COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CiTY
OF JEFFERSONVILLE, INDIANA
MARCH 18, 2002
The Common Couneil of the City of Jeffersonville, Indiana met in regular session in
Muki-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30
on the 18th day of March 2002.
The meeting was called to order by Mayor Thomas R. Galligan, with Clerk Trea
Peggy Wilder at the desk. Also present were City Attorney Anne Marie Galligan, and Det
Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those presen
stand as Councilperson Ron Ellis gave the invocation. Mayor Galligan then asked all ti
present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Les Merkley, Ron
Denny Frantz, Rob Wa[z, and Barbara Wilson.
Absent: Coancilpersons Ron Grooms and Vicki Conlin
Conncilperson Ellis asked that item #16 on the agenda be removed. Councilp.
Merkley then made the motion to approve the agenda as amended, seconded by Councilpe
Waiz, passing unanimously.
Mayor Galligan presented the minutes of the meeting of March 4, 2002 for considere
by the Council. Councilperson Wilson made the motion to approve the March 4, 2002 min
as presented, seconded by Councilperson Merkley, passing unanimously.
Clerk Treasurer Wilder presented the claim list for consideration by the Cou
explaining two additional claims. Council Attorney Jack Vissing reviewed his memo to the
Council suggesting a compromise to regarding the claim for Police cars (attacl
Councilperson Waiz made the motion to accept Mr. Vissing's proposal, seconded
Councilperson Ellis, passing on a vote of 4-1. Council President Frantz voted no. Councilpe
Ellis made the motion to table the claim to Bloomington Ford in the amount of $142,570.7

PUBLIC COMMENT:
Ms. Barbara Anderson appeared before the Council requesting a donation of $30,000
emergency shelter for this year. She also requests emergency shelter be included in the bur
next year. Ms. Anderson distributed a fact sheet of those served and invites calls for
questions. She can be reached at 284-3373, Ext. 105. Mayor Galligan said this is a good set
to the community. Councilperson Waiz would like to look over the information.
Ms. Jill Schimpffof Schimpff's Confectionery, appeared before the Council as a men
of the Bi-Centeunial Committee to request collections for display during the celebration.
also said the committee is looking for items that could be auctioned.
There were no department reports.
AGENDA ITEMS:
Mayor's Assistant Dustin White invited the Council to a meeting with Hyatt P~
Consulting regarding the Urban Enterprise Zone on April 2. Mayor Galligan will speak tc
Rotary Club at noon on March 19. The Sanitary Sewer Board approved longevity at their
meeting. The Department of Redevelopment is looking into a web education bridge Pm

Attorney Galligan presented and explained Ordinance No. 2002-OR-6, An Ord~
Regulating The Excavation And Restoration Of Street And Alley Pavements (Paved
Unpaved) Within The Public Rights-Of-Way Under City Of Jeffersonville Jurisdiction, as
the Council treat this as a new Ordinance. Councilperson Merkley made the motion to
Ordinance No. 2002-OR-6 on the first reading, seconded by Councilperson Waiz, pa~
unanimously.
Mr. Allen Applegate, Attorney representing LPI Investors, appeared before the Co~
to request approval for a voluntary annexation by Utica. Attorney Applegate explained the
Councilperson Waiz made the motion to pass Resolution No. 2002-R-15, A ResolutioJ
Approve Utica Annexation, seconded by Councilperson Merkley, passing unanimously.
Ms. Lisa Thompson, Assistant Director, New Directions Housing, appeared befor~
Council to request a donation of $7,500 for the Repair Affair program. Ms. Thom

Repair Affair in Southern Indiana
A request for support to The City of Jeffersonville
from Repair Affair, a program of New Directions Housing Corporation
Requested amount: $7,500
Total project budget: $30,500
For most Americans, home is more than shelter. Owning a home is part of the dream of
independence and the earned reward for years of employment. Repair Affair is dedicated to the
support of the elderly and disabled as they are chaUenged as homeowners.
It is critically important that elders or those who are physically disabled have continued options to
Eve in the neighborhood homes they worked their lifetimes to own.
Repair Affair homeowners live in the most established neighborhoods in our community, many hay
bought their homes 25, 30 or even 40 years ago. By strengthening the safety and security of their
homes, we also strengthen neighborhoods.
On Saturday, June 8, 2002, Repair Affair's
200 volunteers will focus their repair
efforts on 25 homes in Southern Indiana-
with at least 10 of these homes being
located in The City of Jeffersonville.
Your sponsorship of Repair Affair will go a
long way toward providing safety and and
a renewed sense of independence to the
elderly and disabled homeowners in
Jeffersonville.

In 200~, of 11 Jeffersonvilie applicant homes,
10 received help from Repair Affair's teams.
So far in 2002, three elderly homeowners have
applied for help and outreach is ongoing to
locate others.

Memo to Jeffersonville City Council
From John R. Vissing, Attorney at Law
In re: Cumulative Capital Development Fund
March 18, 2002
Reference is made to my Memo dated March 3, 2002.
I have reviewed the pertinent statutes and your
budgetary practices and it is still my opinion that the
Jeffersonville City Council correctly excluded from
the 2002 budget any purchase of new police cars. I
further believe that consistent with my Memo the
individuals who ordered new police cars in defiance
of the budget did so at their own risk and at odds with
the best interests of the Jeffersonville taxpayers.
Further that no emergency existed to justify such an
expense. These individuals who ordered the new
police cars are subject to damages for the results of
their actions.
The issues have become political and are not issues in
thebest interests of the taxpayers of Jeffersonville. In
an effort to offer to the Administration an opportunity
to keep the new police cars, yet respect the
responsibility of the City Council to budget taxpayers
money to operate the city a compromise is offered.
The City Council should only approve this claim
subject to the following terms:
That the Administration in writing admit that
the act of ordering the police cars with
knowledge that they were not budgeted was
wrong.
That no furore violations of the budget process
be taken by the Administration and that the
Administration will participate in preparation of
future budgets in good faith.
That on or before March 27, 2002, the
Administration will provide in writing for
Council approval and adoption specific
expenditures for the Cumulative Capital
Development Fund for the remainder of 2002
in amounts that will not exceed the $200,000
budgeted less the cost to pay the claim for the
new unbudgeted police cars. In other words the
Administration in writing will advise the
Council and the City Departments how to fund
projects valued at $200,000 by using only
$50,000 that will likely remain.
