HomeMy WebLinkAbout1988-OR-17 ORDINANCE NO. 88-OR-17 ORDINANCE REQUIRING CONNECTION TO AVAILABLE SANITARY SEWER LINES IN THE CITY OF JEFFERSONVILLE, INDIANA WHEREAS, the Indiana Legislature has established guidelines requiring property owners connection to sanitary sewer systems pursuant to I.C. 36-9-23-30; and WHEREAS, the City of jeffersonville desires to promote and maintain the health and welfare of the citizens of the City through active enforcement of the provisions of the Indiana Code. NOW, THEREFORE, the City of jeffersonville, Indiana: 1. That the owner of all houses, used for human occupancy, purposes, situated within abutting on any which there is BE IT ORDAINED by the Common Council of buildings or property employment, recreation or other the City of jeffersonville, and street, alley, easement or right-of-way in now located or may in the future be located a public sanitary or combined sewer of the City, is required at his expense to install suitable toilet facilities therein, and to connect such facilities directly with the proper public sewer in accordance with the provisions of this chapter, within ninety (90) days after the date of official notice to do so, provided that the public sewer is within three hundred feet (300') of the property line. 2. That all houses not tapped into the sanitary sewer system within thirty (30) days after written notice by the city Building Commissioner in contravention of Section (1) hereinabove shall be deemed public nuisances and shall be abateable in such manner and punishable under such penalties as are presently provided for public nuisances in the jeffersonville city code. This ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor.
