HomeMy WebLinkAbout02-05-01COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA FEBRUARY 5, 2001 The Common Council of the City of Jeffersonville met in regular session in the Multi-Pmpos~ Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 5th day o~ February, 2001. Clerk and Treasurer The meeting was called to order by Mayor Thomas R. Galligan, with [ r~ Peggy Wilder at the desk. Also present were Council Attorney Shon Leveritt, and Deputy C e Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those present to stand a! Councilperson Ron Ellis gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Les Merkley, Ron Ellis, DennI Frantz, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin. Absent: None. Mayor Galligan presented the minutes of the workshop of January 22, 2001 for consideratio: by the Council. Councilperson Wilson made the motion to approve the workshop minutes as ! presented, seconded by Council President Merkley and carried unanimously. Mayor Galligan presented the minutes of the meeting of January 22, 2001 for consideration by the Council. Council President Merkley asked that the minutes be corrected as he did not make the motion and second t~ pass the claims. Councilperson Waiz seconded the motion. Councilperson Ellis made the motion to add d~scuss~on regarding funding for the Spring an{ 14t~ turn signal to the agenda, seconded by Council President Merkley, passing unanimously. Councill President Merkley made the motion to add discussion of the Martin Luther King Jr./Louisville Orchestra sponsorship to the agenda, seconded by Councilperson Grooms, passing unanimous~ Council President Merkley made the motion to approve the agenda as amended, seconded Page 2 of Councilperson Ellis, passing unanimously. Clerk and Treasurer Wilder presented the claim list with one additional claim that was faxed to her today from Main Street in the mount of $20,000, for consideration by the Council. Following explanations and discussion, Councilperson Ellis made the motion to approve the claimS, as presented, omitting the claim from Main Street, seconded by Council President Merldey, passing on a vote of 6 to 1. Councilperson Grooms voted nay. PUBLIC COMMENT: There was no public comment. AGENDA ITEMS: Ordinance No. 2001-OR-4, An Ordinance Replacing Ordinance No. 2000-OR~65, Az Ordinance Establishing A Non-Reverting Fund For The Purpose Of Repair And Replacement Of Cit~ Property was presented for consideration by the Council. Council President Merkley made th~ motion to pass Ordinance No. 2001-OR-4 on the second and third readings, seconded by Councilperson Wilson, passing unanimously. Councilperson Conlin presented and read aloud Ordinance No. 2001-OR-5, An Ordinanc! Amending Ordinance No. 2000-OR-04 explaining the amendment is for future appointment~. Councilperson Conlin made the motion to pass Ordinance No. 2001-OR-5 on the first reading stating this has nothing to do with politics, seconded by Councilperson Frantz. Councilperson Wilson doe~ not understand why there should be a residency requirement if there is not one for police and fir~. Attorney Anne Marie Galligan explained residency requirements for police and fire are set by Stat~ Statute. The State Legislature has not spoken on this matter, therefore the Council may. Stating !t is an injustice to consider an amendment without have the original Ordinance available, Councilperson Ellis made the motion to amend Ordinance No. 2001-OR-5, reading several amendments he had prepared having to do with succession, the secretary, attorney, and reappointments. Attorne~ Galligan explained many of the proposed amendments were not legal. Councilperson Wilso~ seconded Councilperson Ellis' motion. Council Attorney Shon Leverett said he cannot prowde~ legal opinion as he has not received a written copy. Councilperson Conlin called for the vote on h~r motion. The motion to pass Ordinance No. 2001-OR-5 on the first reading passed on the followin~ roll call vote: Page 3 of Ayes: Councilpersons Merkley, Frantz, Waiz, and Conlin. Nays: Councilpersons Ellis, Wilson, and Grooms. Clerk Treasurer Peggy Wilder explained the line item for Human Relations was omitted from of Resolution No. 2001-R-2, A Resolution To Advertise Foi the 2001 budget. She requests passage An Additional Appropriation. The date of the next meeting was then discussed with Council President Merkley making the motion that when the regular meeting date falls on a holiday, the meeting shall be rescheduled for the following Monday, seconded by Councilperson Wilson, passin~ unanimously. Council President Merkley then made the motion to pass Resolution No. 2001-R-2~ seconded by Councilperson Waiz, passing unanimously. Ms. Lisa Thompson and Ms. Joanne Dix-Wisdom, Program Manager for Repair Affair1 appeared before the Council requesting funds for the program that will be held June 9, 2001· Printea 1 medals were distributed and statistics ofthe program were given. Following all discussion, Council President Merkley made the motion to donate $7,500 from the Council Special Programs line, seconded by Councilperson Conlin, passing unanimously. Council President Merkley reviewed the 2001 Council Committee Assignments which are Land and Traffic Committee - Barbara Wilson, Run Ellis, Ron Grooms; Budget and Financ&, Committee - Ron Grooms, Rob Waiz, Denny Frantz; Economic Development Committee - Rob Waiz, Ron Ellis, Vicki Conlin; Health and Safety Comnnttee - Barbara Wilson, V~ck~ Conlin, DeTy' Frantz. Council President Merkley made the motion to adopt the assignments as presented, seconded by Councilperson Grooms, passing unanimously. Councilperson Ellis has received requests for information on the proposed drainage fee. Hi feels the Council needs to take heed to what the public is saying and makes the motion to hold publi~ meetings for citizen input, advertised in the newspaper and on television, seconded by Councilperson Grooms. Mayor Galligan said he has had four public meetings in neighborhoods and a flier has bee~ mailed to each sewer customer. The City will not get a reprieve from the State if the City does not do this. Mayor Galligan does not want to be on the enforcement end, he wants to get this dol~ before fines come down from EPA. He does agree to do all possible to inform the citizens., Councilperson Ellis would like to have the open meetings before final passage. Mayor Galligan sai~ the fees would go into the Sewer Fund with separate accounting. The motion passed unanimously Page 4 of Councilperson Grooms feels there should be a vote on ceasing debate when a vote is called forI Attorney Galligan will look this up. Councilperson Grooms asked if there is a bill before the Stat~ ! Legislature to help with funding for the clean water act. Mayor Galligan said there is money availabl4 to borrow at a low rate. There is no "free" money he is aware of. Attorney Galligan explained th~ procedure of borrowing from SRF funds. Jeffersonville is in phase 2 of compliance which is effectiv} 2005. Requirements of the clean water act were further explained. One public meeting will be at Jeffersonville High School Auditoriun~ Mr. John Beyke and the Drainage Board will be invited to take part. Councilperson Ellis said the Council Attorney Committee will interview prospective attorney~ at 5:00 P.M. on February 14. I Councilperson Ellis reported the leR turn signal work for the traffic signal at 14t~ and Sprin~ will cost $12,784. He asks the Council to appropriate the funds. Councilperson Ellis made the motion to approve an expenditure of $12,874 fi.om the Cumulative Capital Development Fund, miscellaneous purchases, seconded by Council President Merkley. Following discussion, the motio~ passed unanimously. City Engineer Miller stated he has this price quote for several months., Following discussion of previous funding, Council President Merkley made the motion to pay one halfofthe Martin Luther King Jr./Louisville Orchestra donation from Council promotion and one half fi.om Mayor promotion, seconded by Councilperson Frantz, passing unanimously. COUNCIL COMMENTS: Councilperson Conlin reported she attended the Solid Waste Board meeting last week. Ther&. is discussion regarding doing away with the county fee. There is also discussion to charge th~ municipalities if 100% is not paid. The interlocal agreement does expire this year. Council President Merkley received a thank you fi.om Jeff-Clark Preservation for the donation the Council made. He would like to discuss Chautauqua Festival funding at the next meeting or twd. Council President Merkley inquired about the status of the "Thunder" committee. Mayor Galligah will find out. Council President Merkley said there is a person living in a truck at the comer of Maplp and Walnut. Council President Merkley said the Council is accepting applications for Councp Attorney and he encourages Shun Leverett to apply. He thanked Attorney Leverett for his time with the Council. Page 5 of Mayor Galligan said the City lost Police Officer Dickey Kratz to cancer. He asks all to g( home tonight and remember Officer Kratz in their prayers. He was a fine person. There being no further business to come before the Council, Councilperson Merkley mad~ the motion to adjourn at 8:30 P.M., seconded by JCouncilperson Grooms, passing unanimously.
