HomeMy WebLinkAbout1988-OR-27 WHEREAS, the boundary of the City of jeffersonville is contiguous to the real estate described herein; and , WHEREAS, on the /~ day of ~ 1988, a Petition for Annexation of the real estate described herein was filed by the legal and equitable owners of said real estate, requesting annexation of the area pursuant to I.C. 36-4-3-5. NOW, THEREFORE, be it ordained by the Common Council of the City of jeffersonville, Indiana, that: SECTION I. The following described land be, and the same is, hereby annexed and declared a part of the City of jeffersonville, Clark County, Indiana to-wit: Commencing at an iron spike in the centerline of the New Albany and Charlestown Pike, marking the west corner of Survey No. 21 of the Illinois Grant; running thence North 50° East along the line dividing Surveys No. 21 with No. 33 and 34, a distance of 1833.15 feet to a point; thence South 40° East, 2333.76 feet to a point in the center of the jeffersonville and Charlestown Pike and being the true place of beginning of land to be herein described: Thence North 16° 45' East along said centerline of the Jefferson- ville and Charlesto%~n Pike, 500 feet to a point; thence South 81° 15' East, 730 feet to a point; thence North 8° 45' East, 575 feet to a point; thence North 57° 14' 47" West, 305 feet to a point; thence North 73° 15' West, 350 feet to a point in the center of said jeffersonville and Charlestown Pike; thence North 16° 45' East along said road centerline, 1150 feet to a point; thence South 40° East, 1012.11 feet to a point; thence North 50° East, 462 feet to a point; thence South 40° East, 244.20 feet to a point; thence South 50° West, 32.51 feet to a point; thence South 400 East, 871.86 feet to a point on the westerly right-of-Way line of the B. & O. Railroad; thence South 18° 45' West along said westerly right-of-way line, 2855 feet, more or less, to a point; thence North 40° West, 2290 feet, more or less, to the place of beginning and containing 110 acres, more or less of land. ~/~, however, to the easterly one-half of the right-of-way of the Jeffersonville and Charlestown Pike. SECTION II. Be it further ordained that the boundaries of the City of jeffersonville shall be and the same hereby are, declared extended to include all of the real estate herein above described as part of the city of jeffersonville, Clark County, Indiana. SECTION III. This ordinance shall be in full force and effect from and after its passage, promulgation, approval by the Mayor and publication in accordance with the law. Subject, however, to the easterly one-half of the right-of-way of the Jeffersonville and Charlestown Pike. The total border of this land is 11,395.88 feet, of which 2,290 feet are contiguous with the City's corporate boundaries. Therefore, 20% of the borders of the proposed annexation is contiguous with the City's corporate boundaries. Ethel E. Woehrle is the sole legal owner of the real estate described hereinabove, and Terry W. Thom is the equitable owner of such real estate based upon contract for sale of such land executed between himself and Ethel E. Woehrle.
