An Ordinance Amending and Adding to Ordinance No. 72-OR-36, which Ordinance is the Adopting Ordinance of the Fire Prevention Code of the City. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA, that Ordinance No. 72-OR-36, which ordinance is the adopting ordinance for the Fire Prevention Code of the citY as enacted December 4, 1972, is amended and added to as follows: Section I. That such'adopting ordinance is amended and changed in that Section 5.1 Establishing Rules and Regulations of Self-serVice Gasoline Filling Stations is added to and shall read thus: o~C ~ I0~ ~ ESTABL!S?~i~G. Self service stations shall mean that portion of property where £1~um~able and con~bustibl~e liquids used as motor fuels ~re stored ~ud subsequently dispensed ~roz £z~ed approved dispensing equipment into the fuel tanks of moto~ vehicles by persons othe~' than the servlc~ station at Sendm%t. 2..a. Approved dispensing devices such as cozn-ope~ated, card operated and remote c~ontrolled types a~,e permitted at self service stations availa!~le and open to ~he public, provided that all dispen- ~zng of Class i liquids shall at all times be ~der the i~uediate observation and control of a co~petent attendant who shall not engage in.duties other than those pertaining tO the operation of the dispen- s lng of fla~muable .liquids. ~ Du~ing the actual dispensing ~of Class I fire, unable liquids the attendant or supervisor on duty ~uust be in direct co~z~r~nication with these persons~perfor~ing such dispensing. co~r~'~uuications systera shall be considered to be An approved two way in compliance. b~. The attendant or supervisor on duty shall be mentally and physically capable of perfor~uinE the functions and assuming the re- sponsibility prescribed in this section. 4.~ P~ire ~Lxtin&~ishers: The type, size and location of fire extir, guishers for self service stations shall be determined by the aut~ority having Jumisdictton. -~ ~a' ~rgency Power .C~t-O~f: A oles~ly identified and easily accessible switch(es) or circuit bre~er(s) shall be provided at a location remote frown dispensing devices, including remote pumping systems, to shut off the power to all dispensing devices in the event of an eraergency. Operating instruction printed black letters on a contrasttr~ bacl~J~ound in not less than 1/2 inch shall be posted at each self service dispensing device and in full view so as to give complete and clear instructions for its operation. Warning signs printed in not less than t~hree inch letters on a contrastfn~ backgrotu~d shall be conspicously posted in the dispensing area incorporating the following or equivalent wording: (a) WARNING .... iT IS U~LAh~b-L ~D DANG~--ROUS TO DISP~SE GASOLINE ~NTOUNAPPE0~ED CONTAINERS; (b).N0 SMOKING; and (c) STOP MOTOR. 7~ The dispensing a~ea ,shall be, at all times, in cleal* view of the attendant ~d the placing or allowing of any obstacle to come between the dispensing area and the attend'~ant control a~ea shall be prohibited, provided, however, the presence of motor vehicles in the service driveway for the p~pose of being serviced shall not be con- ~Idered to be an obstacle as prohibited in this paragraph.' The use indirect reflections or other mechanical devices to accomplish such view is prohibited. 8. Hose nozzles used on self service devfce~ at self service stations shall be of the approved au~o~atic closing ~ype without a latch-open device. Approved dispensing tu~lts must utilize approved s~ivels on the nozzle hose end. 9_~. No dwelling unit for the attendant or sleeping facilities for the attendant shall be maintained in, or on, the pre~aises of a self service sta'r, ion closer than 100 feet from Class I Fl~.~xble liquid self service dispensing devices, or ~0 feet f~o~u Class II Fia~maable liquid self service dispensing devices. Section 2. That the Fire Prevention Code as enacted by Ordinance No. 72-0R-36 is amended in that Section 1.1 The Intent of the Code shall read and be as follows: A/~ticle !
