CALL TO ORDER: Mayor Mike Moore called the meeting to order at 9:30 a.m. in the Mayor's
Conference Room in City Hall. The meeting was held in person and streamed on the City's Website.
Andy Crouch and Rob Waiz served on the board.
APPROVAL OF THE MINUTES: Mr. Crouch made the motion to approve the minutes from December 27,
2023. Mr. Waiz seconded the motion; roll call vote: Mr. Crouch—aye, Mr. Waiz—aye; Mayor Moore—
aye; motion passed, 3-0.
APPROVAL OF PAYROLL: Mr. Waiz made the motion to approve the payroll. Mr. Crouch seconded the
motion; roll call vote: Mr. Crouch —aye, Mr. Waiz—aye; Mayor Moore—aye; motion passed, 3-0.
OLD BUSINESS:
NEW BUSINESS:
1. Larry Wallace-Hearing regarding 811 Watt Street, home owner,Jamie Charles Burton and Iris
A. Boyd on review of compliance with Building Commissioner enforcement -
Mr. Burton appeared before the board for the hearing to review the compliance with Building
Commissioner enforcement at 811 Watt Street. Mr. Wallace confirmed his position with the City
of Jeffersonville was the Building Commissioner and his office has had a case regarding this
property starting from October 8, 2021. Mr. Wallace had inspected the property and confirmed
due to the condition of the structure and the roof caving in this was an unsafe structure, a fire
hazard to neighboring properties, a hazard of public health and a danger to the community.
Mr. Merkley provided photos taken of the structure as recently as the previous week to the
board and advised for the record notice of this hearing was published in the News and Tribune.
A total of six letters were sent to the property owner since October 7, 2021 and Mr. Merkley
confirmed with Mr. Burton he was the legal property owner of 811 Watt Street. Mr. Burton
advised his stepfather recently passed away and he would now legally be able to sell the
property or renovate it. Mr. Wallace advised his recommendation was to deem the structure as
unsafe and move forward with tearing down the structure. Mayor Moore confirmed with Mr.
Wallace if a child or somebody were to enter that building on that day if they would be at risk
and advised he did not like the idea of providing additional time and asked Mr. Merkley if they
were within their right to move forward with demolition. Mr. Merkley stated by statute the
structure cannot be removed for at least ten (10) days from today's hearing.
Mr. Waiz made a motion that the home owner had ten (10) days to secure the building with
plywood so that no person or child would be able to get in, secure the roof so it is not a
nuisance and falling down adding to specify plywood needed to be placed anywhere where
people could get into the structure, the roof needed to be shored up in any sagging areas; if it is
not completed within the ten (10) days the City will have the structure torn down. If the work
was completed to satisfaction of the Building Commissioner within ten (10) days the property
would need to be sold or renovated within two months. Mr. Crouch seconded the motion; roll
call vote: Mr. Crouch—aye, Mr. Waiz—aye; Mayor Moore—aye; motion passed, 3-0.
Mr. Burton acknowledged that he was aware he had ten (10) days to for the Building
Commissioner to confirm the requirements were met before the City would move forward with
demolishing the structure.
2. Christy O'Neil-Request for approval of handicap parking sign at 919 Walnut Street
(Junior Mondie)— Mrs. O'Neil advised Junior Mondie came in and requested a handicap parking
sign at 919 Walnut Street. JPD has looked at the location and are okay with the placement at
the location.
Mr. Waiz made a motion to approve the request and Mr. Crouch seconded the motion; roll call
vote: Mr. Crouch—aye, Mr. Waiz—aye; Mayor Moore—aye; motion passed, 3-0.
3. Les Merkley-Request for approval of Resolution Designating Police Mobile Command Center
as Special Purchase—Mr. Merkley advised last year the City Council gave the approval for the
funding to purchase a Police Mobile Command Unit. This is a complex purchase with unique,
made to order specs that JPD has put together. This will be purchased from MacQueen
Equipment, LLC. This Resolution approves the purchase for the amount of right over 1.2 million
dollars and would designate this as a Special Purchase pursuant to Indiana Law under 5-22-10.
Assistant Chief McVoy advised the intended date for delivery is 22 months from the approval of
the intent to purchase. They will be able to take this to surrounding communities during times
of crisis to assist.
Mr. Crouch made a motion to adopt 2024-R-1 and Mr. Waiz seconded the motion; roll call vote:
Mr. Crouch—aye, Mr. Waiz—aye; Mayor Moore—aye; motion passed, 3-0.
4. Len Ashack-Request for approval of road closure on Oaklawn Drive from 7:00 am on January
8, 2024 to 5:00 pm on January 9th, 2024—Mr. Ashack advised they need to fix an issue in front
of 1122 Oaklawn Drive and will need to close the road to do so starting on Monday,January 8 at
7 am and they hope to be finished by Tuesday,January 9 at 5:00 pm. The road will be open and
a detour will be in place.
Mr. Crouch made a motion to approve the closure and Mr. Waiz seconded the motion; roll call
vote: Mr. Crouch—aye, Mr. Waiz—aye; Mayor Moore—aye; motion passed, 3-0.

CITY OF JEFFERSONVILLE, INDIANA
IN RE THE PROPERTY LOCATED AT:
811 WATT STREET,
ALLEGED TO BE AN UNSAFE BUILDING
JAMIE CHARLES BURTON (PROPERTY OWNER)
FINDINGS OF FACT
AND ORDER
WHEREAS, on December 6, 2023 the Jeffersonville Building Commissioner
("the Enforcement Authority") citied above property owner for violation of I.C. 36-7-9-2
and Ordinance No. 2010-OR-30; and
WHEREAS, the property owner was ordered to repair, rehabilitate or remove the
portion of the unsafe building to bring it into compliance with standards for building
conditions or maintenance required for human habitation or occupancy; and
WHEREAS, a Notice of the Order was sent by certified mail to the following
persons with a substantial property interest in the subject premises:
811 WATT STREET, JEFFERSONVILLE, INDIANA
WHEREAS, service on property owner was unsuccessful; and
WHEREAS, notice was published in the The News and Tribune publication
advising that a hearing would take place in reference to the property to review the order
to determine building code compliance; and
WHEREAS, said notice also invited the property owner or any interested party to
appear at the hearing to present evidence and/or testimony in reference to the violation;
and
WHEREAS, a hearing was scheduled upon the Order on January 3, 2024; and
WHEREAS, the owner, Jamie Charles Burton, appeared in person at the hearing
before the Board of Public Works and Safety ("the hearing authority") to present
evidence or arguments; and
WHEREAS, the Enforcement Authority testified at the hearing that the structure
is unsafe because it has not been maintained for many years, is dilapidated and has
deteriorated to the point that demolition of the structure is required; and
WHEREAS, the Building Commissioner testified that the structure is unsafe and
a fire hazard to the neighboring structure; and
WHEREAS, the hearing authority adopts the testimony given at the hearing as
its Findings and further incorporates the minutes of the meeting including said exhibits
introduced.
NOW THEREFORE, it is hereby ORDERED that the structure, specifically the
structure located at 811 Watt Street, Jeffersonville, Indiana is an unsafe building and
shall be demolished at the direction of the Enforcement Authority in not less than ten
(10) days from the date of this Order unless the owner immediately takes corrective
action to ensure the structure is safe and secure.
IT IS FURTHER ORDERED that during those ten (10) days the owner shall
secure the structure and roof with plywood sufficient to prevent the public from entering
the structure.
IS IT FURTHER ORDERED the demolition order shall be stayed for 60 (sixty)
days in the event the Building Commissioner and/or his designee determines that the
owner has sufficiently and adequately secured the structure with plywood.
IT IS FURTHER ORDERED that during those aforementioned sixty (60) days the
owner shall either sell the structure or renovate the structure as to make it habitable for
human occupancy.
IT IS FURTHER ORDERED that the owner shall appear before the hearing
authority on March 13, 2024 at 9:30 a.m. to advise as to the status of the structure in
the event the order is stayed.
