Whereas, The Clark County State Bank has petitioned the
City to vacate the following unmade right-of-way, said right-
of-way being located in the City of Jeffersonvi]]e, County
of Clark, State of Indiana, and more specifically described
as follows:
Being a 0.1170 of an acre part of Spring StreeL and
New Fourteenth Street in the City of Jeffersonvil]e,
Clark County, Indiana, and being more fully described
as follows, to-wit:
Commencing at the northwest corner of Block No. 146
of the City of Jeffersonville, Indiana, and running
thence South 85° 35' 45" East along the south right-
of-way line of 15th Street, 117.11 feet to an iron
pipe; thence South 17° 47' 02" East along the new
westerly right-of-way line of Spring Street, 277.78
feet to the true place of beginning of ]and to be
herein described:
Thence North 72° 12' 58" East, 19 feet to the back
of a concrete walk; thence South 17° 47' 02" East
along the back of said walk, 137 feet; thence South
6° 15' West along the back of a concrete wall, 6
feet; thence South 83° 45' East along the back of
said wall, 3 feet to the back of said concrete walk;
thence continuing along the back of said wa]k, the
following courses and distances: on a curve to the
right, said curve having a central angle of 110°
11' 20", a radius of 40 feet and a chord which bears
South 45° 01' 26" West, 65.60 feet; North 77° 30'
West, 25 feet; North 72° 30' West, 40 feet; thence
leaving said back of concrete walk, North 50° West,
26 feet to an iron pin on the new northerly right-
of-way line of Fourteenth Street; thence South 61°
44' 48" East along said new northerly right-of-way
line of Fourteenth Street, 30.50 feet to an iron
pin; thence along said new northerly right-of-way
line and along the new westerly right-of-way line
of Spring Street on a curve to the left, said curve
having a central angle of 136° 01' 54", a radius
of 50 feet and a chord which bears North 50° 14'
05" East, 92.73 feet to an iron pipe; thence con-
tinuing along said new westerly right-of-way line
of Spring Street, North 17° 47' 02" West, 103.22
feet to the place of beginning and containing 0.1170
of an acre of ]and.
Subject, however, to all existing utilities lying
in the above described 0.1170 of an acre parcel of
land, said utilities being a part of New Fourteenth
Street and Spring Street.
And, whereas, the Jeffersonville Plan Commission has approved
and recommended such vacation, subject to the following restrictions:
1. If and when the City of Jeffersonvi]]e should require
any portion of the area which has been vacated, up
to and including the whole thereof, the petitioner,
the Clark County State Bank, shall return said portion
to the City upon request being made by the City Attorney
to the bank without cost to the City.

THEREFORE, BE IT ORDAINED that the right-of-way above
is hereby vacated subject to the above restrictions.
