HomeMy WebLinkAbout1981-OR-22 ORDINANCE NO. 81-OR-~. An Ordinance Declaring Masking in Public Disorderly Conduct. BE IT ORDAINED BY THE coMMoN coUNCIL OF THE CITY OF JEFFERSONVILLE IN THE STATE OF INDIANA: Section One It shall be unlawful for any person within the corporate limits of the City of Jeffersonville to violate the following section of this ordinance. Any person over Section Two fourteen years of age who shall assume a mask, false face, oover or partial cover, or other apparel with intent to conceal his identity or counterfeit another, or with the intent to prevent disclosure or recognition, in any public street or other public place; Section Two-A The following are exempted from the provisions of Section Two of this Ordinance. (1) Any person (2) (3) (4) (5) under fourteen years of age; Any person wearing traditional holiday costumes in season; Any person using masks in theatrical productions including use in mardi gras celebrations and masquerade balls; Any person lawfully engaged in trades or employment or in a sporting activity where a mask or facial covering is worn for the purpose of ensuring the physical safety of the wearer, or because of the nature of the occupation, trade or professional or sporting activity; Any person wearing a gas mask in drills, exercises or emergencies; Section Three Any person violating section two hereof may be charged with the offense of Disorderly Conduct and upon conviction thereof may be found guilty of disorderly conduct and shall be fined not less than $35.00 nor more than $!00.00 or imprisoned not exceeding 50 days or both. Section Four This ordinance shall become effective upon its passage and approval and publication as required by Statute.
