COMMON coUNCIL OF THE CITY OF JEFFERSONVILLE
WHEREAS, the Common Council of the City of Jeffersonville
adopted a resolution on June 6, 1983, inducing Popped-Right,
Inc. to construct and equip an economic development facility,
said facility consisting of the expansion of an existing plant
and the aoquisition of machinery and equipment to be used in
the manufacturing and processing of corn-based snack foods; and
WHEREAS, this Common Council has been advised that D. Warren
Brown, as the principal stockholder of Popped-Right, Inc., is
to be included as an applicant for the financing of the $400,000
real estate portion of the above described economic development
facilities;
NOW, THEREFORE, BE IT RESOLVED by the Common Council as
follows:
1. The Common Council now finds that the applicant for
the $400,000 real estate portion of said economic development
facilities is to be D. Warren Brown for lease of the same to
Popped-Right, Inc. and that wherever the term "Applicant"
appears in the resolution adopted on June 6, 1983, such term
shall include both parties, collectively.
2. Such clarification of the designation of the term
Applicant is hereby approved and all prior action by the common
Council with respect to the proposed economic development
facilities is hereby ratified and confirmed.
3. Separate series of economic development revenue bonds
may be issued for D. Warren Brown for the $400,000 real estate
portion of said economic development facilities and for
Popped-Right, Inc. for the $1,400,000 machinery and equipment
portion of said economic development facilities, subject to the
terms and conditions set forth in the June 6, 1983 resolutions
of this Common Council, and D. Warren BroWn shall lease the
real estate portion of said economic development facilities to
Popped-Right, Inc.
