HomeMy WebLinkAboutJune 5, 2023 City Council COMMON COUNCIL OF THE CITY JEFFERSONVILLE, INDIANA June 5, 2023 Regular Meeting Minutes The Common Council of the City of Jeffersonville, Indiana met for the Regular Meeting on June 5, 2023. Council President Owen along with City Clerk Gill called the meeting to order at 7:00 p.m. The meeting was open to the public in person as well as live streamed via the City Website using Zoom. INVOCATION: Councilperson Ellis led the Invocation. PLEDGE OF ALLEGIANCE: ROLL CALL: The roll call was conducted by City Clerk Lisa Gill and present in Council Chambers were Councilperson White, Councilperson Burns, Councilperson Paris, Councilperson Croft, Councilperson Webb, Council President Owen, and Councilperson Ellis. Let the record reflect 7 Council Members were present in Council Chambers. Councilperson Anderson and Council Vice President Hawkins were absent. APROVAL OF MINUTES: Councilperson Burns made a motion to approve the Minutes of May 15, 2023 of the Regular Meeting, seconded by Councilperson Croft; motion passed, 7-0. APPROVAL OF THE AGENDA: Councilperson Burns made a motion to approve the Agenda, seconded by Councilperson Paris; motion passed, 7-0. CLAIMS TO APPROVE: Civil City$2,919,738.51 Mrs. Metcalf advised there were no changes. Council President Owen reminded the Council that he sent an email regarding the balance owed for Jeff Goes Country and how he had it taken care of. Councilperson Burns made a motion to approve the Civil City Claims, seconded by Councilperson Croft; motion passed, 6-1. Councilperson Ellis voted no. Parks$285,112.24 Mrs. Metcalf advised there were no changes. Councilperson Burns made a motion to approve the Parks Claims, seconded by Councilperson Paris, motion passed, 7-0. REPORT OF THE CLERK: Clerk Gill stated she had no comment. UNFINISHED BUSINESS: 1. Kim Calabro 2023-OR-29 Ordinance Amending 2023-OR-13 &an Ordinance Fixing the Salaries of Appointed Officers& Employees for All Departments of Jeffersonville (Salary Ordinance) Mrs. Calabro advised there were no changes other than the Amendment to Section II N. Jeffersonville City Attorney, Les Merkley advised he sent an email today to the Council clarifying the Amendment in reference to the retention bonus for the Police Officers. This would be an Amendment to Section II N to add two (2) sentences at the end of Section II N to read as follows: "Any officer eligible for the stipend shall execute a retention payment agreement as a condition to receive the stipend. The retention payment agreement shall require any officer to repay a prorated share of the stipend in the event the officer ceases to be employed by the department during the twelve (12) months after receiving the stipend." Councilperson Burns made a motion to amend 2023-OR-29 as presented, seconded by Councilperson White; motion to amend 2023-OR-29 passed, 7-0. Councilperson White made a motion to approve 2023-OR-29 as amended on the Final Reading, seconded by Councilperson Burns; motion passed, 7-0. 2. Heather Metcalf 2023-OR-30 Ordinance of Additional Appropriation (PUBLIC HEARING) Mrs. Metcalf advised there were no changes, this Additional Appropriation is for the Election cost. Council President Owen opened the Public Hearing at 7:06 pm, Clerk Gill stated there were no comments sent to the Clerk's office.There were no members of the community present to speak for or against the matter. Council President Owen closed the Public Hearing at 7:06 pm. Councilperson Burns made a motion to approve 2023-OR-30 on the Third and Final Reading, seconded by Councilperson Croft; motion passed, 7-0. 3. Heather Metcalf 2023-OR-31 Ordinance of Additional Appropriation (PUBLIC HEARING) Mrs. Metcalf advised there were no changes. Council President Owen opened the Public Hearing at 7:07 pm. Clerk Gill stated there were no comments sent to the Clerk's office. There were no members of the community present to speak for or against the matter. Council President Owen closed the Public Hearing at 7:07pm. Councilperson Burns made a motion to approve 2023-OR-31 on the Third and Final Reading, seconded by Councilperson Paris; motion passed, 7-0. NEW BUSINESS: 1. Chad Reischl 2023-OR-32 Rezoning Hearing on Property Located at 1802 Allison Lane from NS(Institutional Uses)to C1 (Commercial: Medium Scale) Mr. Reischl advised Applicant Dr. Zach Ogden with Louisville Foot & Ankle Specialist is looking to purchase the building at 1802 Allison Lane which is currently zoned as Institutional use. He is a medical office building and is requesting it be re-zoned to C1. Mr. Reischl advised that the staff feels this property was zoned in error in 2001. This re-zone comes with a favorable recommendation from the Plan Commission. Councilperson White asked when it was changed to the in-proper zoning. Mr. Reischl advised as far back as 2001. Council President Owen opened the Public Hearing at 7:10 pm, Clerk Gill stated there were no comments sent to the Clerk's office. There were no members of the community present to speak for or against the matter. Council President Owen closed the Public Hearing at 7:10pm. Councilperson Burns made a motion to approve 2023-OR-32, seconded by Councilperson White; motion passed, 7-0. 2. Chad Reischl 2023-OR-33 Unified Development Ordinance (Non-Commercial Livestock) Mr. Reischl advised at the request of Councilperson Joe Paris, the Plan Commission has authored a text amendment to Article 8.9, the Non-commercial Live Stock section of the UDO. This Amendment would ban roosters from properties within the City of Jeffersonville with the exception to the properties that are zoned agriculture and properties where it can be demonstrated that the roosters can be kept in an enclosure at least 250 feet from any neighboring dwelling unit. Also, they included text to state if there are any existing roosters that does not comply to this particular Ordinance, they shall be registered with the Code Enforcement Department within 90 days of this Ordinance in order to keep its legal nonconforming status. This comes with a favorable recommendation from the Plan Commission. Council President Owen opened the Public Hearing at 7:21 pm. Public comment made by: James R. McClure-1006 Hazelwood Ct., Clarksville, IN 47129 Mr. McClure said laws for no purpose does not make good government. He would hope that neighbors in the community could agree to work something out instead of having laws that prevent someone's ability to perform commerce or any kind of agriculture. Clerk Gill stated there were no comments sent to the Clerk's office. Council President Owen closed the Public Hearing at 7:23 pm. Councilperson Webb made a motion to approve 2023-OR-33 on the First and Only Reading with it being published 3 times in the News and Tribune, seconded by Councilperson Croft; motion failed, 4-3 due to lack of majority of body. Council President Owen, Councilperson Ellis and Councilperson White voted no. 3. Kim Calabro-2023-OR-34 Ordinance Amending 2023-OR-13 & an Ordinance Fixing the Salaries of Appointed Officers& Employees for All Departments of Jeffersonville (Salary Ordinance) Mrs. Calabro advised the only change to this Ordinance is requested by Waste Water Director, Len Ashack and the Jeffersonville Sewer Board is on page 6. Change the WW Inspector from 1 position to 2 and Heavy Equipment Operator positions from 3 to 2 due to the increase of demand. The WW department currently has 2 Heavy Operator positions open. Councilperson White asked if this demand is from new developments. Mr. Ashack advised it is from anyone doing work on the street, their backyards, etc. The Sewer Board has approved this change. Councilperson Burns made a motion to approve 2023-OR-34 on the First and Second Reading, seconded by Councilperson Croft; motion passed, 7-0. 4. Heather Metcalf 2023-OR-35 Ordinance Establishing Departmental Cash Change Fund and Rescinding Ordinance 2022-OR-39 Mrs. Metcalf advised this Ordinance is to establish the Cash Change Fund and also rescinds the prior Ordinance that included petty cash. There are three (3) departments with petty cash that are no longer needed that will be removed from the Ordinance. Councilperson Burns made a motion to approve 2023-OR-35 on the First and Second Reading, seconded by Councilperson White; motion passed, 7-0. 5. Heather Metcalf 2023-OR-36 Ordinance of Additional Appropriation Mrs. Metcalf advised this is Insurance re-imbursement/re-appropriation for the Parks Department on a plumbing claim. Councilperson Burns made a motion to approve 2023-OR-36 on the First and Second Reading, seconded by Councilperson Paris; motion passed, 7-0. 6. Heather Metcalf 2023-OR-37 Ordinance Transferring Certain Funds within the Same Department Mrs. Metcalf advised this is a transfer from Equipment to Repairs & Maintenance for the Parks Department. Councilperson Burns made a motion to approve 2023-OR-37 on the First and Second Reading, seconded by Councilperson White; motion passed, 7-0. ATTORNEY COMMENT: Larry Wilder—No Comment Les Merkley—No Comment DEPARTMENT HEADS: No Comment PUBLIC COMMENTS: James R McClure Jr.-1006 Hazelwood Ct, Clarksville, IN 47129 All lives matter. Mr. McClure asked that all City employees and the City Council of Jeffersonville join in helping Juniper celebrate her birthday by wearing Hawaiian themed attire on June 6, 2023. COUNCIL COMMENTS: • Councilperson White—Habitat for Humanity is building eleven (11) homes on Pratt Street in the Claysburg area, on the property that is owned by the Housing Authority. Would the Council be willing to allow the builders to come and speak and give an idea of what it all in tells and maybe make a financial donation after the Council has met with them. Councilperson Webb asked if there is a dollar amount that they have asked for. Councilperson White advised that they will accept anything, he has a dollar amount in mind. When the company representative comes to speak, it will not be a request at that time, just information as to how things are done. They will be on the agenda for June 20, 2023 meeting. • Councilperson Burns—Congratulations to Heather Metcalf on her 10`h year of employment with the City of Jeffersonville. • Councilperson Paris—No Comment • Councilperson Anderson—Absent • Councilperson Croft—No Comment • Councilperson Webb—Thanks to Heather Metcalf for her years of service. • Council Vice President Hawkins—Absent • Councilperson Ellis—No comment • Council President Owen—Just to clarify, the next Council Meeting will be held on June 20, 2023 at 7:00 pm due to the 19th of June being a holiday. A cookout will be provided by the Clark County Youth Shelter on June 8, 2023 from 11:00 am to 1:00 pm for Safe Place Program. A huge shout out to the Jeffersonville Fire Department for raising$33,000.00 plus to the Crusade for Children. Would like to commend the Fire and Police Departments along with other City Services for the assistance in the emergency at Claysburg Towers on June 3, 2023 that resulted in evacuation and relocation of nearly 90+ residents. CCMA, CCHD, Clark Memorial Health, Owners and Managers of Claysburg Towers came out and supported in a big way. The developers that came here before that was asking for help with the tax credit were the same people who are emailing us over the weekend asking for contacts for some help with the situation. Thanks to everyone involved. He feels that he cannot support the registration of roosters, if the UDO wants to come back before the Council in the future with different guidelines that would be fine. On the corner of Allison Lane and Oak Park, there are three (3) signage poles, two (2) are lit and one (1) is not. The one that is not lit is falling apart and needs to be repaired. A quote was gotten and the City Engineer, Andy Crouch advised that the cost could possibly come from the Engineering budget. Council President Owen suggested that the Council has some Special Project money and in local Income Tax.
