RESOLUTION DESIGNATING THE COI'R~ON COUNCIL'S PURCHASING CERTAIN REAL PROPERTY INTEREST IN WHEREAS, the Common Council of the City of jeffersonville is aware that the jeffersonville Board of Public Works and Safety has for some time been studying options to relocate the existing jeffersonville Wastewater Treatment Plant to an alternate location within the City and is soliciting the aid of the Indiana Department of Environmental Management with regards to receiving a portion of the remaining grant funding thro'ugh that agency; and, WHEREAS, the Common Council has been adequately advised that such grant application must be submitted on or before July 15, 1990, and that as a part of that grant application the City must and, demonstrate its ability to control the subject property; WHEREAS, the fiscal body of a interest in purchasing such purchase. Indiana Code 36-1-10.5-5 requires a resolution of political subdivision indicating its specified land or structures prior to NOW, THEREFORE, BE the city of interest in property: IT RESOLVED by the Common Council of Jeffersonville that it hereby indicates its making a purchase of the following described real A part of Block No. 114 in the City of 3effer.sonvilte, being a part of the same lot conveyed to Joseph H. Conner at Deed Record 159, Page 28l and bounded as follows: Being all of Block Ho. IL4 in the City of= 3sffersonville, also one half of that part of Illinois RvenUe ad.Jacant to said property when vacated:. Excepting therefrom a 40 foot by 120 foot lot conveyed BE IT FURTHER RESOLVED that: Pursuant to the provisions of Indiana Code 36-1-10.5-3, the jeffersonville Board of Public Works shall serve as the ,'purchasing agent" for these purposes, said board being the board of the City of jeffersonville, Indiana, with the power to purchase land or structures for the benefit of the jeffersonville sewage utility. The Jeffersonville Board of Public Works has previously caused the above-described property to be appraised by Baird Realty Consultants and Carl M. Leffert, SRA, which firms qualify under the provisions of Indiana Code 25-34.1 as appraisers and licensed real estate brokers, and the Common Council hereby acknowledges that copies of said appraisals have been filed with the Clerk-Treasurer of the City of Jeffersonville as of the date of this resolution. Said appraisals shall be kept on file for a minimum period of five (5) years by the Clerk-Treasurer of the City of Jeffersonville, Indiana. The Common Council of the City of Jeffersonville, Indiana, therefore concludes that the relocation of the Jeffersonville Wastewater Treatment Plant is a positive step for the economic development and well-being of this community, and therefore indicates its interest and approves the Jeffersonville Board of Public Works and Safety purchase of said property pursuant to the provisions of Indiana Code 36-1-10.5 et seq.
