HomeMy WebLinkAbout1990-R-12 RESOLUTION NO. 90-R-12 CONFIRMING RESOLUTION DECLARING AN AREA TO BE AN ECONOMIC REVITALIZATION AREA 6-1.1-12.1 et seq.; WHEREAS, this the Clark County been published in forth April WHEREAS, the Common Council of the City of jeffersonville has previously adopted Resolution No. 90-R-10 at its regular meeting on March 19, 1990, wherein it designated the property more specifically described in Exhibit "A" attached hereto as an Economic Revitalization Area under the provisions of I.C. and resolution has been filed in the office of Assessor and notice of this resolution has accordance with Indiana code 5-3-1 setting that a public hearing on this matter shall be s~t for 21, 1990, at the Common Council regular meeting prior to action modifying, confirming, or rescinding the final declaratory resolution of the Council; and WHEREAS, said public Co~non Council's regular remonstrators who believe designating action opportunity to be hearing was held this date at the meeting and all persons and that they were aggrieved by the of the Common Council were given an heard in conformity with governing Indiana law. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of jeffersonville as follows: 1. That it hereby confirms the designation of the area more specifically described in Exhibit "A" attached hereto and previously described in Resolution No. 90-R-10 adopted by the Common Council, as an Economic Revitalization Area with all the benefits pertaining thereto being available under governing Indiana law. The Common Council will hereafter entertain all petitions and Statement of Benefits seeking application for real and personal property tax deductions properly allowable under existing Indiana law, except as in conditioned in paragraph 2 below. 2. The common Council recognizes, however, that the area designated herein as an Economic Revitalization Area is also located in an allocation area as defined in I.C. 36-7-14-39, and no application for property tax deductions, as provided by I.C. 6-1.1-12.1 et seq., may be approved unless the jeffersonville Redevelopment commission, as the commission which designated the allocation area, adopts a resolution approving the application. OREM An area beginning at the intersection of Tenth Street and Walnut Street, running north on Walnut Street to Twelfth Street, then running east on Twelfth Street to Pennsylvania Avenue, then running north on Pennsylvania Avenue to the northern boundary of certain real property owned by LARoche, Industries, Inc., then running east to Dutch Lane, then running south on Dutch Lane to Tenth Street, and running west on Tenth Street to its point of beginning. This area is further identified by the map which is attached hereto as Exhibit A. This area is hereby designated as an "Economic Development Target Area," and henceforth qualifies for the rights and benefits bestowed under Indiana law by virtue of such designation. This Ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor.
