HomeMy WebLinkAbout11-05-01NOVEMBER 5, 2001 1 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 5, 2001 The Common Council of the City of Jeffersonville, Indiana met in regular session ir Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:00 on the 5t~ day of November, 2001. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Trea Peggy Wilder at the desk. Also Present were City Attorney Anne Marie Galligan, and Deli Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those presen stand as Councilperson Ron Ellis gave the invocatior~ Mayor Galligan then asked all tt present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Les Merkley, Ron E Denny Frantz, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin. Absent: None. Council President Merkley made the motion to remove Item #11 fi.om the ageJ seconded by Councilperson Conlin, passing unanimously. Council President Merkley then m the motion to remove Items #16 and #17 fi.om the agenda for this meeting and place them on agenda for the next regular meeting, seconded by Councitperson Waiz, passing unanimou Council President Merkley then made the motion to add as Item #1SA, the CASI Resolut seconded by Councilperson Conlin, passing unanimously. Council President Merkley made motion to approve the agenda as amended, seconded by Councilperson Ellis, pas~ unanimously. Mayor Galligan presented the minutes of the meeting of October 15, 2001 consideration by the Council. Councilperson Ellis made the motion to approve the minute presented, seconded by Councilperson Conlin, passing unanimously. Clerk and Treasurer Wilder presented the claim list for consideration by the Corn Councilperson Ellis made the motion to approve the claims as presented, seconded Councilperson Conlin, passing on a vote of 5-2. Clerk Treasurer Wilder explained the State Board of Accounts is only concerned' payments are made fi:om the appropriate categories, not specific line items. PUBLIC COMMENT: Mr. Allen Morris, Attorney with the £a'm of Stites and Harbison appeared before Council to ask the Council to strongly look at passing the CASI Resolutiom Attorney Mc stated there have been problems in the past, however the group has been reorganized an~ under new leadership. Ms. Linda Hendershot, President, CASI Policy Board, appeared before the Counci explain the problems with the building and encourage the Council to pass the Resolutiom thanked the Council for their suppo~ in the past. Councilparson Conlin explained 64 stud, are homebound due to the problems with the building. She asks the Council to think about kids. AGENDA ITEMS: Mr. David Francke, did not appear, therefore no action was taken. Mr. John Kraft, Attorney, was not in attendance regarding Ordinance No. 2001-OR. An Ordinance Amending The Zoning Ordinance Of Jeffersonville, Indiana (Tri-Sl Development Company, LLC). Council President Merkley made the motion to table Ordin~ No. 2001-OR-32 until the next meeting, seconded by Councilperson Grooms, pas~, unanimously. Mr. Kraft will be notified. Attorney Galligan presented and explained the need for passage of Ordinance No. 2£ OR-34, An Ordinance Repealing Section 92.06 Of The Code Of Ordinance Of The City Jeffersonville, Indiana And Establishing Opening Burning Regulations For The City Jeffersonvitle, Indiana. Councilperson Conlin made the motion to pass Ordinance No. 20014 34 on the second and third readings, seconded by Councilperson Waiz passing unanimously. Attorney Galligan presented and explained Ordinance No. 2001-OR-35, An Ordim Transferring Certain Funds Within Same Department (City Attorney). Councilperson Co: made the motion to pass Ordinance No. 2001-OR-35 on the first and second readings, secon by Council President Merkley, passing unanimously. Ordinance No. 2001-OR-36, An Ordinance Transferring Certain Funds Within S~ Department (City Engineer), was presented for consideration by the Council. Mayor Galligan presented Ordinance No. 200t-OR-37, An Ordinance Of Additk Appropriation (General Fund), announcing the meeting was advertised as a public hearing this Ordinance. Ms. Diane Swank of the Culpepper Group, gave a presentation on the fman status of the Health Insurance Fund. There is concern for the "nm off' claims. Councilpe~ Conlin made the motion to pass Ordinance No. 2001-OR-37 on the first reading in the amour $150,000, seconded by Council President Merkley. Mayor Galligan asked for public comm Following discussion, Councilperson Conlin made the motion to amend the motion to $100,1 seconded by Council President Merkley, passing on a vote of 5-2. Councilpersons Waiz Merkley voted no. Attorney Galligan asked the Council to look for funds to pay the bill of $2,000 to $6, for codification. Resolution No. 2001-R-28, A Resolution Of The Jeffersonville Common Cou Approving A Declaratory Resolution And Economic Development Plan Of The Redevelopn Commission Of Jeffersonville, Indiana, And Approving An Order Of The Jeffersonville Commission Concerning The Community Action Of Southern Indiana Economic Develop~ Area was presented for consideration. Director of Redevelopment David Duggins apologizex not having this Resolution in the Council packet. Councilperson Conlin made the motion to Resolution No. 2001-R-28, seconded by Councilperson Ellis. Councilperson Waiz notec Council has been waiting for a lease. Attorney Galligan explained the advantages of g~ through the Redevelopment Commission rather than the Council. The group is under restraints. Councilperson Wilson would like to see the lease before passing the Resolu Director Duggins explained the Redevelopment Commission has negotiated leases previo and is prepared to negotiate this one. Councilperson Conlin has concerns for the time restr~ and a concern for the Head Start Program. Councilperson Grooms asked Director Duggins ~ he knew this would be on the agenda. Director Duggins replied October 24, 2001 was the he knew. Councilperson Grooms said the Council spent four months waiting for this and nox f'mds out it will be turned over to Redevelopment. Mayor Galligan said the Redevelopment Commission is the logical pl~ Councilperson Grooms still questions why the Council spent four months on this. Councilpe~ Ellis feels the Council is looking at the life and death of the programs. Again, Cotmcilpe~ Grooms explained he doe not disagree with the end result. Mr. Gary Leavell, President NAJ said it is ail about our children and he appreciates all the Council has done in the 1[ Councilperson Wilson said she is very much in faVOr of the program, however she is not ha with the way it has been handled. She is very very unhappy as the Council has been wai some time to see the lease and they are not going to get it. Resolution No. 2001-R-28 passe( the following roll call vote: Ayes: Councilpersons Merkley, Ellis, Frantz, Wilson, and Conlin. Nays: Councilpersons Waiz and Grooms. COUNCIL AND MAYOR COMMENTS: Councilperson Grooms said it is unfortunate to go through the process of government we have and then things are not done the way they were lead to believe. These are things bother Councilperson Grooms. It bothers him that City of Jeffersonville equipment is being t in Utica and he would like an explanation. Mayor Galligan explained that Utica has drair problems and they asked for help. Utica is paying for the work. Jeffersonville is trying to~ good neighbor. Utica stood by Jeffersonville for INNAP. Mayor Galligan feels tha' communities we need to help each other. Councilperson Coniin appreciates the vote for the Head Start program. The end resull the children is what is important. Councilperson Conlin gives thanks to the Parks Depart~ for Halloween Downtown. She explained she was the "Tin Man". Councilperson Wilson has been asked about the leaf pickup. Mayor Galligan said le,' will be picked up on garbage day. Leaves should be raked to the gutters. Councilperson Waiz said he feels like Councilperson Grooms does about the way CASI Resolution was done. This should have been done three months ago. Mayor Gall! apologized for the delay saying it was not the Council's fault. Councilperson Ellis said the Council did something good and right by passing the C Resolution. The Council has to look out for the children. There has been some bickering now is the time for healing. He asks if Council objects to spending $200 for letterhead. There were no objections voiced. The ~ meeting will be Friday at noon. Council President Merkley reminded all that NLC registratio due. He thanks the Street Department and the Mayor for the work done on 8t~ Street. Mayor Galligan explained there have been some complaints from motorists sustah damage while 8th Street was under construction. He explained motorists travel at their own ~ He does understand the problem. Some barricades were run down. The project would have, too much to do in small sections. Mayor Galligan also thanks the Park Department Halloween Downtown. Mayor Galligan announced Life Springs is moving downtown. thanks Fred for working with the City on CASI. It was a tough process and he t~ responsibility for any mishandling. He thanks those who voted for the Resolution understands the no votes. He does not believe the no votes were votes against the kids. Mt Galligan hopes to pave 8t~ Street in the next few days. Mayor Galligan wishes all a Ha Veterans Day.
