HomeMy WebLinkAbout2024-01 Resolution Related to the Amendment of Rules & Procedures, Rule 6STATE OF INDIANA BEFORE THE CITY OF JEFFERSONVILLE POLICE MERIT COMMISSION RESOLUTION NO.2024-01 A RESOLUTION OF THE CITY OF JEFFERSONVILLE POLICE MERIT COMMISSION RELATED TO THE AMENDMENT OF RULES AND PROCEDURES, RULE 6 WHEREAS,pursuant to Ind. Code § 36-4-6-2,the City of Jeffersonville Common Council hereinafter the "Council"), is the legislative body of Jeffersonville City government; and, WHEREAS, pursuant to Ind. Code § 36-8-2-2, the City of Jeffersonville has established, maintains, and operates a police and law enforcement system to preserve public peace and order and provides facilities and equipment for that system (hereinafter, collectively referred to as the Department"); and, WHEREAS,pursuant to Ind.Code§36-8-3.5-3,the Council adopted Resolution No.2008- R-30 (as amended by Resolution No. 2009-R-17, as amended Ordinance No. 2011-OR-44, An Ordinance Reaffirming the Authority of the City ofJeffersonville Police Merit Commission); and, WHEREAS,the Commission has,pursuant to the above-referenced authority,adopted and approved the City ofJeffersonville Police Merit Commission Rules and Procedures(the "Rules"); and, WHEREAS, the Rules and the enabling statutes (Ind. Code § 36-8-3.5-13) provide the Commission authority to set standards and procedures for Promotion of the Members of the Department, in the Commission Rules, which standards and procedures have been previously adopted by the Commission; and, WHEREAS,the Rules further provide an amendment process,for the purpose of amending the Rules as deemed appropriate by the Commission, and, from time to time,the Commission has amended the Rules pursuant to the Commission's authority to do so under the Rules and the enabling statutes; and, WHEREAS, the Department and the Commission have reviewed certain aspects of the promotion process, and determined that, due to changes within the Department, Rule and Procedure 6,entitled"Promotion Examinations"requires updating by way of an amendment to the Rules related to the Promotion Examination Eligibility contained in paragraph, II (A)(1) & (2); and, WHEREAS, Rule and Procedure 6(A)(1) & (2) currently provides as follows: II. PROMOTION EXAMINATIONS A. PROMOTION EXAMINATION ELIGIBILITY 1. Officers will be eligible to take the promotion examinations for specific ranks as follows: Completed Years of Service Rank Examination and/or Specific Rank Held Eligibility Five (5)years in Department Corporal Eight(8) years in Department Sergeant Ten(10)years in Department Lieutenant Twelve (12)years in Department Captain Officers must have served five (5) years in present Department and two (2) years in the present rank before testing for promotion. An officer joining the Department as a lateral transfer from another Department will be hired at the Patrolman rank. 2. An officer under suspension and/or pending hearing, or under appeal from a hearing, may attend any promotion school and take any promotion examination. WHEREAS,the Commission and the Department have reviewed said language,and desire to replace the said language so that Rule and Procedure 6(A)(1) & (2) shall hereafter read as follows: H. PROMOTION EXAMINATION ELIGIBILITY 1. Officers will be eligible to participate in the promotional process for the rank of Corporal if they have Five (5) years of full-time certified law enforcement experience. Lateral hires will be eligible to participate in the promotional process with a minimum of four(4) years with the Jeffersonville Police Department so long as they became hired by the Jeffersonville Police Department already having completed at least two (2) years of full-time certified law enforcement experience. After attaining the rank of Corporal, officers are eligible to test for promotion to the next rank after completing two (2)years in their present rank. If an officer would be eligible to promote within three hundred sixty-four 364) days of the written exam,that officer will be permitted to participate in the promotional process. An officer who has successfully passed a promotional process and has been ranked on a certified list shall be ineligible for promotion until they have met the time in rank requirements hereinabove. When making promotions, upon request,the Commission shall provide the next three eligible candidates from the certified list that have satisfied the time in rank requirements set forth hereinabove. An officer joining the Department as a lateral transfer from another Department will be hired at the Patrolman rank. 2. An officer under suspension and/or pending hearing, or under appeal from a hearing, thay attend any promotion school and take any promotion examination. NOW THEREFORE, THE CITY OF JEFFERSONIVLLE POLICE MERIT COMMISSION RULES AND PROCEDURES, RULE 6(II)(A)(1) & (2), IS HEREBY AMENDED AND REPLACED BY THE LANGUAGE SET FORTH IN RED, HEREINBELOW, in the following respects, to wit: H. PROMOTION EXAMINATION ELIGIBILITY 1. Officers will be eligible to participate in the promotional process for the rank of Corporal if they have Five (5)years of full-time certified law enforcement experience.
