HomeMy WebLinkAbout05-19-2003April 19, 2003 1 - COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA May 19, 2003 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30 P.M. on May 19, 2003. Mayor Tom Galligan, with Deputy Clerk Barbara Hollis at the desk, called the meeting to order. Also present was City Attorney Anne Marie Galligan. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Ron Grooms gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Les Merkley, Ron Ellis, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin, Absent: Councilperson Denny Frantz. Mayor Gatligan announced the Council's appointment to the Sanitary Sewer Board is up at the end of this month suggesting discussion of this appointment be added to the agenda. Councilperson Grooms made the motion to add discussion of Sanitary Sewer Board appointment be added to the agenda, second by Councilperson Conlin, passing unanimously. Councilperson Conlin then made the motion to approve the agenda as amended, seconded by Council President Waiz, passing unanimously. Mayor Galligan presented the minutes of the meetings of April 7, 2003 and April 21, 2003 for consideration of the Council. Council President Waiz made the motion to approve the minutes of the April 7, 2003 meeting as presented, second by Councilperson Wilson passing unanimously. Councilperson Wilson then made the motion to approve the minutes of the April 21, 2003 meeting as presented, seconded by Councilperson Conlin, passing unanimously. Councilperson Denny Frantz arrived at the meeting. Deputy Clerk Barbara Hollis presented the claim list for consideration by the Council, asking that the claim for the Flint Group be tabled and a claim For Jeff Fest be added.. Council Pregident Waiz made the motion to approve the claims adding the claim for JeffFest and tabling the claim for the Flint Group, seconded by Councilperson Conlin. Conncilperson Ellis April 19, 2003 2 questioned a claim for gr~s cutting on Mockingbird. Deputy Hollis explained it was for more than one address. The motion to pass the claims as amended passed unanimously. PUBLIC COMMENT: Mr. Leon Saphara, a resident of 338 Ohio appeared before the Council with concerns of several areas hq the First District that the grass has not be cut. He suggested those in jail cut the areas that need attention. He is also concern with the entrance to the City with the homeless sleeping under the overpass. Mr. Saphara also is concerned with the sewers on Court Avenue being clogged. The gutters need to be cleaned. Mayor Galligan explained some of the areas that have not been cut are State property that have not been cared for due to the construction on I65 and all the min. Mayor Galligan said the City cleans the streets and people throw out trash. The City has no control of the jail, however he will talk to the Sheriff. Mr. Dave Forsee appeared before the Council to express his concern for the vacated CSX tracks behind the homes on Sportsman Drive. He explained all types of vehicles have been using the vacated area, suggesting barriers may be the answer for the larger vehicles. Attorney Galligan explained CSX owns the property and they have not been easy to negotiate with to buy the property. Councilperson Grooms asked if the City could pass an Ordinance prohibiting vehicles on the property. Attorney Galligfin explained it is private property and the City cannot enforce Ordinances on private property. Mayor Galligan noted the City is not able to block access before CSX completes the removal of the hacks. Mr. Ron Glass appeared before the Council to ask for help in controlling the speeding through Northaven subdivision. He suggests speed deterrents like those at the Aquatic Center be installed. Mayor Galligan acknowledged the problem saying he is looking into raising the pavement in areas. Counailperson Conlin said the speeding is bad again on Utica Pike. Many drivers pass on the narrow road. AGENDA ITEMS: Attorney Galligan presented and explained Ordinance No. 2003-OR-19, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No. 4 Of The Illinois Grant From RI: Low Density Residential To Is: Institutional. Attorney Galligan noted this request has been recommended by the Plan Commission. She explained the April 19, 2003 intended use. Councilper~on Conlin made the motion to pass Ordinance No. 2003-OR-19, second by Council President Waiz,~ passing unanimously. Attorney Galligan next presented and explained Ordinance No. 2003-OR-20, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No. 37 Of The Illinois Grant From C2: Medium To Large General Commercial to CI: Small To Medium Scale General Commercial. This has been recommended by the Plan Commission. There was discussion of the area with differing optmons. Councilperson Ellis said he bas requested numerous times that a map be included with all request for rezoning. Councilperson Ellis made the motion to table Ordinance No. 2003-OR-20 until a map is included, seconded by Councilperson Conlin, passing on a vote of 6-1-. Councilperson Grooms voted against the motion. Mayor Galligan asked if the Council has questions such as this they should notify his office Prior to the meeting. Council President Waiz asked for comments regarding the Sanitary Sewer Board appointment. Councilperson Ellis noted the need for a workshop. Mayor Galligan said the Cotincil has a half vote for the Engineer and he has no problem with reappointing Jack Jordan. Attorney G~.alligan said Jeffrey Caldwell does not meet appointment requirements. Following further discussion, Councilperson Merkley made the motion to have a workshop regarding the Sanitary Sewer Board appointments, second by Councilperson Grooms, passing unanimously. COUNCIL AND MAYOR COMMENTS: Councilperson Wilson said she attended a function at the Howard steamboat Museum this past Saturday and Sunday and was concerned for the paint spray coming from Jeff Boat. Councilperson Conlin explained they are spraying on weekends so that citizens can't get any enforcement. Discussion followed. Councilperson Wilson received a call from a resident on Jonquil Drive regarding the yard next door. Mayor Galligan explained the process needed to get anything done. Councilperson Grooms told of the Drainage meeting to be held on May 22 at Walnut Ridge Baptist Church asking all to attend. Councilperson Grooms asked if the City could do any enforcement if there was speeding and disturbance on the CSX property. Mayor Galligan said until CSX gets everything off the property the City can't put up no trespassing signs. Councilperson Conlin asked about the danger of the ties. Attorney Galligan said the City may be able to cite CSX for open storage. She will be looking at the legislation. April 19, 2003 4 Council President Waiz set the workshoP for Thursday, May 29, 2003 at 6:00 P.M. in the Mayor's Conference Room.
