ORDINANCE CONCERNING STREET CUTS WITHIN THE
CITY
WHEREAS, the Common~Council of the City of jeffersonville
belleves that
indiscriminate cutting of City streets, highways,
alleys and other paved areas has created a significant safety
hazard within the City limits; and
WHEREAS, the contractors and/or companies making such
cuts appear to be unable to restore them to useable condition;
and
WHEREAS, the Common Council of the City of jeffersonville
believes that it is in the best interest of the citizens of the
City of jeffersonville to enact restrictions upon the cutting of
holes in i~s streets, highways, alleys and other paved areas.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of jeffersonviile as follows:
1. That if any utilit~ company, con%ractor or individual
causes a total of twenty-five (25) square feet of replace-
ment asphalt to be installed or paved within any City
block during any continuous ~wetve-month period, said
utility company, contractor or individual shall be
required to resurface the entire width of the street,
highway, alley or other paved surface for the full City
block within the current paving season with a minimum
of one (1) inch compacted thickness of surface type hot
asphaltic mix. The existing paved surface shall be
tack coated before paving. For the purposes of this
ordinance, a City block shall be deemed to be any continu-
ous three hundred (300) feet stretch of street, highway,
alley or other paved surface within the City if located
in an area in which a City block is not readily
ascertainable. In no event shall a contractor, utility
company or individual be caused to replace or repave
any continous stretch of street, highway, alley or other
paved surface within the City, in excess of three hundred
(300) feet by reason of violation of this ordinance,
unless other violation hereof shall be committed in
contiguous or continuing areas of the same street,
highway, alley or other paved surface.
Any contractor who fails to do the resurfacing required
above in a timely manner shall be denied any further
permits for such c~t~s or other paving until the required
paving shall be completed in the manner set forth herein.
This ordinance shall be in full force following its
signing and publication as required by law.
