HomeMy WebLinkAbout03-02-98COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MARCH 2, 1998 The Common Council of the City of Jeffersonville met in regular session in the Multi-Pul'pose 'Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 2nd day ot March, 1998. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer C. Richard Spencer Jr. at the desk. Mayor Galligan welcomed all in attendance, asking all those present to stand as Reverend Joyce Seaman gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicky Conlin. Absent: None. Mayor Galligan presented the minutes of the meeting of February 17, 1997 for consideration by the Council. Councilperson Perkins made the motion to approve the minutes as presented seconded by Councilperson Wilder and carried unanimously. Clerk and Treasurer Spencer presented the claim list explaining three additional claims, fo~ consideration by the Council. Following all discussion, Councilperson Perkins made the motion to approve the claims as well as the additional as presented, seconded by Council President Conlin passing unanimously. Mr. Geraldo Rivera, representing Southern Indiana Tenants Union, told of some of the wor[ the group is doing, asking the Council for support. Mayor Galligan presented a Mayoral Proclamation designating March as Disability Awareness Month. Mr. John Walling, representing Koetter Construction, appeared before the Council to request passage of Ordinance No. 98-OR-14, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located At Fronting Brown-Forman Road From Agricultural To I-1. Mr. Walling presented maps and explained the area and the intended use. Councilperson Perkins made March 2, 1998 Page 2 of: the motion to pass Ordinance No. 98-OR-14 on the first and second reading, seconded b3 Councilperson Frantz, passing unanimously. Mr. Walling requested passage of Ordinance No. 98-OR-15, An Ordinance Changing Th~ Zoning Map Designation Of A Certain Tract Of Property Located At 4610 Middle Road'frorr 'Agricultural To I-1, explaining the area and intended use. Councilperson Ellis made the motion tc pass Ordinance No. 98-OR-15 on the first and second readings, seconded by Council Presidenl Conlin, passing unanimously. Attorney Larry Wilder appeared before the Council to request passage of Ordinance No. 98- OR-16, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Propert5 Located At 5800 Block Of Hamburg Pike From B-2 To B-3. Attomey Wilder explained the area and the intended use as an Entertainment Center saying it is the intent and purpose to be good neighbors. Them will be programs for the under privileged. Council President Conlin made the motion to pass Ordinance No. 98-OR-16 on the first and second readings, seconded by Councilperson Wilson passing on a vote of 6-0-1. Councilperson Wilder abstained. Attorney William Smith III appeared before the Council to request passage of Ordinance No 98-OR-17, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Located At 2715 Charlestown Pike, Jeffersonville, Indiana 47130 From R-2 To B-1. Attorney Smith explained the plans for an assisted living facility. Following all discussion, Councilperson Wilder made the motion to pass Ordinance No. 98-OR~17 on the first and second reading, seconded by Councilperson Frantz, passing on a vote of 6-1. Councilperson Perkins voted nay. Attorney Alan Applegate appeared before the Council to request passage of Ordinance No. 98-OR-18, An Ordinance Changing The Zoning Map Designation OrA Certain Tract Of Property Located At 3900/4000 Block Of Charlestown Pike From I-1 To R-1. Attorney Applegate explained the area saying there are plans for a 139 lot subdivision. Councilperson Wilder expressed concerns for homes being built in the area of the quarry. Attorney Applegate has talked with the people at the quarry and there is no real concern as the blasting in the quarry is moving away from the planned subdivision. All buyers will be informed of the quarry. Councilperson Perkins made the motion to pass Ordinance No. 98-OR-18 on the first and second reading, seconded by Council President Conlin passing unanimously. March 2, 1998 Page 3 of.' Attorney Applegate next requested passage of Ordinance No. 98-OR-19, An Ordinanc~ Changing The Zoning Map Designation Of A Certain Tract Of Property Located At 4000 Block O: Coopers Lane From I-1 To B-3. At this time there is no specific use intended for the area Councilperson Wilson made the motion to pass Ordinance No. 98-OR-19 on the first and seconc 'readings, seconded by Councilperson Ellis, passing unanimously. Deputy Mayor Phil McCauley presented Resolution No. 98-R-7, A Resolution Approving Statement Of Benefits For Purposes Of Property Tax Abatement (Brinly-Hardy). Councilpersor Perkins welcomed Brinly-Hardy to Jeffersonville making the motion to pass Resolution No. 98-R-7 seconded by Council President Conlin, passing unanimously. Attorney Bob Lanum requests passage of Resolution No. 98-R-8, A Resolution Approving Statement Of Benefits For Purposes Of Property Tax Abatement (Chemtrusion). Attorney Lanu~r stated Chemtrusion expects to double in size in the near future. The request is for a five yem abatement on machinery and equipment only. Mayor Galligan said Chemtrusion has been a gooc corporate citizen. Council President Conlin made the motion to pass Resolution No. 98-R-8 seconded by Councilperson Wilder, passing unanimously. Councilperson Wilson made the motion to pass Ordinance No. 98-OR-13, An Ordinanc Transferring Certain Funds Within Same Department (Common Council) on the third and finai reading, seconded by Council President Conlin, passing unanimously. Planning and Zoning Director Jim Urban explained the need for passage of Ordinance No. 98- OR-20, An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 97-OR-33 (Building Commissioner). Council President Conlin made the motion to suspend the rules for Ordinance No. 98-OR-20 seconded by Councilperson Frantz, failing on a vote of 6-1 with Councilperson Ellis voting nay. Council President Conlin then made the motion to pass Ordinance No. 98-OR-20 on the first and second readings, seconded by Councilperson Frantz, passing on a vote of 6-1, with Councilperson Ellis voting nay. Director Urban then requested passage of Ordinance No. 98-OR-21, An Ordinance Transferring Certain Funds Within Same Department (Building Commission). Councilperson Perkins made the motion to pass Ordinance No. 98-OR-21 on the first and second readings, seconded b, Councilperson Frantz, passing on a vote of 6-1 with Councilperson Ellis voting nay. March 2, 1998 Page 4 of 5 City Attorney Sedwick Galligan introduced Ordinance No. 98-OR-22, An Ordinance Establishing A Non-Reverting Fund For The Carnegie Library. Attorney Sedwick Galligan said thi., will be funded with the Build Indiana Fund money. Councilperson Perkins made the motion to pas., Ordinance No. 98-OR-22 on the first and second readings. Councilperson Perkins withdrew his 'motion. Councilperson Perkins then made the motion to suspend the roles for Ordinance No. 98-OR- 22, seconded by Council President Conlin, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 98-OR-22 on all three readings, seconded by Councilperson Wilson, passing unanimously. City Attorney Sedwick Galligan explained Resolution No. 98-R-9, A Resolution To Advertise For An Additional Appropriation (Motor Vehicle, Sanitation, and General Fund). Attorney Sedwick Galligan explained each line. Street Commissioner Ervin spoke in support of the Motor Vehicle and Sanitation requests. Councilperson Perkins made the motion to pass Resolution No. 98-R-9 seconded by Councilperson Ellis, passing unanimously. Councilperson Frantz would like to allow presentations, previously heard during a workshop regarding items on the agenda so the public can hear them. Councilperson Williams realizes the Build Indiana Fund money represents a small portion of the repairs that are needed on the Carnegie Library. The original estimates for repair were $850,000 to $1,000,000. He would like some form of layout of how these expenses will be handled. Councilperson Perkins stated Mayor Galligan deserves credit for getting the Build Indiana money. The main objective for the use of these funds are to stabilize the building. He feels the original estimate is on the high side and feels it can be done for one half to three fourths ora million dollars and this is with no consideration of any in-house or in-kind work. Attorney Sedwick Galligan said the plans for the building are in her office and all are welcome to review them. Couneilperson Perkins said he is getting paranoid regarding the Thunder celebration and the potential problems with the new Kingfish and Buckheads Restaurants. He feels they will need Police help to control the crowd. Attorney Sedwick Galligan said both restaurants have been told they cannot depend on Jeffersonville Police to control their area. Director Urban said Kingfish will have a chain link fence and they will charge to get into the area. They will have 15 security of their own. Buckheads will also have fence and security. Director Urban informed the Council the parking fee March 2, 1998 Page 5 of 5 for the piggyback will be $20, with most sold in advance. All issues are being worked on. Councilperson Ellis said he was in a local establishment recently and was told an employee of the Building Commissioner's Office had been in to inspect the grease trap. The $25 fee was paid in cash on the spot. Mayor Galligan will check on this. · ~ -' Councilperson Wilder feels the fee structure for grease trap inspections should be looked at and adjusted for the size of the restaurant. Clerk and Treasurer Spencer presented a claim for the new Carnegie Library Fund. All agreed to pay the claim. Council President Conlin will make copies for the Council of the material presented by Mr. Rivera. Council President Conlin acknowledged receipt ora resume from Mr. Kyle Williams, saying the Council now has three. These will be discussed at the next workshop which will be March 10 at 6:00 P.M. There will be an executive session for the first 15 minutes. Mayor Galligan said a lot of grease traps in the City are not being cleaned. There are nine schools without grease traps. Keeping the grease traps clean will cut down on a lot of sewer problems and problems at the plant. They are trying to do preventative things. Mr. Mike Hurt asked questions regarding the additional appropriations. Mayor Galligan explained the equipment that will be bought. Mayor Galligan said the City is picking up trash for the housing authority for free. This bill is equivalent to $56,000 year. There was an agreement between the Housing Authority and the City. The Housing Authority bought a truck for the City and the City will pick up trash for 10 years. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 8:45 P.M., seconded by Council President Conlin, passin~[~unanimoUsly.
