COUNTY ANINMAL SHELTER AND ORDINANCE NO. 1996-OR-98,AN
ORDINANCE DESIGINATING FUNDS FOR THE JEFFERSONVILLE-CLARK
COUNTY ANIMAL SHELTER BUILDING AND CAPIAL IMPROVEMENT NON-
REVERTING FUND
WHEREAS, the Common Council of the City of Jeffersonville ("Council") has
previously adopted Ordinance No. 1996-OR-14, "An Ordinance Establishing a Non-Reverting
Fund for the Jeffersonville-Clark County Animal Shelter"; and
WHEREAS, the Council has previously adopted Ordinance No. 1996-OR-98, "An
Ordinance Designating Funds for the Jeffersonville-Clark County Animal Shelter Building and
Capital Improvement Non-Reverting Fund," and
WHEREAS, the Council has determined that both ordinances should be repealed in that
they are outdated and no longer applicable; and
NOW THEREFORE BE IT RESOLVED by the Common Council of the City of
Jeffersonville that Ordinance No. 1996-OR-14 and Ordinance No. 1996-OR-98 are hereby
repealed.
This Ordinance (2023-OR-66- ) shall be in full force and effect from and after its
passage by Common Council and approval by the Mayor.

ORDINANCE NO. qt 6-47/44_
ORDINANCE ESTABLISHING A NON-REVERTING FUND
FOR THE JEFFLRSONVILLE-CLARK COUNTY
ANIMAL SHELTER
WHEREAS;pursuant to an Interlocal Cooperation Agreement for the Joint Use and
Operation of the Jeffersonville-Clark County Animal Shelter, which Agreement is dated
November 4, 1991, the City of Jeffersonville accepted the sole duty to establish and
maintain a budget for the Animal Shelter, to staff the Animal Shelter, and to perform all
other management functions for the Animal Shelter; and
WHEREAS, various individuals at times wish to make donations to the Animal
Shelter; and
WHEREAS, the City needs to make capital improvements to the Animal Shelter
and may need in the future to build a new facility.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana that it hereby establishes a non-reverting fund for the purposes of
receiving funds donated to the Jeffersonville-Clark County Animal Shelter and for using
those monies to build a new facility and/or make capital improvements to the existing, or
any new facility used by the Animal Shelter. This fund shall be entitled the
"Jeffersonville-Clark County Animal Shelter Building and Capital Improvement Non-
Reverting Fund" and monies shall be extended from this fund only upon the filing of a
proper claim in issuance of a warrant for payment by the Clerk-Treasurer after approval
by the Common Council of the City of Jeffersonville. This fund shall be a non-reverting
fund and all monies received as revenues from donations to the Jeffersonville-Clark
County Animal Shelter shall hereafter not be required to be received into the general fund
of the City.
This ordinance shall be in full force and effect upon its timely passage,
promogation and approval by the Mayor.

AN ORDINANCE DESIGNATING FUNDS FOR THE

FUND
WHEREAS, on the / day of /4)At H , 1996 the Common Council
of the City of Jeffersonville (hereinafter "the Council") established the Jeffersonville-
Clark County Animal Shelter Building And Capital Improvement Non-Reverting Fund to
receive donations for building a new animal shelter; and
WHEREAS, on the I6 L day of npgiii_ , 1996 the City of
Jeffersonville (hereinafter "the City") entered into a lease with Sprint Spectrum for a
portion of the land on the existing animal shelter property; and
WHEREAS, it is imperative that a new animal shelter be constructed as soon as
possible; and
WHEREAS, the Council wishes to save the taxpayer of the City the expense of
constructing a new animal shelter; and
WHEREAS, the Sprint Spectrum lease has produced non-tax income for the City
and will continue to do so; and
WHEREAS, the Council believes that the Sprint Spectrum lease income would
be most productively used to fund the purchase of land and the building of a new animal
shelter;
NOW THEREFORE, BE IT HEREBY ORDAINED that the Clerk/Treasurer is
hereby directed to credit all the proceeds of the Sprint Spectrum lease, including
proceeds already received, to the Jeffersonville-Clark County Animal Shelter Building
And Capital Improvement Non-Reverting Fund.
This Ordinance shall be in full force and effect from and after its passage and
approval.
