WHEREAS, the Board of Trustees of the Clark County
Memorial Hospital has petitioned the City to vacate the following
Avenue, said Avenue being located in the City of jeffersonville,
County of Clark, State of Indiana, and generally described
as 130 feet of Duncan Avenue, immediately south of Thirteenth
Street, and more specifically described as follows:
All that part of Duncan Avenue, 50 feet wide, in the
City of jeffersonville of Clark County, Indiana, that
lies between Lot No. 3 in Block No. 1 of IngramLeavenw°rth
Plat and Lot No. 1 in Block No. 3 in said Ingram
Leavenworth Plat, extending southward from the south
line of Thirteenth Street to and including a ten (10)
foot wide alley, the whole of which is bounded as follows:
Beginning at the northwest corner of said Lot No. 3 in
Block No. 1 in the south line of Thirteenth Street,
running thence South, 140 feet with the west line of
said Lot No. 3 to the south line of said ten (10) foot
wide alley; thence West, 50 feet with the south line of
said alley; thence North, 140 feet with the east line
of said Lot No. 1 in Block No. 3 to the northeast
corner thereof in the south line of Thirteenth Street;
thence East, 50 feet with the south line of Thirteenth
Street to the place of beginning.
WHEREAS, the jeffersonville Plan Commission has
approved and recommended said vacation subject to the following
restrictions:
1. The vacation is made subject to all existing utility
easements on the property in question.
NOW, THEREFORE, BE IT ORDAINED that the Avenue above
described be and is hereby vacated subject to the above
restrictions ·
This ordinance shall be in full force
from and after its passage and approval. Passed this ~ day of
