BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, CLARK COUNTY, INDIANA:
WHEREAS, it is in the best interest of the City to prevent
the travel of any motorized vehicle over certain bicycle tra~]s
in the City and within certain areas of the City parks; and
WHEREAS, the City of Jeffersonville has the authority
to restrict the travel of such vehicles ~ithin the City limits,
the following Ordinance is deemed necessary and appropriate.
SECTION 1
It shall be unlawful for any person to ride a moped, motorbike,
motorcycle or other motorized vehicle on any bicyle path, or
in any park in the City of Jeffersonville or which the City
of Jeffersonville owns unless such travel is done in an area
where automobile traffic is presently allowed.
SECTION 2
The B~ard of Public works and Safety shall erect such
signs as are necessary to inform the public of the restrictions
set forth in Section 1.
SECTION 3
PENALTY
Any person who violates the provisions of this Ordinance
shall pay an assessment of Fifteen Dollars ($15.00) (except
as hereinafter provided) if paid within seventy-two (72) hours
of the time of such violation to the Clerk-Treasurer of the
City of Jeffersonville.
In the event that any person charged with a violation
hereunder fails to pay as above provided, such persons shall
be charged in City Court and upon conviction shall be charged
not less than Fifteen Dollars ($15.00) nor more than Five Hundred
Dollars ($500.00).
In addition to any fines which may be given as a result
of violations of this Ordinance, any vehicles which are used
in violation of this Ordinance may be towed to an area
designated by the Chief of Police of the City of Jeffersonv~]le,
Indiana, at the owner's expense. The owner shall also be required
to pay any and all storage fees resulting from this action.
SECTION 4
This Ordinance shall be in full force and effect from
and after its passage by the Common Council of the City of
Jeffersonville, upon its passage, approval and publication
as required by statute.
