COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
MARCH 4, 2002
The Common Council of the City of Jeffersonville, Indiana met in regular session in
Muki-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30
on the 4th day of March 2002.
Mayor Galligan asked to honor two Jeffersonville High School swimmers that rec
won state titles, as well as their coach. Students Ben Hesen and Marsh Lindley with Coach (
were congratulated by all in attendance. Mayor Galligan thanked the students for all their
work, telling them to keep it up. They have done a good job of representing their coach, ·
team, and their school. Mayor Galligan told them "You make us proud".
The meeting was called to order by Mayor Thomas R. Galligan, with Deputy C
Barbara Hollis at the desk. Also present was City Attorney Anne Marie Galligan. ME
Galligan welcomed all in attendance, asking all those present to stand as Councilperson i
Grooms gave the invocation. Mayor Galligan then asked all those present to join him in
pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Les Merkley, Ron
Denny Frantz, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin.
Absent: None.
Councilperson Grooms made the motion to approve the agenda as presented, second
Council President Frantz, passing unanimously.
Mayor Galligan presented the minutes of the meeting of February 25, 2002
consideration by the Council. City Attorney Galligan asked to have "without proper notice
violation of Indiana Open Door Law" inserted in her comment regarding meetings on pal
Councilperson Wilson made the motion to approve the February 4, 2002 minutes as corre~
seconded by Councilperson Waiz, passing unanimously.
Clerk Hollis presented the claim list for consideration by the Council. Councilpe
Ellis asked Attorney Jack Vissing to comment at this time regarding the claim for 7 new p~
cars. Attorney Vissing reported his f'mdings (attached). Councilperson Conlin said it is sad
the police department is suffering and she apologizes to the department. City Attorney Gall

presented a handout outlining what she feels Attorney Vissing missed. She reviewed the 5
appropriation order appropriating $305,000 into the Cumulative Capital Development Fund
capital purchases explaining it is the executive's prerogative to use this money. The Counc

Attorney Vissing noted the Council intentionally did not fund certain items. Mayor Galli
noted there is money appropriated. Attorney Vissing's advice is the claim is an inappropx
claim. Attorney Vissing then read the list of capital purchases that were removed bom
budgets for capital purchases. Council President Frantz noted there is $200,000 to satisfy cat
needs and it is the Mayor's choice to determine how it is spend. Attorney Vissing suggests
claim be tabled tmtil the matter can be worked out. Councilperson Ellis then made the motio
table the claim for $142,570.75 from the Cumulative Capital Development Fund, seconde~
Councilperson Merkley, passing on a vote of 5-2. Councilpersons Conlin and Frantz voted

Wilson, passing unanimously.
PUBLIC COMMENT:
Mr. Doug Toland, Bi-Centennial Committee member, appeared before the Counci
review the plans for the celebration. City vendors have been generous with their support.
Toland presented certificates of appreciation to Mr. Mike Pepper of Independent Concret
Pipe and Mr. Ken Rush of Sellersburg Stone.

AGENDA ITEMS:
Mayor's Assistant Dustin White reported this past week the City instituted a pre
which will define the agenda for the downtown historic district. The consultant will be lq
Palmer f~om Virginia. This will defme a clear plan for the development of downtown

Mayor Galligan will give the State of the City address by the end of March. This week
administration will be meeting with Congressman Hill and representatives of Senators Bayh
Lugar regarding matters relative to this area. There will be a meeting tomorrow at K

members of the African American Clergy, will be brainstorming and developing a program

Councilperson Ellis stated he had requested a list of City projects at the last meeting and wc
like to know when this will be available. Assistant White said each meeting he will give
update on relevant activities and projects. Councilperson Ellis said he is requesting an offi
list of all projects in the City at this time. Assistant White asked Councilperson Ellis to reque
specific list and state the statutory authority. Councilperson Ellis said he will have his attor
reply. Assistant White said all taxpayer money is approved by the Council.
Attorney Galligan stated she received a request from the petitioners to table Ordina
No. 2002-OR-2, An Ordinance Annexing Contiguous Territory By Voluntary Petition (Aberd
Place). Councilperson Conlin made the motion to table Ordinance No. 2002-OR-2, seconder
Conncilperson Waiz. Councilperson Waiz asked why the request was made. City Atto~
Gailigan understood they needed time to take measurements and talk to neighbors. The mo
to table passed unanimously.
Ordinance No. 2002-OR-3, An Ordinance Of Additional Appropriation (City Court),
presented to the Council for consideration. Councilperson Waiz made the motion to
Ordinance No. 2002-OR-3 on the second and third readings, seconded by Councilperson Co
passing unanimously.
Ordinance No. 2002-OR-4, An Ordinance Of Additional Appropriation (Motor Veh/
was presented to the Council for consideration. Councilperson Merkley made the motion to
Ordinance No. 2002-OR-4 on the second and third readings, seconded by Councilperson Wi
passing unanimously.
Ordinance No. 2002-OR-5, An Ordinance Of Additional Appropriation (Probation 1
Fund) was presented to the Council for consideration. Councilperson Grooms made the mo
to pass Ordinance No. 2002-OR-5 on the second and third readings, seconded by Councilpel
Conlin, passing unanimously.
Conncilperson Conlin asked for a discussion and a commitment to proceed by
Council on the Court Avenue extension project. Councilperson Merkley said the project is ]
overdue. Councilperson Wilson would like to see the project made a reality. Councilpe:
Conlin said she supports the project. Councilperson Grooms said he has no problem '
proceeding. Councilperson Waiz said he is in favor, as did Councilperson Ellis. Councilpe
Conlin then made the motion to pass Resolution No. 2002-R-13, A Resolution To Advertise

An Additional Appropriation (Cumulative Capital Improvement - $300,000), seconded
Councilperson Merkley. Councilperson Frantz asked what the project stage is. City Engi~
Miller said he hopes to have the project ready to bid by April 1 and completion by the end of
year. The motion to pass Resolution No. 2002-R-13 passed unanimously.
COUNCIL AND MAYOR COMMENTS:
Councilperson Ellis noted his request for a list of on-going projects for the City is pu
record. If there is denial of a public record, he will file an official complaint. City Attm
Galligan said records are available, however to have records compiled in a certain manner is
required.
Councilperson Wilson noted redistricting is to be done this year and she sugges
meeting on the subject. City Attorney Galligan read dates of meetings conducted by I.A.C.~[
redistricting. Councilperson Ellis has attended three workshops and has information from
workshops as well as the information the County used. The deadline for passage is Novemb~
Councilperson Frantz has a map from Jacobi, Toombs, and Lanz Engineers. The Council
meet at 6:30 P.M. on March 18 in Council Chambers.
Councilperson Grooms called attention to articles in Nations Cities Weekly regardi]
City Hall in Minnesota and a robot used in sewer lines.
Councilperson Conlin related that Plan Commission approval becomes law after 90 ~
unless denied by the Council. Councilperson Conlin would like to know how the Council ca
assured Plan Commission actions come to the Council. City Attorney Galligan said there

Mayor Galligan again congratulates the students from Jeff High, saying the commu
needs to be proud of them. Councilperson Merkley recognized the Jeff High students that
been videotaping the Council meetings for broadcast on cable television. Councilperson C*
asked about signs for Olympic Medal winner Doug Sharp and the Jeff High swimmers. M,
