HomeMy WebLinkAbout02-24-2003COUNCiL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA FEBRUARY 24, 2003 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:30 P.M. on February 24, 2003. Council President Rob Waiz, with Deputy Clerk Barbara Hollis at the desk, called the meeting to order. Council President Waiz welcomed all in attendance, asking all those present to stand as Councilperson Ron Ellis gave the invocation. Council President Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Ron Ellis, Les Merkley, Denny Frantz, Rob Waiz, Barbara Wilson, and Vicki Conlin. Absent: Councilperson Ron Grooms. Following discussion, Councilperson Merkley made the motion to amend the agenda to present Item #22 as #13A, second by Councilperson Wilson,,passing on a vote of 5-0. Council President Waiz did not vote. Councilperson Merkley then made the motion to approve the agenda as amended, seconded by Councilperson Wilson, passing on a vote of 5-0. Council President Waiz did not vote. Council President Waiz presented the minutes of the workshop of February 3, 2003, and the minutes of the meeting of February 10, 2003 for consideration by the Council. Councilperson Wilson made the motion to approve the February 10, 2003 minutes as presented, seconded by Councilperson Conlin, passing on a vote of 5-0. Council President Waiz did not vote. Deputy Clerk Hollis presented the claim list for consideration by the Council. Deputy Hollis noted one vendor name correction and explained one additional claim for a salt track. The Council discussed payment of the salt truck asking that the $26,500.00 be taken from the Cumulative Capital Development Fund (Miscellaneous $4,185; Sanitation $15,000; Law Department $2,000; and Information Technology $5,315). Following discussion, Councilperson Conlin made the motion to remove the portion of the claim for payment to Indiana Department of Transportation for the Court Avenue Project from the February 24, 2003 2 Cumulative Capital Improvement Fund, second by Councilperson Frantz, passing on a vote of 4-1. Councilperson Merkley voted against and Council President Waiz did not vote. Following discussion of the request for payment of parking tickets in the Department of Law, Councilperson Ellis made the motion to delete the claim to the New Albany Police Department, second by Councilperson Merkley, passing on a vote of 5-0. Council President Waiz did not vote. Councilperson Frantz then made the motion to approve the claims as amended, second by Councilperson Wilson, passing on a vote of 5- 0. Council President Waiz did not vote. PUBLIC COMMENT: There was no public comment. DEPARTMENT HEAD REPORTS: Councilperson Ellis introduced Mr. Gayle Robinson, Director of the Department of Redevelopment. Councilperson Ellis said he hopes to develop a good relationship. Director Robinson said he looks forward to working with the Council. Councilperson Conlin requests Director Robinson keep the Council infom~ed on the progress of the Quadrangle. AGENDA ITEMS: Ms. Rachele Cummins, Attorney representing Geo E. Pfau's Sons Co., Inc., appeared before the Council requesting passage of Ordinance No. 2003-OR-2, .An Ordinance Granting Petition To Vacate A Public Way In The City Of Jeffersonville ("Alleys"), and Ordinance No. 03-OR~3, Ordinance Granting Petition To Vacate A Public Way In The City Of The City Of Jeffersonville ("Locust Street"). Ms Cummins explained the area and the need for passage. Ms. Ann Pfau answered questions. Councilperson Conlin made the motion to suspend the rules for Ordinance No. 2003-OR- 2, second by Councilperson Wilson, passing on a vote of 5-0. Council President Waiz did not vote. Councilperson Conlin then made the motion to pass Ordinance No. 2003- OR-2 on all three readings, second by Councilperson Wilson. As this is a public heating regarding this issue, public comment was requested. There being no public comment, Ordinance No. 2003-OR-2 passed on a vote of 5-0. Council President Waiz did not vote. Councilperson Conlin then made the motion to suspend the rules for Ordinance No. 2003-OR-3, second by Councilperson Wilson, passing on a vote of 5-0. Council February 24, 2003 3 President Waiz did not vote. Councilperson Conlin then made the motion to pass Ordinance No. 2003-OR-3 on all three readings, second by Councilperson Wilson. Again public comment was requested. There being no pubic comment, Ordinance No. 2003-OR-3 passed on a vote of 5-0. Council President Waiz did not vote. City Court Judge Vicki Carmichael appeared before the Council requesting passage of Ordinance No. 2003-OR-4, An Ordinance Amending Ordinance No. 2002- OR-51, Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2003 (City Court Non-Reverting). Judge Carmichael introduced Ms. Autumn DuPre and explained she will be working part-time and will not be eligible for benefits. All expenses will come from the Non-Reverting Fund and if Ms. DuPre does become eligible for benefits the benefits costs will also be paid by the Non-Reverting Fund. Councilperson Conlin made the motion to pass Ordinance No. 2003-OR-4 on the first and second readings, second by Councilperson Wilson, passing on a reading of 4-0-1. Councilperson Merkley abstained and Council President Waiz did not vote. Ordinance No. 2003-OR-5, An Ordinance Transfening Certain Funds Within Same Department (Motor Vehicle) was introduced for consideration. Deputy Clerk Hollis explained this is a result of the State ordered budget cuts and the Council workshop. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-5 on the first reading, second by Councilperson Ellis, passing on a vote of 5-0. Council President Waiz did not vote. A series of Tax Anticipation Warrant Ordinances were presented and explained. A workshop will be scheduled for discussion prior to final passage. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-6, An Ordinance Authorizing A Tax Anticipation Warrant For The Tax Increment Financing Fund Of The City Of Jeffersonville, (TIF - $878,000) on the first reading, second by Councilperson Conlin, passing on a vote of 4-0-1. Councilperson Ellis abstained, Council President Waiz did not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-7, An Ordinance Authorizing A Tax Anticipation Warrant For The Sanitation Fund Of The City Of Jeffersonville ($663,000) on the first reading, second by Councilperson Conlin, passing on a vote of 4-0-1. Councilperson Ellis abstained, Council President Waiz did February 24, 2003 4 not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-8, An Ordinance Authorizing A Tax Anticipation Warrant For The Cumulative Capital Development Fund Of The City Of Jeffersonville ($125,000), second by Councilperson Wilson, passing on a vote of 4-0-1. Councilperson Ellis abstained, Council President Waiz did not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-9, An Ordinance Authorizing Tax Anticipation Warrant For The Building Rental Fund Of The City Of Jeffersonville, ($221,000) on the first reading, second by Councilperson Wilson, passing on a vote of 4-0-1. Councilperson Ellis abstained, Council President Waiz did not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-10, An Ordinance Authorizing A Tax Anticipation Warrant For The Fire Pension Fund Of The City Of Jeffersonville ($63,000) on the first reading, second by Councilperson Wilson, passing on a vote of 4-0-1. Councilperson Ellis abstained and Council President Waiz did not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-11, An Ordinance Authorizing A Tax Anticipation Warrant For The General Fund Of The City Of Jeffersonville ($7,600,000) on the first reading, second by Councilperson Wilson, passing on a vote of 4-0-1. Councilperson Ellis abstained and Council President Waiz did not vote. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-12, An Ordinance Authorizing A Tax Anticipation Warrant For The Park Fund Of The City Of Jeffersonville ($720,000) on the first reading, second by Councilperson Conlin, passing on a vote of 4-0-1. Councilperson Ellis abstained and Council President Waiz did not vote. Councilperson Conlin suggested the Council ask their attorney to review the papers. Council President Waiz will have the attorney look at them. COUNCIL AND MAYOR COMMENTS: Councilperson Ellis explained he abstained from the votes on the tax anticipation warrant ordinance because he does not feel it is in the best interest to the taxpayer. Councilperson Conlin noted the Jeff High Lady Red Devils basketball team has won Sectionals and will play again Tuesday night. She asks all to remember and root for the girls. She suggests they be recognized. Council President Waiz said plans have been finalized to hold a Council meeting on March 29, 2003 at 9:00 A.M. at the Parks Department Office and on April 26, 2003 at 5 February24,2003 9:00 A.M. at the Ken Ellis Center. Council President Waiz next congratulated Councilperson Conlin for receiving the Outstanding Leader Award. The Council will meet for a workshop on Monday, March 3, 2003 at 6:00 P.M. in the Mayor's Conference There being no further business to come before the Council, the meeting was adjourned at 8:30 P.M.
