COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE- INDIANA
January 5. 2004
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville- Indiana,
at 7:30 P .M. on Monday, January 5. 2004.
Mayor Rob Waiz. with Clerk Treasurer Peggy Wilder m the desk, called the
meeting to order. Also presem were City Attorney Les Merkley and Deputy Clerk
Barbara I-Iollis. Mayor Waiz welcomed all in attendance, asking all those present to
stand as Councilperson Ron Grooms gave the invocation. Mayor Waiz then asked all
those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were: Councilpersons John Perkins. Ed
Zastawny, Keith Fetz. Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley.
Absent: None
Councilperson Perkins made the motion to approve the agenda as presented,
' second by Councilperson Grooms, passing on a vote of 7-0.
Mayor Waiz presented the minutes of the meeting of December 30, 2003 for
approval. Councilperson Wilson made the motion to approve the minutes, second by
Councilperson Grooms, passing on a vote of 7-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council.
Mayor Waiz said he has a meeting with Hannum, Wagle, and Cline scheduled regarding
their claim. Following discussion. Councilperson Grooms made the motion to approve
the claims with the exception of the Hannum. Wagle, and Cline claim, second by
Councilperson Wilson, passing on a vote of 7-0.
PUBLIC COMMENT:
There was no public comment.
AGENDA ITEMS:
Mr. Phil Bates. representing the Housing Authority, appeared before the Council
to request passage of Resolution No. 2004-R-1, A Resolution Of The City Council Of
The City Of Jeffersonville Indiana, Authorizing The Submittal Of A Community Focus

Fund Proposal To The Indiana Department Of Commerce. Mr. Bates explained this was
approved previously, however the grant application was rejected due to the failure of the
City to provide an adequate fixed asset list. Mr. Bates explained the project, the
matching funds, and the time line. Councilperson Perkins made the motion to pass
Resolution No. 2004-R-1, second by Councilperson Zastawny. Councilperson Grooms
asked if the City would be asked for financial help. Mr. Bates said no financial help will
be needed in phase one, but there may be need in the future. Councilperson McCauley
stated he can't think of a better project and asked ifUEZ will be contributing. Mr. Bates
replied they would. Mayor Waiz said this is an excellent project that had been approved
previously and it is a shame it had to come back. Mayor Waiz has a letter from Mr.
Lincoln Cram indicating the fixed assets list should be completed in the next couple of
weeks. At the conclusion of all discussion, the motion to approve Resolution No. 2004-
R-1 passed on a vote ofT-0
City Attorney Les Merkley presented Ordinance No. 2003-OR-42, An Ordinance
Granting Petition To Vacate A Public Way In The City of Jeffersonville, explaining the
area. Mayor Waiz said he would like to talk with Engineers Jacobi, Toombs, and Lanz
regarding the drainage in this area. Councilperson Grooms the made the motion to table
Ordinance No. 2003-OR-42, second by Councilperson Wilson, passing on a vote of 7-0.
City Attorney Les Merkley next presented Ordinance No. 2003-OR-46, An
Ordinance Annexing Contiguous Territory By 100% VOluntary Petition explaining a
public hearing was held on December 19, 2003 with the ordinance passing on the first
reading. Councilperson Perkins made the motion to pass Ordinance No. 2003-OR-46 on
the second and third readings, second by Councilperson Zastawny, passing on a vote of
7-0.
City Attorney Les Merkley then presented Ordinance No. 2003~OR-49, An
Ordinance Granting Petition To Vacate A Public Way In The City of Jeffersonville,
explained a public hearing was held December 19 with no action taken. Mayor Waiz said
he would like to review this with Jacobi, Toombs, and Lanz also. Councilperson Fetz
made the motion to table Ordinance No. 2003-OR-49, second by Councilperson Wilson,
passing on a vote of 7-0.

City Attorney Les Merkley presented a list of City Council appointments for the
Council to review and consider before the end of the month. Mayor Waiz announced the
Board Of Public Works and Safety wili be meeting every Wednesday at 9:30 A.M.
Councilperson Grooms Nominated Councilperson Sellers as the Council appointment to
the Board of Public Works. Councilperson Perkins nominates Councilperson Wilson as
the Council appointment to the Board of Public Works. Councilperson Sellers was
appointed to the Board of Public Works on the following roll call vote: votes for
Councilperson Sellers - Councilpersons Zastawny, Sellers, McCauley, and Grooms;
votes for Councilperson Wilson - Councilpersons Perkins, Fetz, and Wilson.
Councilperson Grooms made the motion to table all other appointments until the next
meeting, second by Councilperson Wilson, passing on a vote of 7-0.
City Attorney Merkley distributed forms to each Councilperson that need to be
filed by February 11 '2004, along with a copy of the ethics ordinance.
The meeting schedule was discussed. Councilperson Grooms made the motion to
schedule City Council meetings for the 1s~ and 3rd Monday of each month, unless the 1~
or 3rd Monday is a holiday the meeting will be the following Monday, second by
Councilperson McCauley, passing on a vote of 7-0.
Nominations for Council President and Vice President were requested.
Councilperson Perkins made the motion to nominate Councilperson Wilson for Council
President. second by Councilperson Fetz. Councilperson Sellers made the motion to
nominate Councilperson McCauley for Council President, second by Councilperson
Grooms. Councilperson McCauley was elected Council President on the following roll
call vote: votes for Councilperson McCauley - Councilpersons Grooms, McCauley,
Sellers. and Zastawny; votes for Councilperson Wilson - Councilpersons Wilson. Fetz.
and Perkins. Councilperson Zastawny made the motion to nominate Councilperson
Grooms for Vice President. second by Councilperson Sellers. Councilperson Wilson
made the motion to nominate Councilperson Fetz for Vice President, second by
Councilperson Perkins. Councilperson Grooms was elected Vice President on the
following roll call vote: votes for Councilperson Grooms - Councilpersons Zastawny,
Sellers. McCauley, and Grooms; votes for Councilperson Fetz - Councilpersons Perkins.
Fetz. and Wilson. Councilperson McCauley said he is honored, and he hopes to make

changes in the way the Council functions and operates, He is looking forward to working
with the Council.
COUNCIL AND MAYOR COMMENTS:
Councilperson Perkins said it is nice to be back and he pledges to work with all.
He is looking forward to working with the Council and Council President McCauley.
Councilperson Zastawny said it is an honor and privilege to be here and he is
looking forward to working with the Council and Council President McCanley. This is a
challenge and be appreciates it.
Councilperson Fetz gives thanks for the opportunity he has been given.
Councilperson Sellers said she is excited to be here.
Councilperson Wilson said she is pleased to be back and welcomes all.
Councilperson Grooms welcomes all new members wishing all a Happy New
Year. He sees tremendous opportunities for the City. He has never been more enthused
about what the Council can do. He firmly supports Council President McCanley
and Mayor Waiz. He thanks all for the opportunity to be here. Councilperson Grooms
said he is the same distance from Councilperson Perkins as he was 12 years ago.
Council President McCauley said he is extremely excited about being on the
Council. He never enjoyed anything like his four years with the City. The amount of
support and expertise in the City is remarkable. He looks for~vard to working with Mayor
Waiz to maintain and accelerate progress in the City. He is looking forward to leading
this Council. He hopes to organize talent to make Jeffersonville a model City. He thanks
all that participated in the process of election.
Clerk Treasurer Wilder said laptop computers have been purchased for the
Council and it is her hope for this to be a "paperless Council". They should be ready by
the end of the week. She requests biographies and photos of each Councilperson for the
internet site.
Mayor Waiz said this is a new beginning and he is looking forward to working
with all. There is a great potential when all work together. His door will always be open.
Mayor Waiz congratulates Council President McCauley and Vice President Grooms and
Councilperson Sellers for her appointment to the Board Of Works. He appreciates all
who came tonight.

There will be a Council workshop on January 20, 2004 at 5:00 P.M. There will
be a visit to the sites of the areas tabled this evening prior to the workshop at 4:00 P.M.
There being no further business to come before the Council, Councilperson
Perkins made the motion to adjourn at 8:25 P.M., second by Councilperson Fetz, passing
