AN ORDINANCE AMENDING ORDINANCE NO. 89-OR-58 PURPORTEDLY
VACATING A PORTION OF PEACELY STREET IN
THE CITY OF JEFFERSONVILLE, INDIANA
WHEREAS, Wyandot,
requesting a vacation
city of Jeffersonville,
by the Common Council
Inc. has previously filed a petition
of a portion of Peacely .Street in the
Indiana, which petition was acted upon
of the City of Jeffersonville after
proper notice at its regular meeting on September 16, 1989, and
was adopted pursuant to Ordinance No. 89-OR-58; and
WHEREAS, the Clark County Surveyor has advised the Common
Council of the City of Jeffersonville that the legal
description of the vacated public way is more expansive than
necessary; and
WHEREAS, that portion of Peaceley Street which needed to
be vacated was contained fully within the
advertised and contained within Ordinance No.

THEREFORE, BE IT ORDAINED by the Common Council of
Jeffersonville that it hereby amends Ordinance
to reflect that portion of unvacated Peaceley and
Green Streets contained within the original legal description
of Ordinance No. 89-OR-58 in order to vacate only that portion
which was subject' to the existing right-of-way in order to
clarify the records of Clark County, Indiana.
BE IT FURTHER ORDAINED that the proper legal description
of the vacation of Ordinance No. 89-OR-58 is as follows:
Being a part of Peacely Street in what was formerly the Town of
Claysburg, as shown in Plat Book 4, Page 62, of the Clark County, Indiana
Records, now in the City of Jeffersonville and being further described as
follows:
Beginning at the northeast corner of Lot #25 in Block 8 as shown in said
Plat Book and Page; Thence N.85°53'Ig"w., (basis of bearings) along the south
Right-of-Way llne of said street, 174.73 feet (Record 200 feet) to the
northwest corner of said lot; Thence N.6°IO'51"E.,40.02 feet to the north
Right-of-Way line of said street; Thence S.85°53'19"E., along said north
Right-of-Way line, 173.68 feet to the northwest corner of the previously
vacated protion of said street as recorded in Deed Drawer 15, Instrument 11344
of said county records; Thence S.4°40'30"W., along the west line of said
vacated portion, 40.00 feet to THE TRUE PLACE OF BEGINNING.
Containing 6967 square feet, more or less.

timely passage, promulgation and approval by the Mayor.
