RESOLUTION RESARDING EXCHANGE OF PROPERTY W TH THE
JEFFERSONVILLE BOARD OF'PARKS AND RECREATION DEPARTMENT
WHEREAS, it has been brought to the attention of the
Common Council of the City of Jeffersonville that no deed
exists for certain property along the Jeffersonville Riverfront
which has been operated within recent memory by the
Jeffersonville Board of Parks and Recreation as a park
property; and

WHEREAS, it is the desire of the Common Council of the
of Jeffersonville to establish good title for property in
Board of Parks and Recreation for the continued use of the
same as park property; and
WHEREAS, Indiana Code 36-1-11-8 allows the exchange of
property with another governmental entity for the exchange of
any amount of real property, cash, or other personal property
as agreed upon by the entities; and
WHEREAS, Indiana Code 36-1-11-11 provides for the
execution of a deed in situations where there is a dispute
concerning the interest in any property of the political
subdivision, or which the Mayor considers not frivolous, or
where such deed would facilitate the establishment of title to
any property. Such deed may be executed on behalf of the
political subdivision for any consideration that the disposing
agent considers fair and in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of
the City of Jeffersonville that it deems as fair and adequate
consideration the sum of One Dollar and No/100 (1.00) from the
Jeffersonville Board of parks and Recreation in order to
possess title in the property previously operated as a park by
the Board of Parks and Recreation within the City Of
jeffersonville, the full legal description of which is attached
hereto as Exhibit A and inoorporated herein by reference. Upon
the payment of such consideration by the Board of Parks and
Recreation, as well as the passing of a concurrent resolution
regarding the acceptance of this property by such Board, the
Mayor of the City of Jeffersonville.shall have the authority to
execute a deed for such property to the Board of Parks and
Recreation on behalf of the City of Jeffersonville, in order to
vest good and marketable title in the same to the Board of
Parks and Recreation.

Clark County, Indiana.

EXHIBIT A
Being all of Outlot #248 and #249, and the "commons" south of Riverside
Drive (formerly Front Street) in the City of Jeffersonville, all in Survey #!
of the ~ll~nois Grant to Clark County Indiana and being further described as
follows:
Beginning at the northwest corner of said Outlot #248, same being
southeast corner of Fort Street and said Riverside Drive (60 feet wide);
Thence northeastwardly, along the south llne of said Riverside Drive, 349~
feet, more or less, to the southwestern line of Block #43 in said city;
Thence southeastwardly, along said southwestern line, and said line extended
to the line dividing the state of Indiana and the Commonwealth of Kentucky;
Thence southwestwardly, along said dividing line, to a point where said
dividing llne would intersect the eastern Right-of-Way line of said Fort
Street if extended to said dividing line; Thence northwardly along the
extension of said eastern line of Fort Street and said eastern Right-of-Way
line to the PLACE OF BEGINNING.
