AN ORDINANCE ESTABLISHING A cITY PROJECTS FUND
WHEREAS, the City of jeffersonville has recovered certain
monies for existing disputes with the County of Clark regarding
the assignment of various spaces within the City-county
Building; and
WHEREAS, the Clerk-Treasurer of the City of jeffersonville
as well as the City Attorney have engaged in various
correspondence with the Indiana State Board of Accounts and
Indiana State Board of Tax Commissioners regarding the
appropriate receipt and dispersal of said funds; and
WHEREAS, the State Board of Accounts has determined that
$270,000.00 should be receipted into the Building Rental Fund
and that the remaining $300,000.00 which was received in
settlement for the ongoing dispute with the county of Clark may
be receipted and disbursed based upon the opinion of counsel
rendered by the City Attorney; and
WHEREAS, the Clerk-Treasurer of the city of jeffersonville
has reported that a legal opinion has been rendered by the City
Attorney whereby said funds can be receipted into a special
non-reverting fund established by ordinance of the Common
council for use in City-related projects which would relate to
the betterment of the City of jeffersonville.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of jeffersonville:
1. That $270,000.00 of
the money received from the
Building Authority shall be receipted into the
Building Rental Fund pursuant to the instructions of
the State Board of Accounts.
That it hereby establishes a City Projects Fund to be
administered by the office of the Clerk-Treasurer,
which fund shall be non-reverting, and the monies
deposited in such fund shall be used solely for
projects which are deemed by the Common Council to be
in the best interests of the City of jeffersonville.
That the remainder of funds received from the
Building Authority in the approximate amount of
$300,000.00 plus all accrued interest thereon shall
be deposited into the City Projects Fund as soon as
is practicable upon passage and enactment of this
ordinance.
