HomeMy WebLinkAbout11-10-2003November 10, 2003 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA November 10, 2003 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30 P.M. on Monday, November 10, 2003. Mayor Tom Galligan, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Anne Marie Galligan and Deputy Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Ron Grooms gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Les Merkley, Ron Ellis, Denny Frantzo Rob Waiz, Barbara Wilson, and Ron Grooms. Absent: Councilperson Vicki Conlin. Councilperson Merkley made the motion to add a Resolution regarding the Carnegie Library to the agenda as agenda item 15A, second by Councilperson Grooms, passing on a vote of 6-0. Councilperson Merkley then made the motion to approve the agenda as amended, second by Councilperson Wilson, passing on a vote of 6-0. Mayor Galligan presented the minutes of the meeting of October 20, 2003 for consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Councilperson Merkley, passing on a vote of 6-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council. Clerk Treasurer Wilder presented an additional claim for Cmm's Auction in the amount of $1,000 to be paid from the Council budget. Clerk Treasurer Wilder has requested a breakdown of the claim for Hannum, Wagle & Cline and has not received it. Council President Waiz made the motion to approve the claims, with the addition of the claim for Crum's Auction and the removal of the Hannum, Wagle & Cline claim, second by Councilperson Grooms, passing on a vote of 6- 2 November 10, 2003 PUBLIC COMMENT: Ms. Jun Paddocks, representing a group fxom the historic district, expressed concern for the demolition of a house at 420 East Maple. This house was rated outstanding as of 1988 and was one of the older houses in the City. She encouraged the Council to pass an Ordinance that would protect older houses by requiring public notice and a waiting period. AGENDA ITEMS: Attorney Mike Naville appeared before the Council to request passage of Ordinance No. 2003-OR-37, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No. 33 Of The Illinois Grunt From C2, Business Park/Light Industrial to PD-C2, Medium To Large General Commercial. Planning and Zoning Director Chris Padgett noted this request received a favorable recommendation bom the Plan Commission. Council President Waiz made the motion to pass Ordinance No. 2003-OR-37, second by CounCilperson Wilson. Counoilperson Grooms said the City may want to consider looking at, and revising the comprehensive master plan to include a community impact study. The motion to pass Ordinance No. 2003-OR-37 passed on a vote of 6-0. Ms. Phyllis Croee appeared before the Council to request passage of Ordinance No. 2003-OR-38, An Ordinance Grunting Petition To Vacate A Public Way In The City Of Jeffersonville, explaining the request. As this meeting is a public hearing on the request, public input was requested. Ms. Melody Carico encouraged the Council to approve the request. She then noted she had placed three calls to the City Attorney's office for information and did not have her calls returned. City Attorney Galligan said she did not understand she was to return the calls und thought her paralegal had answered Ms. Carico's questions. As there was no further public comment, Council President Waiz made the motion to pass Ordinance No. 2003-OR-38 on the first reading, second by Councilperson Merkley, passing on a vote of 6-0. Mr. Alan Applegate, an attorney representing Dominion Homes, appeared before the Council to request passage of Ordinance No. 2003-OR-39, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No.'s 34 And 35 Of The Illinois Grant From M2: General Multifamily Residential, CI: Small To Medium Scale General Commercial And RI: Low Density Residential To R3: Old City Residential. Attorney Applegate explained the area und the intended use. The use would be 242 single-family lots on 48.65 acres with 20% open space in the old city style with alleys. A homeowners association will care for November I0, 2003 3 the open spaces. The homes will be in the range of $105,000 to $155,000. Entrance and dra'mage concerns were voiced. The area that is not within the city limits will be annexed through a voluntary annexation. Following all discussion, Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-39, second by Councilperson Grooms, passing on a vote of 6-0. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-35, An Ordinance Transferring Certain Funds Within Same Department (Animal Shelter) on the second and third readings, second by Council President Waiz, passing on a vote of 6-0. Councilperson Merkley next made the motion to pass Ordinance No. 2003-OR-36, An Ordinance Of Additional Appropriation (Local Roads and Streets) on the second and third readings, second by Councilperson Grooms, passing on a vote of 6-0. Mr. Jeff Corbit appeared before the Council to request approval of an Interlocal Agreement On Sanitary Sewer System. Councilperson Merldey made the motion to adopt the agreement, second by Councilperson Grooms, passing on a vote of 6-0. City Attorney Gall[gan presented Resolution No. 2003-R-19, A Resolution Endorsing Transfer Of The Carnegie Library Building To The Jeffersonville Carnegie Library Foundation, explaining the proposed use. Mr. Tom Lindley encouraged the Council to support the Resolutiom Councilperson Ellis said he supports the Resolution but feels slighted the Council has not been approached and been made aware of the proposal. Councilperson Grooms asked if the City would have any financial responsibility. The answer is no. Councilperson Grooms then made the motion to pass Resolution No. 2003-R-19, second by Councilperson Wilson, passing on a vote of 6-0. COUNCIL AND MAYOR COMMENTS: Council President Waiz wished all a good night. Mayor Gag[gan reviewed the dedication of the Thomas Jefferson statue, saying the tree blocking the view will be moved, and the statue will be lighted. It was a great day that made a great statement. The statue looks like no other and looks alive and moving.
