'81 R 51 AN ORDINANCE MAKING MINOR TRAFFIC VIOLATIONS ORDINANCE VIOLATIONS, AND PROVIDING FOR THE DEPOSIT OF FINES INTO THE CITY GENERAL FUND the City of Jeffersonville, Indiana, pursuant to to regulate the use WHEREAS, the provisions of I. C. 36-9-2-7, is authorized of public ways within the city; and WHEREAS, the City is aunhorized, pursuant to the provisions of I. C. 9-4-1-27 to adopt an ordinance regulating automobile traffic and to deposit fines assessed for violations into the City's general fund~ BE IT THEREFORE ORDAINED BY THE C6~MON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA. that: Section t. Traffic Offenses. Hereafter, any person who commits one of the following traffic offenses and is fined therefor, will be in violation of this Ordinance: (A) Speeding Violation: 1. A speeding violation shall be construed by the Court as that which is in excess of the posted speed limit and/or that which is in excess of what is reasonable and prudent under the conditions and having regard to the actual and potential hazards there existing at the time of the alleged violation. 2. (E) Disobeying a Yield Sign: 1~ The driver of a vehicle shall come to a full and complete stop at any yield sign if other traffic is present and otherwise shall reduce speed yielding the right-of-way to through traffic and otherwise observe all directions of traffic except when directed to oroceed by a police officer or traffic control device. Improper Passing Violation: 1. The City of jeffersonville is hereby authorized to designate those parts of the streets where overtaking and passing would be hazardous and may, by appropriate signs or marks on the street, designate no passing zones which driver of a vehicle. (G) Failure to Yield Right-of-Way: 1. The driver of a vehicle shall shall be obeyed by the stop or yield in obediance to a stop or yield sign or automatic signal as required by this ordinance. Where such sign or signal is erected at one or more entrances or intersections, although not part of a through street, the driver shall proceed cautiously, yielding at the entrance of a through street to vehicles not so obliged to stop, and may then proceed if safety permits. 2. The driver of a vehicle shall not pull from a private drive onto a through street unless he can do so safely and without violating the right-of-way of those vehicles and drivers already upon said through street. (B) Parking Violation: 1. No person shall stop, park, or leave standing any vehicle upon the paved or main traveled parn of the street when it is practical to park or stop such vehicle off such part of said street. 2. No person shall stop, stand, or park a vehicle, except to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device in any place which is prohibited by the City of jeffersonville. (C) Disobeying a Stop Sign: 1. The driver of a vehicle shall come to a full and complete stop at any stop sign regardless of the presence or absence of other vehicles except when directed to proceed by a police officer or traffic control device. (D) Improper Turn Violation~ 1. The driver of any vehicle intending to turn at an intersection or private drive shall ~o so only as follows: a. When making a right turn a driver shall make said turn approach only from the safest right-hand portion of the road staying close to the right-hand curb or berm of the road. b. When making a left turn a driver shall make said turn approach from nhe section of the right half of the roadway nearest to the center line and upon entering the road upon completion of the left-hand turn the driver shall make certain that said vehicle remains to the right of the center line. c. The driver of a vehicle shall obey markers or signs placed within or adjacent to intersections, and no driver shall make a turn other than is directed by said markers or signs. 2. No driver of a vehicle shall turn the vehicle so as to make a U-turn near the crest Of a grade where such vehicle cannot be seen by the driver of any other vehicle approaching from (H) Wrong-Way on a One-Way Street: 1. The driver of a vehicle shall not disobey a sign designating one-way traffic. (I) Other Non-Moving Violations: 1. No person shall disobey the requirements of the Indiana Motor Vehicle Law as to proper safety equipment on a vehicle, nor shall any person drive a vehicle without being duly licensed to drive such vehicle. The driver of a vehicle shall at all times be able to display proper registration of said vehicle. (J) Disregarding AutomaTic Traffic Signal: 1. No driver of a vehicle shall disobey the instructions of any traffic control device on or upon the streets of the City of Jeffersonville. Section 2. Payment of Penalties. Whenever this Ordinance is violated, the person so charged for such violation, shall be cited to come before the Judge of the Jeffersonville City Court, at the City-County Building, 501 East Court Avenue, Jeffersonville, Indiana. The Judge of the jeffersonville City Court shall be authorized to establish a Traffic Violations Bureau to receive payment of penalties. Payment of penalties shall be made to the Clerk of the Jeffersonville City Court at the City Court Clerk's Office. Section 3. Penalty Schedule. Penalties assessed for violations shall be based (A) (C) (F) upon the following schedule: Speeding viclation ....... S25.00 up to $500.00 Parking violation ........ 15.00 up to 100.00 25.00 up to 500.00 Disobeying stop sign ....... Improper turn violation ..... 25.00 up to 500.00 Improper passing violation 25.00 up to 500.00 Yield sign viclation ....... 25.00 up to 500.00 (G) Failure to yield right-of-way .... (H) Wrong-way on one-way street (I) Other moving violation .... (j) Disregarding automatic traffic signal 25.00 up to 500.00 25.00 up to 500.00 25.00 up to 500.00 25.00 up to 500.00 Section 4. Fines. Those persons who admit the allegation or have a judgment entered against them under Section 2, subsection (A), (C), (D), (E), (F), (G), (H), (I), or (J) of this Ordinance shall be fined a minimum of $25.00 up to a maximum of $500.00. Those persons who admit the allegation or have a judgment entered against them under Section 2, subsection (B) of this Ordinance shall be fined a minimum of $25.00 up to a maximum of $t00.00. ~ Section 5. Certification. Ail violations of this Ordinance relating to moving vehicles shall be certified to the Bureau of Motor Vehicles in Indianapolis within ten (10) days after the conviction pursuant to I. C. 9-4-1-135. ~ection 6. Authorization. The City Court is authorized to take the steps necessary to set up certification and payment procedures. Section 7. Effec%ive Date. This Ordinance shall be in full force and effect after its adoption and publication as required by statute. Section 8. If any part of this Ordinance is found to be unconstitutional, then in that event the remainder of this Ordinance shall remain in full force and effect.
