HomeMy WebLinkAbout04-19-2004COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA APRIL 19, 2004 The Common Council of the City of Jeffersonville met in regular session in the Multi- Purpose Meeting Room in the City County Building, Je£fersonville, Indiana at 7:30 p.m. on the 19th day of April 2004. , Mayor Rob Waiz called the meeting to order, w/th Deputy Clerk Lynne Mayfield and Clerk Treasurer Peggy Wilder at the desk. Also present was City Attorney Les Merkley. Mayor Waiz welcomed all in attendance, asking all those present to stand while Pastor Danny Wharf of Rolling Fields Baptist Church gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Ron Grooms, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, John Perkins, and Phil McCauley. Absent: None Lyndon Dodd of the Evening News presented a Community Service Award to Councilperson Barbara Wilson. Councilperson Perkins made the motion to approve the agenda with the addition of an ordinance mgm'ding Tax Warrants, to be item 14A, seconded by Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of April 5, 2004 Council Meeting, seconded by Councilperson Sellers and carried unanimously. Councilperson Wilson made the motion to approve the minutes of the April 5, 2004 Workshop with the correction that Councilperson Ed Zastawny did attend the Workshop, seconded by Councilperson Grooms, passing on a vote of 7-0. Councilperson McCauley made the motion to approve the claims list, seconded by Councilperson Perkins, passing on a vote of 7-0. There was no public comment. Councilperson Perkins made the motion to table Ordinance No.2004-OR-20, an Ordinance Authorizing City to Remove Debris, Trash, Garbage, Rubbish, Litter, Refuse, Junk, and Tires, seconded by Councilperson Wilson, passing on a 7-0 vote. Mayor Waiz suggested that Building Commissioner Segraves attend the next meeting to explain procedure on this matter. Councilperson Fetz made the motion to pass with an amendment Ordinance No. 2004- OR-21, an Ordinance Establishing a Tree Board on the 2nd Reading, seconded by Councilperson Perkins, passing on a 7-0 vote. The amendment states the Mayor will appoint three members to the Board and the Council will appoint two members. Councilperson Perkins made the motion to pass Resolution 2004-R-14A, a Resolution Utilizing Keystone Consulting Services, Inc. as a Software Systems Vendor for the Office of Clerk Treasurer Peggy Wilder, seconded by Councilperson Wilson, passing on a vote of 7-0. Councilperson Perkins made the motion to pass on the 1 st Reading Ordinance No. 2004- OR-22, an Ordinance Regulating News Racks, seconded by Councilperson Fetz, passing on a 7-0 vote. Councilperson Perkins made the motion to suspend the rules and pass on all three readings Ordinance No. 2004-OR-23, an Ordinance Concerning the Refunding by the City of Jeffersonville of it's Sewage Works Revenue Refunding Bonds, Series 1995; Authorizing the Issuance of Sewage Works Refunding Revenue Bonds for such Purpose; Providing for the Collection, Segregation and Distribution of the Revenue of the Sewage Works and the Safeguarding of the Interests of the Owners of the Sewage Works Refunding Revenue Bonds Authorized Herein; Other matters connected therewith; and Repealing Ordinances inconsistent herewith, and seconded by Councilperson Fetz, passing on a 7~0 vote. Councilperson Perkins made the motion to pass on all three readings Ordinance 2004-OR-23, seconded by Councilperson Fetz and passing on a 7-0 vote. City Attorney Merkley presented Ordinance 2004-OR-24, an ordinance recommending a Tax Anticipation Warrant in the amount of $7,000,000.00 for the City General Fund. Councilperson Perkins made the motion to suspend the rules for Ordinance 2004-OR-24, seconded by Councilperson McCanley, passing on a 7-0 vote. Councilperson Perkins made the motion to pass Ordinance 2004-OR-24 on the first, second, and third readings, seconded by Councilperson McCauley, passing on a 7-0 vote. Comments: Councilperson Perkins said the workshop was good. He is pleased about the $236,000.00 savings due to the Bond Refinancing by Redevelopment. He said $1,000.00 for the Howard Steamboat Museum would on the next agenda. He praised the Mayor and the Police and Fire Departments for a job well done with Thunder Over Louisville. Councilman Zastawny commented again about the money to be saved by the refinancing of the bonds. He said he hasn't received his stationery. Clerk Treasurer Wilder said she would check on it for him. He requested copies of the Ordinance Code Book. City Attorney Merkley said several years ago the City entered into a contract with a company that recodifies ordinances but some of the ordinances were done incorrectly. Because of the errors they will have to be redone. Clerk Treasurer Wilder said the Ordinance book we have is too old to work with, as it's almost ten years old. She said many additions and changes have been made since then. She said she would get Councilperson Zastawn a copy of the old book for the time being. Councilperson Fetz complimented the Police and Fire Departments on the handling of Thunder Over Louisville. He said both Police and Fire Union presidents have contacted him to discuss contract negotiations. Councilperson McCauley, Councilperson Zasta~vny, and Councilperson Fetz plan to meet with the Unions. Councilperson Fetz asked the time frame for the web site to start. Clerk Treasurer Wilder said it needs to be discussed with Rich Davis, the City Attorney, and the gentleman working on the site. Councilperson Sellers said she received a call from several constituents that live on SZ4var-ban Court m regard to water standing in their cul-de-sac when it rains. She said the last administration scraped off part of the pavement and now they can't pull into their driveways without damaging their vehicles because of the sharp angle. They have talked to Street Commissioner Ellis and to Engineer Miller. They've been told what needs to be done but nothing has been done. Mayor Waiz said he would talk to Engineer Miller and Street Commissioner Ellis. Councilperson Wilson said she attended the Parks Board meeting and the pool is to open on May 31st and the walking trail. She said she met with Chief Miles and went through Station 2. She said it needs a lot of sprucing up. She said she thinks this Thunder was the best one yet. She asked Mayor Walz if he intends to start work on the streets. Mayor Waiz said Street Commissioner Ellis is compiling a list of streets so she can call him. Councilperson Grooms said the Solid Waste Boards next meeting is May 6, 2004. One of the items on the agenda will be to request that funding for the solid waste district come from Cagit money. Another option to be looked at is a tax levy that would be approved by the County Council and Commissioners ~vhere money would be added to the tax rolls for Solid Waste. The third alternative being considered is a separate line item on the tax bill to be approved by the County Council, the County Treasurer, and Auditor where the solid waste fees would be collected. The Clark County Solid Waste Board would no longer send th; bills. These options are in the consideration stage. Councilperson Grooms said he has received two calls from police and fire retirees about the rise in insurance. Mayor Waiz said there had been no change in four years. Councilperson Grooms said he talked to Street Commissioner Ellis about leasing versus privatizing sanitation pickup. Street Commissioner Ellis is getting bids and studying the cost of privatizing versus the City doing the sanitation pickup. Street Commissioner Ellis estimates that he will have about $220,000.00 in his budget for paving. His intention is to use most of it for Tenth Street, Spring Street to Main Street, and Hamburg Pike. Councilperson Grooms said he and City Attorney Merkley discussed presenting a Resolution whereby the Council takes a position that donations to non-profit organizations and other organizations in the city must be presented during the budget session preceding the year they are to receive the money. Councilperson McCauley said the motions Redevelopment made and the Council made in refinancing bonds saves $741,000.00. Councilperson McCauley said he received correspondence from Perrin Park. They are concerned about public safety in so far as the condition of Perrin Lane. Perrin Park has offered to work with the city in some fashion. The cost is too much for the city to do alone. Councilperson McCauley said no applications have been received for a City Council attorney. He asked the Council to allow him to create a correspondence with the attorney's who regularly practice in the Courts of this building. There was no objection by the other Council members. He said he was happy to read that Veteran's Parkway is going to open May 23, 2004. He said he has a meeting scheduled with representatives who want to keep the Council informed about development along that Parkway inside the City. He said he really likes the way the Tree Ordinance was written. He thinks it will be excellent for the City. Mayor Waiz praised everyone involved in Thunder Over Louisville. He said Sunday morning after Thunder the Jeffersonville High School Band helped with the clean up.
