sewers will start Wednesday if it is not raining. The sewers are complete in this area. Mayor Galligan has been through the new Buckheads Restaurant. This is a first-class restaurant, good for Jeffersonville. The new Kingfish is the same way. The view is beautiful. This will bring a lot of people to Jeffersonville and help all ot Jeffersonville. This is just the tip of the iceberg for the City. There are problems now that people didn't think they would see. Rhonda drive residents cannot get out due to the traffic at the new Sonic Restaurant. The Highway 62 corridor is under study. Director Urban reported on a discussion he had with Sonic headquarters and it is hoped the opening of the Sonic on Spring Street will not cause as many problems. They do feel this will slow down in six weeks. Mr. Charlie Ruck said all who attend the Council meetings want to know what is going on and the speaker this evening could not be heard. He feels copies of presentations should be available to those in the audience. Mayor Galligan acknowledged this is a point well taken. There is a need March 16, 1998 Page 6 of 6 for a portable microphone. Councilperson Perkins suggests portable audio-visual equipment is needed. This will be looked into. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 8:10 P.M., seconded by Councilperson Ellis, passing unanimously.
