1. WhereaS, a petition has been made by Medical Plaza, of
Jeffersonville, an Indiana general partnership, located in
Charlestown, Indiana, to vacate a certain alley more specifically
described below, located between Locust Street and Wall Street
and between 11th Street and 12th Street, within the City of
Jeffersonville, in the County of Clark, in the State of Indiana;
and,
2. Whereas, the Common Council of the City of
Jeffersonville has held the hearing required by Indiana Code
§36-7-3-12; and,
3. Whereas, the appropriate notice has been given to the
abutting land owners; and,
4. Whereas, it has been shown to the Common Council of the
City of Jeffersonville, that notice by publication has been given
pursuant to Title 5 of the Indiana Code,
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the
City of Jeffersonville as follows:
The unimproved alley described in Exhibit "A" attached
hereto and highlighted in the survey attached hereto as Exhibit
"B", shall be vacated, and the immediately adjoining landowners
shall receive as their own the land which has been vacated by
this ordinance.
These land owners include the Medical Plaza of
Jeffersonville, a general partnership, and the County of Clark,
which obtained title to the property by reason of a tax title in
deed drawer 19, instrument no. 16197 as is set forth in the
records of the recorder of Clark County, Indiana.
This Ordinance shall be in full force and effect upon its
timely passage, promulgation and approval by the Mayor.
Passed and adopted by the Common Council of the City of
Jeffersonville, Clark County, Indiana, on the ~ day of
