HomeMy WebLinkAbout06-18-01COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 18, 2001 The Common Council of the City of Jeflrersonville met in regular session in the Multi-Purpos Meeting Room in the City-County Building, Jeffersonvilte, Indiana, at 7:00 P.M. on the 18th day o June, 2001. The meeting was called to order by Council President Les Merldey, with Deputy Clerk/ Barbara Hollis at the desk. Also present was Council Attorney Dawn Elston. Council President / Merkley welcomed all in attendance, asking all those present to stand as Councilperson Ron Gro0n~ gave the invocation. Council President Merldey asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Les Merkley, Ron Ellis, Denn Frantz, Rob Waiz, Barbara Wilson, and Ron Grooms. Absent: Councilperson Vicki Conlin. Council President Merkley presented the minutes of the meeting of June 4, 2001 fo? consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Coun¢ilperson Grooms, passing on a vote of S-0. As chair of the meetin Council President Merkley did not vote. Councilperson Grooms made the motion to apprOve the agenda as presented, seconded 1 Councilperson Waiz, passing on a vote of 5-0. Council President Merkley did not vote. Deputy Clerk Hollis presented the claim list for consideration by the Council. Councilpersoh · Waiz made the motion to approve the claims as presented, seconded by Councilperson Groo , / passing on a vote of 4-1. Councilperson Ellis voted against passage and Council President Merkle~ did not vote. PUBLIC COMMENT: There was no public comment. AGENDA ITEMS: Council President Merldey presented Ordinance No. 2001-OR- 13, An Ordinance Amendi~ June 18, 2001 Page 2 of 1 SS93.01 Through 93.32 Oftbe Jeffersonville Municipal Code Concerning City Garbage Collectio~ for consideration on the third reading. Councilperson Ellis stated his objection to 93.31. He feels on sthat one person should not have the authority to arbitrarily set rules and regulations. He opini ' I roles and regulations should be approved by another governing body. Councilperson Grooms made the motion to pass Ordinance No. 2001-OR-13 on the third reading, seconded by Councilpersoh'! Waiz. Councilperson Ellis made the motion to amend Ordinance No. 2001-OR-13, Section 93.31 first sentence, to include "with the approval of the Council or the Board of Public Works", seconde. by Councilperson Frantz, passing on a vote of 4-1. Councilperson Waiz voted against the amendmer and Council President Merkley did not vote. Council Attorney Dawn Elston suggested the sam amendment be made to the second sentence in Section 93.31. Councilperson Ellis made the motio to amend the second sentence as suggested by Council Attorney Elston, seconded by Councilperson Frantz, passing on a vote of 5-0. Council President Merkley did not vote. He also has reservations on a couple o clauses. The vote to pass Ordinance 2001-OR-13, as amended, failed on a vote of 0-5. Council President Merktey did not vote. Council President Merkley presented Ordinance No. 2001-OR- 15, an Ordinance Transferrin Certain Funds Within Same Department (Cumulative Capital Development). Councilperson Grooms the Ordinance for the audience. Councilperson Grooms then made the motion to pas~! explained Ordi~.ance No. 2001-OR- 15 on the second reading, seconded by Councilperson Waiz, passing on a vote of 4-1. Councilperson Ellis voted against passage and Council President Merkley did not rot{.' Council President Merkley presented Ordinance No. 2001-OR- 16, An Ordinance mending' SS35.10 (C) Of The Jeffersonville Municipal Code Concerning Sick Leave. Councilperson Ell' stated his concerns for the effect on employees. Council Attorney Elston recommends defeat o f tk Ordinance as some employees are under contract. She recommends defeat or table until after tl~ current contract negotiations are complete. She does not feel this belongs in a City Ordinanc~ Council Present Merkley received a call fi.om City Attorney Anne Marie Galligan explaining the ! (5) days should read ten (10) and thirty (30) days should be forty (40). Councilperson Waiz theh made the motion to table Ordinance No. 2001-OR-16 until the next meeting, seconded by/ June 18, 2001 Page 3 of: Councilperson Frantz, passing on a vote of 5-0. Council President Merkley presented Ordinance No. 2001-OR-18, An Ordinance Vacatin Part Of Platted Right-Of-Way In Jeffersonville, Indiana, explaining the area and the neet Councilperson Grooms made the motion to pass Ordinance No. 2001-OR-18 on the first readin seconded by Councilperson Waiz, passing on a vote of 5-0. Council President Merkley did not vot COUNCIL'COMMENTS: Councilperson Grooms introduced Aaron Neely who will graduate from high school next year and will be joining the U. S. Navy. / Councilperson Frantz informed all in attendance that Firefighter Gary Kinnaird won the gol medal in his event at the Police and Fire World Games. Firefighter Kinnaird represented the City Council President Merkley received a call from Jeffersonville Township Trustee Dale Popp who will be hosting the Trustees Conference at the Holiday Inn Lakeview, requesting door prizeS. There being no further business to come before the Council, Councilperson Frantz made ti motion to adjourn at 7:25 P.M., seconded by Councilperson Wilson, passing unanimously.
