HomeMy WebLinkAbout1989-OR-72 ORDINANCE NO. 89-OR- ~ ORDINANCE REGARDING THE REMOVAL OF WEEDS, UNKEMPT GRASS, AND RANK VEGETATION IN THE CITY OF JEFFERSONVILLE, INDIANA WHEREAS, it has been difficult at times to have all property owners in the City of jeffersonville keep their yards and lots in good condition; and WHEREAS, the Common Council of the City of jeffersonville finds the condition of overgrown weeds and rank vegetation to be a public health hazard; and WHEREAS, the Indiana Legislature has provided an alternate procedure for the City to require all property owners to cut and remove weeds or other rank vegetation on property, by virtue of Indiana Code 36-7-10-3 as adopted in 1989. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of jeffersonville, that the Building commission of said City shall be entitled to certify to the jeffersonville Clerk-Treasurer that any lot within the City that is encumbered with excessively high or overgrown weeds and other rank vegetation, specifically including, but not limited to, grass which is in excess of eight inches (8") in height, whereupon the Clerk-Treasurer of the City of jeffersonville is directed to send by certified mail, a five (5) day written notice to remove the vegetation to the landowner of said lot at the landowner's last known address as revealed by the tax duplicate records of the Clark County Auditor. If the landowner fails to remove the vegetation within the time prescribed, the Building Commissioner of the City of jeffersonville is hereby directed to cause such vegetation to be removed, whereupon the jeffersonville/~lerk_Treasurer is further directed to prepare a certified statement of the actual costs incurred by the City for such removal. This certified statement of costs shall be delivered to the owner of the property by certified mail at his last known amount to within ten event address, and the owner of said lot shall pay the the office of the Jeffersonville Clerk-Treasurer (10) days after receiving the statement, in the that the landowner fails to pay the amount within said period of time, a certified copy of the payment of cost shall be filed with the office of the clark county Auditor whereupon the Auditor shall place the amount claimed on the tax duplicate against the property affected by such work, and the amount shall thereafter be collected and disbursed to the general fund of the City of jeffersonville in the usual and customary jeffersonville, Clark manner. This ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor..
