RESOLUTION CONCERNING LITIGATION
WHEREAS, the Common Council desires to make a formal declaration oi its
support for the 3eilersonville Police Department and its police officers individually
named in Lou Ann Dyer, et. al. verses City of 3effersonville~ Indiana, et. al., Cause
Number $1-C-232 in the Circuit Court of:Washington County, Indiana; and,
WHEREAS~ the City of 3ellersonville is liable for all damages awarded an
individual in its employ ii that individual acted in good faith, in his capacity as an
employee to its extent of $300~000.00i. and,
WHEREAS, the Common Council has been presented with a demand by the
plaintifl's council in the subject action; and,
WHEREAS~ the Common Council does not believe that the City has any liability
in the subject action.
NOW, THEREFORE~ BE IT RESOLVED by the Common Council oi the City of
3effersonville:
(1) In the event any money damages are.awarded against the officer named
individually in the subject action, the City will pay the damages to the extent of its
legal liability.
(2) The Common Council re}ects the settlement offer tendered by the plaintiff.
