ORDINANCE VACATING A PORTION OF ILLINOIS AVENUE
IN THE CITY OF JEFFERSONVILLE, INDIANA
WHEREAS, the Jeffersonville Wastewater Treatment Plant
filed a Petition requesting the City of jeffersonville,
Indiana, to vacate that portion of platted Illinois Avenue
southern of Tenth Street to the northern boundary of Ninth
Street, which Petition is in the following words and figures
follows:

AND WHEREAS,
as
the Common Council has caused public hearing
to be set for August 1, 1988, at 7:30 P.M., in the Council
Chambers and the Clerk-Treasurer has caused notice of that
hearing to be published to be published in the jeffersonville
Evening News pursuant to Indiana law; and
WHEREAS, the Common Council on August 1, 1988, at 7:30
P.M., has heard all persons wishing to be heard on the Petition
and has determined that neither the public nor the City will be
harmed by vacation of that portion of Illinois Avenue more
particularly described hereinafter.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the city of Jeffersonville, Indiana, that:
The following described portion of Illinois Avenue be and
the same is hereby vacated subject only to the existing
utility easements if the same may be needed:
Being a part of Illinois Avenue in the City of Jeffersonville,
Clark County, Indiana and being further described as follows:
Beginning at the southeast corner of Block ~|0 in said city, same
being the northwest corner of Ninth Street and said Illinois Avenue; Thence
N.4°20'E., along the west Right-of-Way line of said Illinois Avenue, 276
feet to the Right-of-Way line of Interstate 65; Thence N.69°53'E., along
said Right-of-Way line, 65.9 feet to the east Right-of-Way line of
Illinois Avenue; Thence S.4°20'W., along said east Right-of-Way line,
303.3 feet to the Southwest corner of Block #109, same being the North Right-
of-Way line of Ninth Street; Thence N.85°38'W., 60 feet to the PLACE OF
BEGINNING.
Containing 0.40 acres, more or less.
This ordinance shall be in full force and effect
upon its timely passage, promulgation and approval by the
Mayor.
Passed and adopted by the common Council of the City of
jeffersonville, Clark County, Indiana, on the __L_~ day of

PETITION FOR VACATION OF A PORTION OF ILLINOIS AVENUE
IN THE CITY OF JEFFERSONVILLE~ INDIANA
The Petitioner, jeffersonville Wastewater Treatment Plant,
petition the Mayor and the Common Council of the City of
jeffersonville, in Clark county, Indiana, as follows:
1. The Petitioner, jeffersonville Wastewater Treatment
Plant, as a subdivision of this municipality, which operates at
the jeffersonville Wastewater Treatment Plant on the real
property located in an area between Ninth Street and Tenth
which area is dissected by a platted Illinois Avenue,

sole adjoining landowner of the property described hereinbelow
save for the State of Indiana, and its Department of Highways,
for that portion of State Road 62 (Tenth Street) lying directly
north of the Wastewater Treatment Plant.
4. That the Petitioner requests that a portion of
Illinois Avenue be vacated for purposes of clearing title to
the same for the benefit of the jeffersonville Wastewater
Treatment Plant, which property is more fully described as
follows:
Being a part of Illinois Avenue in the City of Jeffersonville,
Clark County, Indiana and being further described as follows:
Beginning at the southeast corner of Block ~I0 in said city, same
being the northwest corner of Ninth Street and said Illinois Avenue; Thence
N.4°20'E., along the west Right-of-Way line of said Illinois Avenue, 276
feet to the Right-of-Way line of Interstate 65; Thence N.69°53'E., along
said Right-of-Way line, 65.9 feet to the east Right-of-Way line of
Illinois Avenue; Thence S.4°20'W., along said east Right-of-Way line,
303.3 feet to the Southwest corner of Block #109, same being the North Right-
of-Way line of Ninth Street; Thence N.85°38'W-, 60 feet to the PLACE OF
BEGINNING.
Containing 0.40 acres, more or less.
5. The Petitioner states that the State of Indiana,
Department of HighwayS, has been notified by Certified Mail of
this request, and that no persons will suffer damage if the
platted portion of Illinois Avenue is vacated.
WHEREFORE, the Petitioner asks the Mayor and the common
Council of the City of jeffersonville, clark County, Indiana,
to adopt an ordinance vacating the above-described portion of
Illinois Avenue in the city of jeffersonville, Clark county,
Indiana, for all other just and proper relief.
