HomeMy WebLinkAbout1981-OR-27 AN ORDINANCE REGULATING PRECIOUS METAL TRANSACTIONS IN THE CITY OF JEFFERSONVILLE, INDIANA BE IT ORDAINED BY THE COMMON COUNCIL INDIANA: Section I OF THE CITY OF JEFFERSONVILLE, DEFINITIONS: A. Precious metal - When used in this Ordinance, metal shall mean any gold, silver, or platinum, in any shape, or use. B. Precious metal dealer. Any individual, firm, precious form =o7poration or partnership engaged in the business of purchasing and reselling precious metal at a permanently established place of business or in connection with a business of an intinerant nature. Section II EXCLUSIONS: The provisions of this Ordinance shall not apply to the purchase from persons, firms or corporations regularly engaged in the business of manufacturing precious metals, the business of selling precious metals at retail or wholesale, to the purchase of one dealer from another if such person, firm or corporation at the time of purchase provides each purchaser with a bill of sale or other written evidence of title to the precious metal. Section III APPROVAL No person, firm, corporation or partnership ~r association shall engage or continue to engage in the business of buying and selling precious metals except as authorized by this Ordinance without having first obtained approval from the Board of Public Works and Safety. Section IV BILL OF SALE: If the precious metal dealer, business, in the conduct of such purchases any article or articles from a seller, such purchase shall be evidenced by a bill of sale properlY signed by the seller. All such bills of sale shall be in triplicate and contain the following: 1. The date of the sale. 2. Amount of consideration. 3. Name of licensee. 4. Description of article or articles 5. Signature of the seller. 6. Address of the seller. sold. Section V REPORTS: At the close of each business day in which the licensee has purchased precious metals, the said licensee shall send a of the bills of sale to the Chief of Department. Section VI HOLDING PERIOD: Ail precious metals by said dealer for four (4) before said precious metals the dealer. Section VII SEVERABILITY: If a part of this Ordinande is the Jeffersonville Police purchased by a dealer shall be held business days after the purchase are sold or otherwise disposed of by invalid, all valid parts that are severable from the invalid parts shall remain in effect. If a part of this Ordinance is invalid in one or more of its applicationB, the part remains in effect in all valid applications that are severable from the invalid applications. Section VIII PENALTY: It shall be unlawful for any individual, firm, corporation or partnership to do any act forbidden or to fail to perform any act required by this Ordinance and on conviction of the violation of this Ordinance, said individual, firm, corporation or partnership shall be subject' to a fine of not less than $100.00 nor more than $1,000.00. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and due publication as of City 1981. required by law.
