HomeMy WebLinkAbout1984-OR-69AN ORDINANCE ORDINANCE NO. 84-0R-__ AMENDING ORDINANCE NO. 1555 AS AMENDED AND APPROVED Section I Licensing and Registration Section A Structural Licenses and Registration A.1 commercial General Contractor License. Any person, firm, or corporation who engages in the erection of all new structures or all new additions to existing structures and all remodeling, repair, and demolition of existing structures shall be required to obtain a license from the Department in order to engage in such activities. (This license permits all construc- tion activities permitted by A. 3, A. 5, and A. 6 below) A.2 A.3 A.4 A. 5 A.6 Contractors Insurance Any person, firm, or corporation who engages in the erection of all new strUctures, or all new additions to existing structures, and all remodeling, repair, and demolition of existing structures, shall be required to submit to the City Building Commissioner a copy showing proof of insurance with a minimum amount of $300,0Q0 single limit for each occurance of liability for bodily injury and property damage. To obtain registration with the City Building Commissioners office and to conduct business in the City of jeffersonville. A copy of this insurance certificate will be filed with registration certificate in Building Commis- sioner's office. Failure to produce such insurance certificate will result in non issuance of license. The contractor shall be responsible for keeping this certificate current; failure to keep the certificate current will result in revocation of license. Commercial Construction Superintendent License Contractors will, at the time application is made for a building permit, file with the Building Department the name of the indi- vidual who will be the responsible person for supervision of the project, for which the permit is being applied. Any individual who engages in or who supervises the work of commercial construc- tion shall be required to be licensed with the Department in order to engage in such activities. Residential Contractor License (up to and including three (3) stories) Any person, firm, or corporation who engages in the erection of new residential structures or new additions to existing structures and remodeling, repair, and demolition of residential structures, shall be required to obtain a license from the Department in order to engage in such activities. (This license permits all construction activities permitted by A.6 and A.7 below, as to residential structures only). Residential Construction Superintendent License Any individual who engages in or supervises the work of residentia construction (up to and including three (3) stories) shall be required to licensed with the Building Department. Home Improvement Contractor License Any person, firm, or corporation who engages in the improving, re- modeling, and repair of existing one and two-family structures shall be required to obtain a license from the Department in order to engage in such activities. This license permits all activities pertaining only to the improving, remodeling, and repair on one and two-family structures, additions not included. Remodeling jobs are jobs which do not add square footage in floor area to a building. This license will permit the construction of unattached garages and accessory buildings. (1) Section I Section A Licensing and Registration Structural Licenses and Reqistration A.7 Contractor Registration Any person, firm, or corporation who is acting as a sub-contractor shall be registrated under the general contractor and they shall be responsible for their sub-contractors work. H0wever, any sub-contractor who gainfully solicites work on their own shall be registered in the Building Commissioners office as a mis- cellaneous contractor. However, registration under this category is in no way to be interpreted as to include any person, firm, or corporation who contracts and engages in any activity which is not directly related to the building, remodeling, or repairing of a structure. Registration categories are as follows: A.7 (a) Concrete A.7 (b) Masonry A.7 (c) Carpentry or frame A.7 (d) Steel Erecting A.7 (e) Roofing A.7 (f) Drywalling, Plastering, and Acoustical Tile Installation A.7 (g) Siding A.7 (h) Demolition A.7 (i) Architectural Sheet Metal, Gutters, Flashings A.7 (j) Miscellaneous work--Tower Buildings, Swimming Pool, Lawn Sprinkler System, etc. Ail contractors who are not currently licensed and who are required to obtain licenses pursuant to Section IA (above) must secure required licensee within sixty (60) days of effective date of this ordiance. the Section B Mechanical Licenses B.1 Electrical Contractor's License (a) Any person, firm, or corporation who engages in electrical con- tracting, including the securing of permits for installation, alterations, and repair of any electrical wiring devices, appliances or equipment shall be required to obtain a license from the Department in order to engage in such activities, except as pro- vided in B.2 (a). R.2 (b), and B.3 (a~. Any licensee under this Super¥isor'm L~cel).u, as defined in S~ction B~i (b) or B.1 (c); or have in hll ,mploy one who holds an Electrical Supervisor's License as d,fined in B.1 (b) or B.1 (c). Scope of work permitted license is determined by classification of Supervisor. Commercial .Su~ervisor's License (b) An individual who supervises the work and is responsible for installing, maintaining, altering, or repairing electrical wiring, electrical devious, electrical appliances, and electrical equip- ment while in th~ ~mploy of an Electrical Contractor Licensee shall be ~,qul~,d to obtain a licenle from the Department in order to engage in such activities. B.1 One and Two-Famil~ Residential Electrical Su~ervisor's License (c) An individual who superv2ses the work and is responsible for ~nstalling, maintaining, altering, or repairing one and two-family residential electrical wiring, electrical devices, electrical appliances, and electrical equipment while in the employ of an Electrical Contractor L~censee, shall be required to obtain a license from the Department in order to engage in such activities. Section B Mechanical Licenses (continued) B.2 Plumbing Licensing and Registration B.2 (a) Sanitary Plumbing Registration Any person, firm, or corporation who is licensed by the Indiana Plumbing Commission as a Plumbing Contractor in accordance with Public Law 188 of the Indiana Acts of 1972 as Amended, and who performs any work under said plumbing license shall be required to register with the Department in order to engage in such activities. Any registrant herein shall be permitted to install Power and control wiring as may be requ%red for satisfactory performance of installed fossil fueled heat systems, and domestic water heaters, as set forth in paragraph B.2 (a)-l. B.2 (a)-l. Anyone who has license under B.2 (a) shall be permitted to make electrical connections and install control wiring as may be required for satisfactory performance of either new instal- lations or replacements of fossil fueled heating systems, heat pumps or domestic water heaters. Such work is restricted as follows: Control wiring no restriction unless codes require it to be installed in metal raceway. In these cases, raceway shall be installed by Electrical Contractor. Circuit wiring may be completed from a dis- connect located and rated to comply with applicable code. For new installations, circuit and disconnect will have been pro- vided by Electrical Contractor. For replace- ment, connection may be made to existing circuit and disconnect are not exceeded, and location complies with applicable code. Licensee is not permitted to install service equipment, branch circuit, over current devices, nor resistance electric heat. Licensee shall clearly state on each permit application for replacement of first-time installation at existing buildings who will do electrical portion of work: i.e. by licensee or others. (b) Non-Sanitary Plumbing License Any person, firm, or corporation who engages in the installation, maintenance, alteration or repair of piping systems not specificall covered by the Sanitary Plumbing Code of the State of Indiana, ex- cluding fuel and refrigerant lines for heating and air conditioning shall be required to obtain a license from the Department in order to engage in such activities. An examination shall be required of any license applicant in the following special Categories i, j, and k as definded below: Areas covered by non-sanitary licensing include but limited to the following special categories i, j, and k. (a) Storm drainage (b) Underground tanks for fuel (c) Aboveground tanks for fuel (d) Compressed air systems (e) Temperature controls (f) Sprinkler systems (g) Hydraulic systems (h) Gas piping systems (i) Refrigeration system - refrigerant system that is capable of maintaining a constant temperature Section B Mechanical License (continued) B.2 Non-Sanitary Plumbing License below 60© Fahrenheit in a structure (j) Low pressure hot water and steam and equipment (k) High pressure steam boiler heating boilers Any person, firm, or corporation holding a Jeffersonville Heating, Air Conditioning, Refrigerant, and Duct System License prior to 1982 will not be required to obtain a Non-Sanitary License for the following special Categories i, j, and k as defined above. Any registrant herein shall be permitted to install power and control wiring as may be required for satisfactory performance of installed fossil fueled heat systems, and as set forth in paragraph B.2 (b)-l. ~ B.2 (b)-l. Anyone who has license under B.2 (b) shall be permitted to make electrical connections and install control wiring as my be required for satisfactory performance of either new installations or replace- menus of fossil fueled heating systems, heat pumps. Such work is restricted as follows: Control wiring. No restriction unless codes require it to be installed in metal raceway. In these cases raceway shall be installed by Electrical Contractor. Licensee shall clearly state on each permit appli- cation for replacement of first-time installation at existing buildings who will do electrical portion of work: i.e. by licensee or others. New fucl systems, except parts thereof controlled and maintained by a public utility, shall conform to the requirements of this Chapter and shall not be made operative until first approved by the City of Jeffersonville Building Department official. mR-1 Natural Gas A4 The following procedure shall apply to any installation requiring a new meter set and turn on Meter to be connected to supply line only upon approval of the Jeffersonville Building Department. Approval to be given to the proper department of serving gas supplier by phone and confirmed in writing. Fuel supply line to bear inspectors tag as having met the following requirements: 1. Ail welded pipes to be tested at 60 PSI for 30 Minutes. 2. Threaded line 1½" or larger to be tested at 30 PSI for 15 minutes. 3. Threaded line 1¼" or smaller to be tested at 10 PSI to gasoline to be made~ certified welder for 15 minutes. Ail welds RR-1 D. F. G. RR-2 A. RR-3 A. RR-4 A. B.3 B.3 (a) Natural Gas Fuel lines to extend outward from building from 4-6 inches. Ail gesting to be completed in the presence of a City of Jefferson- ville Building Department official. Inspection to made within two (2) days after request from contractor on a normal working day. Gas to be released to heating plant or water heater only if these bear an approval from a City of jeffersonville Inspector. All other gas burning appliances are excluded. uNDER NO CIRCUMSTANCES IS THE METER LOCKING DEVICE TO BE REMOVED OR GAS INITIALLY RELEASED BY OTHER THAN EMPLOYEES OF SERVICE GAS SUPPLIER. Upon gas release the employee may light pilot, ignite main burner, check for proper ignition, adjust flame air control, then shut down the unit by closing both the hand valve and automatic valve serving each unit. It shall be the responsibility of the Heating Contractor to put the heating unit into service, veri~y the safety and per- formance of each control, part and overall operation. Liquid Petroleum Gas New line installations shall conform to regulations as set out for natural gas. Continuous roll copper tubing %" or smaller is exempt except if concealed within a building or buried underground. Liquid Fuel No testing of lines carrying liquid fuel shall be demanded unless buried underground. If buried they shall comply with Section M-1921 of Indiana State Building Code covering one and two-family dwellings or in accordance with requirements of UMC Standard Number 5-1. Temporary Heat - Warm Air Warm air heating plant shall not be put intO operation without having the return air system completely connected to heating unit or, when applicable, installed under ANSI Regulation A83.7, as approved October 17, 1974. Heating, Air Conditioning~ Refrigerant, and Duct System Licenses. Heating, Air Conditioning~ Refrigerant and Duct System Contractor'~ License Any person, firm, or corporation who contracts for the servicing and installation of heating, air conditioning, refrigerant, and. duct systems in any structure shall be required to obtain a license from the Department. Any license under this classification must either be the holder of a Heating, Air Conditioning, Refriger- ant and Duct System Supervisor's License, in the category or categories as enumerated below, or have in his employ a holder of Heating, Air Conditioning, Refrigerant, and Duct System Supervisor's License, as set forth in Section B.3 (b) below. In order to engage in any activity or activities for which said supervisors must be qualified within a specific licenses category. Any registrant herein shall be permitted to install power and control wiring as may be required for satisfactory performance of installed electric air conditioning, fossil fueled heat systems, as set forth in paragraph B.3 (a)-i B.3 la)-I Anyone who has license under B.3 (a) shall be ' 1 permitted to make electr~ca connections and install control wiring as may be required for satisfactory performanoe of either neW installations or replacements of electric air conditioning, fossil fueled heating systems, heat pumps. Licensee shall clearly state on each permit appli- cation for replacement or first-time installation at existing building who will do electrlca portion of work: i.e. by licensee or others. ~ Air Conditionin~erant' a~ Su~ervlsor's License Any individual who supervises the work of installing, maln- taininq, altering, or repairing heating, air conditioning, refrigerant, and duct systems equipment, appurtenances and accessories while in the employ of a Heating, Air Conditioning, Refrigerant, and Duct System Contractor Licensee shall be required to obtain a license from the Department. A super- visor must be qualified to act in a supervisory capacity in the respective category or categories for which he is licensed and must have worked for a period of five (5) years or equivalent for a B.3 (a) Contractor, one (1) year of which he must have been a Journeymen, as defined in B.3 (c) below, in order to engage in such actlvities in a certain category or categories. A Supervisor's License will be issued in any one o a combination of the following categories: Category A - Heating and air conditioning systems having a heating capacity of 360,000 BTU or less, and a cooling capacity of 120,000 BTU or less, includinq fuel and refrigerant lines required (including, but not limited to electric, gas or oil fired furnaces and duct heaters) that do not utilize a high pressure steam boiler. Category B - Heating and air conditioning systems having a heating capacity of 1,800,000 BTU or less, and a cooling capacity of 600,000 BTU or less, includin~ fuel and refrigerant lines required (including but not limited to electric, gas, or oil fired furnaces, and duct heaters) that do not utilize a high pressure steam boiler. Category C - Heating and air conditioning systems together with refrigerant and fuel lines, required, withou regard to any BTU limitations. Category D - Duct System License (a): low pressure duct syste~ with velocities of 2,000 FMP, duct static pressuz to 2 inches of W.C. and transporting no more than 4,000 CFM. Category E Duct Systems License (b): (6) B.3 Heating, Air Conditioning, Refrigerant, and Duct System Supervisor's License Category E - Duct Systems (b): 1. Installs, services, maintains, alters or repaars any medium and high pressure duct system as defined by ASHRAE Guide, without restrictions as to CFM. 2. Installs, services,~ maintaans, alters, or repairs exhaust systems, blow pipe systems, dust collector systems, and other specialty fields not specifically mentioned herein. Category F - Start up service, or maintain gas burners, oil burners, stokers, air conditioning, etc. Category G - Electric air conditioning for systems with a cooling capacity up to and including 120,000 BTU. Section C C.1 Category C.2 Sign License "A" Sign Contractor License Any person, firm, or corporation who engages an the erection, placing, moving or maintenance on or off premises, exterior signs or displays used for advertising, promotion or public notice purposes shall be required to obtain a license to engage in such activities. This category shall include, but not be limited to permanent, temporary, por~ble, mobile trailer signs, electric and non-electric signs, and make electric hookup to existing service outside of building. This license permits in addition to the above activities those listed in C.2 below. Those signs requarang electrical hookup must have a permit and be wired by a licensed electrician in the City of Jeffersonville. No sign license assued under this ordiance shall be transferable, unless the transferee shall meet all the requirements of this ordiance. If the transferee is a corporation, said corporation shall furnish to the Building Commissioner an affidavit that as principal stockholder, operation or plant manager or superintendent meets all the requirements of this ordiance. Installation or erection of architectural letters or numerals are e~empt from above categories. Any person, firm, or corporation holding an active Commercial General Contractor's License is exempt from Categories A, B, and C above when constructing, erecting, or installing building mounted identification signs or a freestanding building identification sign {building identification sagnage means the principal name and/or address of the building) with letters or numerals of materials which are normally part of the bid documents as issued by an architectural/engineering firm for any new project. This work shall be part of the work historically performed by the general contractor and no extra permits will be required. Section D Contractor Licensees All structural, electrical, mechanical, and plumbing contractor licensees shall be required to have in their employ, an andividual superintendent/supervisor licensee or registrant, whichever is applicable in order to do work under any of any licensing or registration categories for which a superintendent/supervisor card shall be issued only to an individual. (7) Section D Contractor Licenses The superintendent/supervisor is not required to be on the job at all times, however, this is subject to the size and complexity of said job and is the discretion of the Building Commissioner. The name of the superintendent/supervisor shall be given at the time of issuance of the permit for reference only. Section E Examinations for Licenses Any person, firm, or corporation applying for any license, except as hereinafter provided, shall be required to take an examination given by the Building Commissioner, with Board approval. E.1 Time and Date of Examination (a) Examinations for license applicants shall be conducted the first week of June and the first week of February. The time, date, and place of the examination to be conveyed to license applicant at the time of his application. The Board of Mechanical Control may con- duct examinations at other times and from time to time if, in their opinion, an examination is necessary to avoid the imposition of a hardship on a license applicant or applicants. E.1 Examinations (b) Examinations shall be standard in form and shall be prepared by the Building Commissioner or other individuals as designated by the Commissioner. E.1 Examination Results (c) The Commissioner may use the Chief Inspector of the examined trade involved, as well as all other individuals as the Commissioner feel may be required to make fair, unbiased, and impartial judgment of the results of the applicants examination and the applicants qual- ifications based upon his examination results. Applicants shall be notified of examination results within thirty (30) days and of his right to appeal within ten (10) days thereafter. E,1 (d) Hearing If a license applicant has been rejected by virtue of his exam-~. ination results, applicant may appeal such rejection and shall be entitled to a Hearing before the trade committee involved of the Board. A request for such Hearing must be made in writing within ten (10) days after receipt of notice of rejection by the applicant The Board shall thereafter notify the applicant of its decision within a reasonable time after the hearing. E.1 Examination Fee (e) The Building Commissioner, with Board approval, shall presczibe a reasonable examination fee to be paid by the license applicant, said fee to defray the cost of preparation and conducting the grading of examinations. This fee may be changed from time to time as the Commissioner sees fit in order to defray the expenses as set forth. E.2 Expiration and Renewal of Licenses or Registration Ail licenses or registration, together with the renewal thereof, shall expire on the 31st day of December of each year. Thereafter, every licensee or registrant shall have the right, without further examination, to obtain a license of the same classification each calendar year after the issuance of said license or registration, upon the payment to the Jeffersonville Building Department of the prescribed annual license or registration fee. Whenever any license issued under the provisions of the codes administered by this Department and these Rules and Regulations has expired for a period of twelve (12) calendar months, the licensee must apply for a new license at initial license fee. (8) F.3 Inactive License F.4 (a) {b) (c) Any contractor licensee may elect to hold his license in an inactive status upon informing the Department and thereafter the inactive licensee shall be registered by the department upon payment of an annual fee of $25.00. License issuance to persons or firms heretofore engaged in the following categories without examination; pursuant to F.4 a, b, c, & d; Commercial Contractor, Commercial Construction Super- intendent, Residential Contractor, Residential Construction Superintendent, Home Improvement Contractor and non Sanitary Plumbing Contractor. Any person, firm or corporation that has contracted to do and has done work in the City of Jeffersonville at least one year prior to'the effective date of this ordinance may be issued a license by the Building Commissioner without examination. Proof of having done business in the City of Jeffersonville one year prior to such date shall be by a showing that a work permit was issued by the Building Commissioner to such applicant at least one year prlor to such effective date and by this evidence only. The Building Commissioner shall inspect the work of any applicant receiving a license under this section as soon as possible and may thereafter require an examination as provided. (d) Ail licenses shall be non transferable. Section 10. Fees Fees Paid to the Clerk-Treasurer Ail fees for permits required to be paid by any section of this Chapter, or elsewhere in this Code shall be paid to the City Clerk-Treasurer when such permits are issued by him, with the approval thereof by the Building Commissioner. The permit fee for all public owned structures or structures owned and wholly occupied by religious or non-profit organi- zations shall be one-half the fee as stated in any section of this chapter. Permits covering the work to be performed are to be issued only to licensed permit applicants, provided however, that nothing in these Rules and Regulations shall be construed to prevent a person who owns and occupies a single or two-family residence from securing a permit to personally perform the work allowed by the permit, provided he shows to the satisfaction of the Building Commissioner that he has reasonable knowledge of such work and is capable of completing such work. No permit shall be required for any agricultural outbuilding. It shall be the duty of any license holder, as described in para- graph B-2, who secures any permit for work, to insure that any work which is sub-contracted under said permit, only be sub- contracted to an active licensee of this Department, in good standing, qualified by license to perform that particular work which is to be sub-contracted. Section G Suspension and revocation of licenses or registration of Commercial General Contractor, Commercial Construction Superintendent, Residential Contractor, Residential Construction Superintendent, Home Improvement Contractor, Electrical Contractor, Electrical Commercial Supervisor, One and Two Family Residential Electrical Supervisor, Sanitary Plumbing Contractor, Non-sanitary plumbing Contractor, Heating, Air Conditioning, Refrigerant, and Duct system Supervisor, and Sign Contractor. (1) Any license or registration issued under this code shall be re- voked for the following causes: (a) Execution of a false affidavit in connection with the license application. (b) Failure on the part of the licensee to comply with this code with- in a reasonable time after having received written notice of such violation from the examining board. (2) Any license or registration may be suspended by the examining board for failure on the part of any licensee to correct any defect or deficiency, within such additional tame as may be allowed upon request to the board. (10) Section G (continued) (3) Any license or registration revoked or suspended because of de- fective work has been corrected; provided, however, that this requirement shall not apply where the licensee is prevented from making such correction by either the property owner, or for any other reasons deemed sufficient by the examing board. (4) The examing board, upon receipt of any information or complaint containing grounds for the revocation or suspension of a license or registration shall immediately cause written notice of such information or complaint to be issued to the responsible licensee. The notice shall state the nature of the-information or complaint and the time which the board has set for a hearing. If, after hearing, the board is satisfied that the weight of the evidence clearly shows that a violation has occured, the board may, with the approval of the commissioner of buildings, suspend or revoke the license or registration of such person. Section H' Conflicting Ordinances~ Effective Dater and Repeal of Conflicting Ordinances Section..1 General In any case where a provision of this ordinance is found to be in conflict with a provision of any zoning, building, plumbing, elec- trical, heating, ventilating, fire, or safety code of the City of Jeffersonville, existing on the effective date of this ordinance the provisions which establishes the higher standard or higher fees for the promotion and protection of health and safety of the people shall, prevail. .Section 2 Effective Date This ordinance shall be effective on and after the Section 3 Repeal of conflictin9 ordinances This shall provide that all ordinances and parts of ordinances in conflict herewith are hereby repealed. (11) This Ordinance shall be in full force and effect from and after its passage and approval. Adopted this day of , 1984.
