COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
January 26, 2004
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:30 P.M. on Monday, January 26, 2004.
Mayor Rob Waiz, with Deputy Clerk Barbara Hollis at the desk, called the
meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz welcomed
all in attendance, asking all those present to stand as Monty Snelling gave the invocation.
Mayor Waiz then asked all those present to join him in the pledge of allegiance to the
flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley.
Absent: None
Councilperson Perkins asked that an ordinance amending the noise ordinance and
an ordinance regarding a Police S.W.A.T. Non Reverting Fund be added to the agenda. It
was also requested that the Council and Mayor appointments be included in the agenda.
Councilperson Grooms made the motion to approve the agenda with the additions,
second by Councilperson Sellers, passing on a vote of 7-0.
Mayor Waiz presented the minutes of the meeting of January 5, 2004 for
approval. Councilperson Perkins made the motion to approve the minutes as presented,
second by Councilperson Wilson, passing on a vote of 7-0.
Deputy Hollis presented the claim list, explaining three additional claims. Mayor
Waiz again asked that the claim for Hannum, Wagle and Cline be tabled, as he has not
been able to meet with the firm. There followed discussion of the claim to National City
on behalf of Galvpro. Following discussion, Councilperson Grooms made the motion to
approve the claims with the additions, and with the exception of the Harmum, Wagle, and
Cline Claim and the National City claim, second by Cotmcilperson Wilson, passing on a
vote of 7-0.

PUBLIC COMMENT:
There was no public comment.
DEPARTMENT HEAD REPORTS:
Mayor Waiz introduced Police Chief Rick Ashabrarmer. Chief Ashabranner is
here to answer any questions regarding the purchase of new police cars. A good rotation
of cars would be 8 new per year with the average use of 7 years per car. Follo~ving
discussion, it was the consensus of the Council to approve the order for new police cars.
Mayor Waiz then introduced Vehicle Maintenance Director Mike Drury. Director
Drury explained the 1995 and 1996 garbage trucks have over 200,000 miles. The cost for
a new unit would be between $150,000 and $200,000.
AGENDA ITEMS:
Mayor Waiz said representatives from H.J. Umbaugh would be here this week to
look over the fiscal records to give a quote. Crowe Chizek will also be submitting a
quote. Mayor Waiz hopes to have these quotes at the next meeting. Councilperson
Zastawny asked if the Council could submit questions for the fiscal review. Mayor Waiz
said they could. Councilperson Perkins would like a review of the T.I.F. District and tax
abatements. Councilperson Grooms asked that the Finance Committee be noticed about
the meeting.
City Attorney Merkley presented and explained Ordinance No. 2003-OR-42, An
Ordinance Granting Petition To Vacate A Public Way In The City of Jeffersonville. A
pubhc hearing on this matter has been held. Mayor Waiz said Jacobi, Toombs and Lanz
did not feel this was a good idea. Following discussion, Councilperson Perkins made the
motion to pass Ordinance No. 2003-OR-42, second by Councilperson Grooms, failing on
a vote of 0-7.
City Attorney Merkley presented and explained Ordinance No. 2003-OR-49, An
Ordinance Granting Petition To Vacate A Public Way In The City Of Jeffersonville. A
public hearing has also been held on this matter. Mayor Waiz said he does not see a
reason to get rid of this. Councilperson McCauley suggested this be tabled if there is no
hurry. Councilperson Sellers made the motion to table Ordinance No. 2003-OR-49,
second by Councilperson Zastawny, passing on a vote of 7-0.

Deputy Hollis explained resolution No. 2003-R-2, A Resolution Authorizing The
Investment Of Temporarily Dormant Funds. Councilperson Perkins made the motion to
pass Resolution No. 2004-R-2, second by Councilperson Fetz, passing on a vote of 7-0.
Resolution No. 2004~R-3, A Resolution Of Additional Appropriation (General
Fund - Vehicle Maintenance) was presented and explained. Council President McCauley
asked if the State would approve any additional appropriations. Deputy Hollis explained
no approvals would be given until the 2003 and 2004 budgets have been approved.
Councilperson Perkins made the motion to pass Resolution No. 2003-R-3, second by
Councilperson Fetz, passing on a vote of 7-0.
Resolution No. 2004-R-4, A Resolution Of Additional Appropriation (General
Fund - City Court) was presented and explained. Councilperson Perkins feels this
funding should be from the Probation User Fund. Following discussion, Councilperson
Perkins made the motion to pass Resolution No. 2004-R-4, second by Councilperson
Wilson, passing on a vote of 7-0.
Councilperson Perkins mad aloud and explained the need for passage of
Ordinance No. 2004-OR-1, An Ordinance Amending Jeffersonville Noise Ordinance.
Following discussion, Councilperson Perkins made the motion to suspend the roles for
Ordinance No. 2004-OR-1, second by Council President McCauley, passing on a vote of
7-0. Councilperson Perkins then made the motion to pass Ordinance No. 2004-OR-1 on
all three readings, second by Councilperson Wilson, passing on a vote of 7-0.
Councilperson Perkins then presented and explained the need for Ordinance No.
2004-OR-2, An Ordinance Establishing The Police S.W.A.T. Non-Reverting Fund.
Chief Ashabrauner explained the City has a 10-member S.W.A.T. Team he would put up
against any in the state. There is no line item in the budget for the high dollar S.W.A.T.
equipment that is necessary. Councilperson Perkins noted there are weapons on the street
that can penetrate the vests. Council President McCauley questioned the non-reverting
fund established in 1997. Following discussion, Councilperson Fetz made the motion to
pass Ordinance No. 2004-OR-2 on the first reading, second by Councilperson Sellers.
Council President McCauley said the police may be shy to ask for money in the budget
and he feels they may be short-changed by this fund. The motion to pass Ordinance No.
2004-OR-2 on the first reading passed on a vote of 7-0.

Council President McCauley reviewed the list of appointments and committees.
Cmmcil President McCauley then read aloud a draft letter to Department Heads regarding
the liaisons. Councilperson Perkins made the motion to accept the Council Appointments
as presented, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson
Perkins then made the motion to accept the Council Committees and Council Liaisons as
presented, second by Councilperson Zastawny, passing on a vote of 7-0.
Following discussion and introductions, Councilperson Grooms made the motion
to appoint Ms. Jan Paddocks, Ms. Melanie Yates, Mr. Troy McCormick, and Ms. Laura
Renwick to the Historic Board, second by Councilperson Wilson, passing on a vote of 7-
COUNCIL AND MAYOR COMMENTS:
Councilperson Perkins expressed his appreciation for the Council's indulgence
with regard to the noise and S.W.A.T. ordinances.
Councilperson Zastawny requests a meeting of the health insurance committee.
Mayor Waiz will call and set up a meeting. Councilperson Zastawny questions
development of Woehrle Road and suggests revising the master plan. Councilperson Wilson feels the Council is off to a good start.
Councilperson Grooms said he is working with Councilperson Fetz on a vision or
mission statement. He feels this would be a good gesture and asks for suggestions.
Councilperson Grooms referred to a letter from Clark Memorial Hospital regarding the
proposal for a specialty hospital in New Albany. He has concern for the burden of unfair
competition and asks the Council to think about taking a position. Councilperson Grooms
referred to a letter from Ms. Mary Gowens regarding lighting on the Second Street
Bridge. Councilperson Seller said Engineer Miller is checking on this. Mayor Waiz will
talk to Mr. Jim Keith about helping with funding. Councilperson Grooms says thank you
to Council President McCauley, noting this should be an awesome year. Cooperation
from Mayor Waiz is appreciated.
Council President McCauley thanked the Council for their attendance at the
workshop and for their cooperation. He will ask for a liaison report at the next meeting.
He also appreciates the cooperation of Mayor Waiz. Council President McCauley next
referred to the recent disaster in the City of a horrible fire. The Council is ready to help

Mayor Waiz. He is looking for~vard to ne;v life downtown. A decision needs to be made
so that things can move on.
Mayor Waiz appreciates the Council's approval to order the police cars. He is
going to Indianapolis tonight to meet with the Governor with his "tin can". He wants to
get Spring Street open as soon as possible. He will meet with business owners when he
gets back.
City Attorney Merkley would like to meet with the Council in executive session
at 6:30 P.M. on February 23, 2004 to discuss pending litigation. City Attorney Merkley
will prepare the oath papers. He reminded all that the ethics disclosure forms are due by
February 1, 2004.
As there was no further business to come before the Council, Councilperson
Perkins made the motion to adjourn at 9:00 P.M., second by Councilperson Wilson,
passing unanimously.
