Notwithstanding any other provisions of the City code,existing ordinances not yet codified, resolutions or Orders of the Board of Public Works and Safety, stop signs shall be erected on Market Street at its intersection with Walnut Street in the City of jeffersonville. OREM At the Council meeting of October 7, 1985, the Council felt this Ordinance should be passed and the ~-ign replaced for safety purposes. Councilman.~'. Perkins made a motion t~> override the Mayor's veto and pass ordinance No. 85-OR-52, seconded by Councilman Waiz. The Mayor's veto was overridden by a vote of 6 in favor of and 1 abstention. EXCERPTS FROM THE COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA October 7, 1985 The Common Council of the City Of jeffersonville met in regular session in the City-County Building, in the Clark Coun- ty Cour~ Room, in jeffersonville, Indiana, on the 7th day of Octo- ber, 1985, at 7:30 o'clock P.M. The meeting was called to order by Mayor Dale Orem pre- siding and Clerk-Treasurer C. Richard Spencer at the desk. Mayor Orem asked all those present to stand and pledge allegiance to the flag and welcomed all students as well as mem- bers of this year's Leadership Class and visitors in attendance. The roll was called and those present were Councilmen Perkins, Waiz, Shrewsberry, Weidner, Potter, Allen and Grooms. After the taking of the roll, other business followed. Councilman Perkins inl~la~ed discussion concerning the stop sign at Market and Walnut Streets, which had been ~aken down on Market Street, and he has now requested that it be replaced. Mayor Orem addressed the Council concerning said sign and gave a repor~ on The survey he had conducted by the Police Department con- cerning a 2700 traffic count by radar on Market Street of eastbound and westbound traffic, and gave the results of said study. The Council at the last meeting passed an Ordinance ~o put the sign back up, which Mayor Orem did not sign in the 10 days following passage by the Council, which by law conssitutes a veto by the Mayor. Mayor Orem s~ated his reasons for no~ signing said Ordinance and expressed his feeling that there were a~ this rime a~ least six crossings ~hat were more serious and where stop signs have been quested. He cited Cedarview at Plank Road as an example. Council- man Pot~er felt perhaps ~his matter should come before the Board of Works ra~her ~han the Council. Councilman Perkins stated he did not like ~o override a Mayor's veto but he felt very strongly this Ordinance should be passed and the sign replaced for safety pur- poses. He then introduced Ordinance No. 85-0R-52, An Ordinance Con- cerning a Stop Sign, and made a motion to override the Mayor's veto and pass Ordinance No. 85-OR-52, seconded by Councilman Waiz and the following roll call vote was recorded: Ayes: Councilmen Shrewsberry, Weidner, Potter, Allen, Perkins and Waiz. Councilman Grooms abstained. The Mayor's veto was overridden by a vote of 6 in favor of and 1 abstention. Councilman Perkins requested the sign be replaced as soon as possible and Councilman Grooms asked that there be some newspaper publicity concerning the replacement of the sign in or- der to inform those traveling on that street. Other business followed. There being no further business to come before the Coun- cil, Councilman Potter made a motion to adjourn the meeting at 10:00 o'clock P~M., seconded by Councilman Waiz and unanimously carried. OREM OCTOBER 1, 1985 VETO OF ORDINANCE 85-OR-52 Gentlemen: As I informed you in our meeting of September 21, 1985, I have vetoed Ordinance No. 85-OR-52. As you know, this is the first ordinance which I have vetoed during my term and I do so with some regret since this indicates that for the first time we have been unable to reach a compromise concerning any particular piece of legislation. The reasons for my veto are quite simple. At my instruction, the Jeffersonville Police Department ran several surveys over an extended period of time concerning the usage of the intersection As a result of those surveys and a close review of in question. the situation by the Police Chief, the Fire Chief, the City Engineer and the Street Commissioner, we made a determination that it was in the best interest of all residents of the City that the stop sign be removed. I will present those surveys at the meeting on October 7, 1985. It is my belief that we enhance the safety of 'the City and dramatically improve the flow of traffic by the removal of this stop sign.
