HomeMy WebLinkAbout1988-OR-16 ORDINANCE NO. 88-OR-~ ORDINANCE REGARDING REMOVAL AND DISPOSAL OF ABANDONED VEHICLES WHEREAS, the General Assembly has declared that abandoned vehicles are a public ~isance and a safety and health hazard pursuant to I.C. 9-9-1.1-1; and WHEREAS, the General Assembly has empowered municipal bodies to enforce by ordinance certain aspectS of an act relating to the removal and disposal of abandoned vehicles pursuant to I.C. 9-9-1.1-9 and I.C. 9-9-1.1-16- NOW, THEREFORE, BE IT ORDAINED by the Common council of the city of jeffersonville, Indiana: SECTION 1 ,,Abandoned vehicle" is defined by I.C. 9-9-1.1-2 as follows: 1. 2. A vehicle located on public property illegally; A vehicle left on public property continuously without being moved for three (3) days; 3. A vehicle located on public property in such a manner as to constitute a hazard or obstruction to the movement of pedestrian or vehicle traffic on a public right-of-way; 4. A vehicle that has remained on private property without the consent of the owner, property, for more than 48 hours; 5. A vehicle from which or person in control, of that there has been removed the engine, transmission, or differential or~ that is otherwise partially dismantled or inoperable and left on public property; 6. A vehicle that has been removed by a towing service or a public agency upon request of an officer enforcing a statute or ordinance other than I.C. 9-9-1.1-1 et seq., if the vehicle once impounded is not claimed or redeemed by the owner or his agent within fifteen (15) 7. A vehicle that is mechanically inoperable and continuously in a location days of its removal; or six or more model years old and is left on private property visible from public property for more than thirty (30) days. SECTION 5 The charges for towing abandoned vehicles in the City of jeffersonville shall not be more than $50.00 per tow. SECTION 6 for abandoned vehicles shall not be The storage charges more than $5.00 per day. The Board of SECTION 7 Public Works and Safety of the City of jeffersonville shall have the authority to amend the towing and storage Charges from time to time and shall notify the Bureau of Motor vehicles of such amendmentS. This ordinance shall be in full force and effect upon its timely passage, promulgation, approval by.the Mayor, and publication.
