SUBDIVISION IN JEFFERSO~ILLE,
WHEREAS, Elk Pointe Developers, Inc., has filed a petition
requesting the jeffersonville common Council to vacate an easement
between Lots Eighteen (18) and Nineteen (19) of the Elk Pointe
Subdivision, located in jeffersonville, Indiana;
WHEREAS, the Common Council has caused a public hearing to be
set for ~.~ ~.- , 1989, at 7~ ~.m., in Room
of the Council Chambers, and the Clerk-Treasurer has
caused notice of that hearing to be published in ~he Evening News
and Clark County Journal; and
WHEREAS, the Common Council on O~' ~'-- , 1989, at

and has determined that neither the public nor the city
harmed by the vacation of the easement more particularly
hereinafter, provided that said vacation is subject to
all utilities of record.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
city of Jeffersonville, Indiana, that:
1. The following described easement be, and the same hereby
is, vacated subject to the rights of all utility easements of
record to maintain the service of said utilities:
A part of Lots Eighteen (18) and Nineteen (19), Elk
Pointe subdivision as recorded in Plat Book 9, Page 64,
Clark County, Indiana, City of jeffersonville, described
as follows:
Beginning at the north corner of Lot No. Eighteen (18),
thence South 54° 42' 14" West 20 feet along the line
between Lots Eighteen (18) and Nineteen (19) to the TRUE
PLACE OF BEGINNING,
Thence South 35° 17' 46" East 10 feet, thence South 54°
42' 14" West 70 feet, thence North 35° 17' 46" West 20
feet, thence North 54° 42' 14" East 70 feet, thence
South 35° 17' 46" East 10 feet to THE TRUE PLACE OF
BEGINNING.
2. This Ordinance shall be in full force and effect upon its
timely passage, promulgation and approval by the Common Council.
