HomeMy WebLinkAbout1973-R-08 ESO UT OH RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA, APPROVING THE CLAYSBURG NEIGHBORHOOD DEVELOPMENT PROGRAM, THIRD ACTION YEAR, PROGRAM NUMBER INDIANA A-3, ANNUAL INCREMENT THEREOF AND FILING OF AN APPLICATION FOR FINANCIAL ASSISTANCE WHEREAS, under Title I of the Housing Act of 1949, as amended, the Secretary of Housing and Urban Development is authorized to extend financial assistance to Local Public Agencies in the elimina- tion and prevention of the spread of their slums and urban blight through undertakings and activities carried out under a Neighborhood Development Program; and, WHEREAS, the City of jeffersonville Department of Redevelop- ment has prepared and submitted a proposed Neighborhood Development Program and annual increment thereof covering the urban renewal areas described in Schedule A attached thereto; said proposed pro- gram and annual increment having been duly reviewed and considered: NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CiTY OF JEFFERSONVILLE, INDIANA: 1. That the Neighborhood Development Program and annual increment are hereby approved. The City Clerk-T~easurer is hereby directed to file a copy of said program and annual increment with the minutes of this meeting. 2. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal activities with Federal financial assistance under T~tte I~ including those relating to (a) the relocation of site occupantS~ (b) the provision of local grants-in-aid~ and (c) the prohibition of discrimination ment because of race, color, creed, or national origin. 3. That the financial assistance available under Title I is needed to enable the City of jeffersonville Department of Redevelop- to finance the undertakings and activities proposed in said program and annual increment. 4. That the City of jeffersonville Department of Redevelopment is authorized to file an application for financial assistance to carry out the Neighborhood Development Program and the annual increment thereof. said directed BE IT FURTHER RESOLVED that the Clerk-Treasurer of City Of jeffersonville, Indiana, is hereby ordered and to give notice as provided by law. Presented by me as of jeffersonville this Clerk-Treasurer to the Mayor of the City CLERK-TRE~URER ~/' - Approved 1973. and signed by me this day of -2- SCHEDULE A LEGAL DESCRIPTION Beginning at the northeast corner of the intersection of Eighth Street and Spring Street; thence in a north- erly direction along the east side of Spring Street to the southeast corner of the intersection of Ninth Street and Spring Street; thence in a westerly direction along the north side of Ninth Street to its intersection with the west side of Broadway; thence northwardly along the west side of BroadWay to its intersection with the south side of Sparks Avenue; thence westerly along the south line of Sparks Avenue to the City Limits; thence following the line of said City Limits to a point where said City Limits intersect the Pennsylvania Railroad right-of-way track; thence following the easterly llne of said right- of-way track approxlmate~ly 1,000 feet to a point; thence eastwardly to the City Limits; thence northwardly along said City Limits to Nineteenth Street; thence northeast' wardly along said City Limits to a point where said City Limits changes direction to a southeastwardly course; thence along said City Limits in a southeastwardly direc- tion to a point where said City Limits would intersect the north side of Pennsylvania Avenue, if extended; thence in a southeastwardly direction along said extension and thence along the easterly side of Pennsylvania Avenue to its in- tersection with the north side of Twelfth Street; thence in an easterly direction along the north side of Twelfth Street to its intersection with the east side of Watt Street; thence in ~ southeastwardly direction along the east side of Watt Street to its intersection with the south side of Eighth Street; thence in a westerly direction along the south side of Eighth Street to its intersection with the east side of Walnut Street; thence at right angles in a northerly direction to a point where said line inter- sects the north side of Eighth Street; thence in a westerly direction along the north side of Eighth Street to the place of beginning; CERTIFICATE OF RECORDING OFFICER THE UNDERSIGNED HEREBY CERTIFIES AS FOLLOWS: 1. That he is the duly qualified and acting City-Clerk Treasurer of the City of Jeffersonville, Indiana, (hereinafter called the "Locality"), and the custodian of the records of the Locality, including the minutes of the pro- ceedings of the Common Council of the City of Jeffersonville, Indiana (herein- after called the "Governing Body")- 2. That the attached Resolution is a true and correct copy of a Resolution, including the WHEREAS clauses, as adopted at a meeting of the Governing Body held on the ~ day of~, 1973, (hereinafter called the "Resolution of the Governing Body"). 3. Also attached hereto is a true and correct copy of the Urban Renewal Plan, which has been previously approved by the City of Jeffersonville Department of Redevelopment Commission, as evidenced by a duly certified Resolution of that body attached to the Plan, presented at the meeting, and approved by the Resolution of the Governing Body. 4. That the Resolution of the Governing Body has been duly recorded in the minutes of the meeting and is now in full force and effect. 5. That said meeting was duly convened and held in all respects in accordance with Law and the By-Laws of the Locality. To the extent required by Law or By- Laws, due and proper notice of said meeting was given. A legal quorum of mem- bers of the Governing Body was present throughout the meeting, and a legally sufficient number of members of the Governing Body voted in the proper manner and for the adoption of the ResOlution of the Governing Body. Ail other require- ments and proceedings under Law, the By-Laws, or otherwise, incident to the pro- per adoption of the Resolution of the Governing Body, including any publication, if required by Law, have been duly fulfilled, carried out, and otherwise observed. 6. If an impression of the seal has been affixed below, it constitutes the official seal of the Locality and this certificate is hereby executed under such official seal and was duly affixed by the undersigned at the time this certificate was signed. If no seal has been affixed below~ the Locality does not have and is not legally required to have an official seal~ 7. That the undersigned is duly authorized to execute this certificate.
