HomeMy WebLinkAbout2000-R-28RESOLUTION NO. 2000 R- ~-8 A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA (Armstrong Farms Annexation Area) WHEREAS, the City of Jeffersonville desires to annex an area contiguous and adjacent to the corporate limits of the City of Jeffersonville, more particularly described in Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, state law requires adoption of a fiscal plan and a definite policy for the provision of services to annexed areas; and WHEREAS, such plan entitled 'Fiscal Plan for Armstrong Farm Annexation Area" is attached as Exhibit "B" and incorporated herein by reference; and; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVlLLE, CLARK COUNTY, INDIANA, THAT: The Common Council of the City of Jeffersonville, Clark County, Indiana, hereby approves and adopts the "Fiscal Plan for Armstrong Farm Annexation Area ", which Plan is attached hereto and made a part hereof as Exhibit "B", and hereby approves and adopts the specific policies for implementation of the Plan as set out therein; Any monies necessary for the Provision of services as described and itemized in the attached Plan shall be budgeted and appropriated from the applicable fund, pursuant to state law and the City's budget procedure; Passed and adopted by the Common Council of the City of Jeffersonville, Clark County, State of Indiana, on this day of ,2000. ~s~R~Galliga n.~ Presiding Officer ATTEST: Peggy ~!.~r, Clerk-Treasurer day of Presented by me as Clerk and Treasurer to the Mayor of said City of Jeffersonville this ,2000. p'~'ggy~ Clerk and Treasurer Approved and signed by me this __ day of ,2000. Jun-22-00 09:17A Jacobi Toombs Lanz 812 288 6656 P.02 June 15, 2000 EXHIBIT 'A' DESCR/PTION OF ANNEXATION THE ARMSTRONG FAMILY TRUST TRACT A part of Survey No. 34 of the Illinois Grant of Clark County, Indiana being a part of the same tract conveyed to the Armstrong Family Trust at Deed Drawer 29, Instrument No. 16968 and bounded as follows: 'Beginning at a point in the southeasterly line of Survey No. 34 and also being the boundary line of the City of Ieffersonville which marks the northerly corner of Survey No. 21, the True Place of Beginning. Thence southwestwardly 502 feet, more or less, along said City's boundary and the dividing line of Surveys No. 21 and 34 to the south comer of said Armstrong tract; Thence northwardly 1,372 feet, more or less, continuing along said City's boundary, which is also Armstrong's southwesterly line to the northwesterly right-of-way line of the CSX Railroad, which is also southeasterly line of the Meadows Subdivision, and the boundary of the City of Jeffersonville. Thence northeastwardly 1,207 feet, more or less, continuing along said City's boundary and the Railroad right-of-way to the dividing line of Surveys No. 34 and No. 35; Thence southeasterly 1,653 feet, more or less, leaving said City's boundary along the line dividing Surveys No. 34 and 35 to the northwesterly line of Survey No. 22 and said City's boundary; Thence southwestwardly 660 feet, more or less, along the boundary of the City of Jeffersonville, which is the line dividing Surveys No. 22 and 34 to the north corner of Survey No. 21 and said City's boundary to the True Place of Beginning and containing 40 acres, more or less, of land. The intent of this description is to describe all of said Armstrong tract which lies in Survey No. 34. Sanitation Services - The City w/ll not incur any additional cost to provide sanitation services to the Armstrong Farm Property. Street and Road Maintenance Services - The City will incur only a minimal marginal increase in cost to provide street and road maintenance services. Any additional cost will be recovered from the increase in funds the City will receive from the State of Indiana Local Roads and Streets funds attributable to the additional road mileage represented by any streets developed on the Armstrong Farm Property. Within three years of the effective date of the proposed annexation of the property described in Exhibit A, attached hereto and incorporated herein (the "Armstrong Farm Property"), the City of Jeffersonville (the "City") will provide the following capital services to the Armstrong Farm Property in a manner equivalent in standard and scope to the same services the City currently provides to other areas within its corporate boundaries: Sewer Facilities - The City will not incur any additional cost to provide sewer service to the Armstrong Farm Property, as the owner/developer of the Armstrong Farm Property will construct the necessary connecting sewer lines to an existing interceptor. o Water Facilities - The City will not incur any additional cost to provide water service to the Armstrong Farm Property, as the owner/developer will construct the necessary connecting water lines to existing Indiana-American water line. o Street Construction - The City will incur an estimated $200,000.00 in additional cost to construct a street through the Armstrong Farm Property. The funding for construction of the proposed street will be provided from the State of Indiana Local Roads and Streets funds the City receives in both the 2000 and 2001 budget years. Street Lighting - The City will not incur any additional cost to provide street lighting for the Armstrong Farm Property, as the owner/developer will install the necessary street lighting.
