Street, Indianapolis, Indiana 46250. (hereinafter referred to as the "CONSULTANT"). WITNESSETH WHEREAS,.the OWNER desires to contract for the professional services hereinafter described (the "Services"), in relation tohthefollowing described project (the"Project"): Ohio River Greenway Trail Design Jeffersonville, Indiana , WHEREAS,- the CONSULTANT is qualified and prepared to perform the Services required in said work and they agree to perform the Services under the terms and conditions herein set forth; and, WHEREAS, said funds are available for the Services; and; WHEREAS, the OWNER is authorized to enter into this Agreement. NOW, THEREFORE, IT IS MUTUALLY AGREED that the OWNER does hereby employ the CONSULTANT to perform the Services specified herein and agrees to pay for the Services the amounts hereinafter specified; and the CONSULTANT agrees to perform the Services as are herein enumerated. SECTION I. SERVICES BY CONSULTANT The Services to be provided by the CONSULTANT under this Agreement are as set forth in Appendix "A", which is attached to this Agreement and made an integral part hereof. SECTION II. INFORMATION AND SERVICES TO BE FURNISHED BY OWNER.. The information and services to be furnished by the OWNER under this Agreement are as set forth in Appendix"B",which is attached to this Agreement and made an integral part hereof. 1 APPENDIX "A" Services by Consultant The CONSULTANT's understanding of the Project is as follows;; The Project includes the construction of approximately 1,700 feet of 10 feet wide trail extending from 1-65-to the east side of US 31 as outlined in Attachment A-1, which is attached hereto and made an integral part hereof. ::It is assumed:that the trail will be constructed at grade where possible and utilize approximately 935' of poured in place retaining walls in areas where grades require. The alignment will follow the rivers edge for the eastern half of the project and traverse up the river bank son the western half of - the project. The trail will ultimately connect up to the south side of Rive rside Drive west of the Rocky's- restaurant and 'parking lot. A small trail .node is proposed at.the Riverside Drive and trail intersection. No connections of the trail to adjacent businesses . are anticipated. Lighting will be designed to use bollard type fixtures spaced at approximately 30:feet on center.along the trail.: Plan submissions will include Stage1 Plans, Preliminary Plans, Stage 2 Plans, Stage 3 Plans and Final Tracings. The following items shall be considered additional services (if needed or requested) and. cause for a supplemental agreement • Storm water detention or water quality.measures Coordination with the State of Kentucky • Construction access and staging design Elevated trail sections The CONSULTANT shall provide the OWNER with the following Services: 1.. Route Survey 1.1 Perform the fieldwork for supplementing the existing route survey. 1.2 Furnish a determination of all existing right-of—way and apparent property lines. and to show same on plans. 2. Environmental. 2.1' ' Develop and document.a State Environmental Assessment in 'accordance with Indiana's.Environmental.Policy Act (IC 13-12-4): 2.2 Prepare-a Waters of the US Report for the project due to the impacts to wetlands within the project limits. A-1 3. Design 3.1 Make preliminary investigations, design studies leading to the preparation of a preliminary plans, and approximate estimates of cost. : - 3.2 Make final plans to appropriate scale, with geometric computations to be precise for field layout, specifications and estimates of construction.cost. 3.3 Furnish properly referenced horizontal and vertical control points throughout the Project. . 3.4 Furnish a determination of all required right-of-way-and to show same on plans. - 4. Retaininb,Wall,`Design 4.1 Make preliminary investigations, design studies leading to :the preparation of a preliminary retaining wall plans, and approximate estimates of cost: • 4.2 Make final plans to appropriate scale, with geometric computations to be precise ; for field layout, specifications and estimates of construction cost. • -- 5. Landscaping Plans 5.1 Make preliminary investigations and studies leading to the preparation of conceptual landscaping plans and approximate estimates of cost. 5.2 Make final landscaping plans, specifications and estimates of construction.cost. 6. ,Soils Investidation and:Report 6.1 Obtain the borings and substructure explorations, and the analysis thereof, in connection with the Project. 6.2 Borings shall extend sufficiently in depth to obtain characteristic data_ :for the proper design of the Project. 7. :Construction'Bidding Phase 7.1 Furnish the personnel to complete the following tasks; 71.1 Assist the OWNER in bid advertising 7.1.2 Prepare and distribute addenda 7.1.3 Attend the bid opening 7.1.4- Tabulate the bid results and prepare a recommendation letter A-2 8. : General 8.1 Prepare applications and documents to assist the OWNER in obtaining permits from various governmental agencies. It is anticipated that .one (1) 401 Permit, one (1) 404 Permit, one (1) IDNR Construction in a Floodway Permit and one (1) Stormwater General Permit will be required. 8.2 Meet with the OWNER or its representatives, when requested or necessary for consultation or conference as requested by the OWNER. It is anticipated that approximately four (4) client coordination meetings will be required during the duration of the Project. 8.3 Coordinate with subconsultants, prepare monthly progress reports.and provide Next Level Trails Grant reporting support. 8.4. Coordinate- with utilities and prepare utility reimbursement agreements (if necessary) and perform utility coordination services during design. A-3 APPENDIX"B" Information and Services to be Furnished by Owner The OWNER shall furnish the CONSULTANT with the following: 1.. Guarantee access to and make all provisions for the CONSULTANT to enter upon public and private lands as required for the CONSULTANT to perform the Services under the. Agreement. 2. All legal services as may be required for the development of the Project. 3.. Assist the CONSULTANT in obtaining property owner information, deeds, plans of - adjacent developments, section corner information and any other pertinent information necessary to perform the Services under the Agreement. . 4._ Utility plans available to the OWNER covering utility facilities, the location of signals and underground conduits throughout the affected areas. 5. . Plans of existing structures within the Project limits, if.available. 6. Available data from the transportation planning process, including traffic assignments and:projections. 7. Criteria for the design and details for signs, signals, lighting, highways and structures, etc. 8. Specifications and standard drawings applicable to the Project. 9. Designate a representative to act on behalf of the OWNER with respect to the Services to be performed under the Agreement with such person to have complete authority to transmit instructions, receive information, interpret and define OWNER'S policies and decisions pertinent to the Services covered by the Agreement 10., Provide access, at no expense to the CONSULTANT, to OWNER'S officers and/or staff, to all available information pertinent to the Project and the use of such information as appropriate in the accomplishment of the Services. 11:: Obtain approval of all governmental authorities having jurisdiction over the Project and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. B-1 APPENDIX"C" Notice to Proceed and Schedule Unless otherwise directed by the OWNER, the execution of this Agreement shall constitute a notice to proceed with the Services as set forth in Appendix"A". C-1 • APPENDIX"D" Compensation The OWNER,shall compensate the CONSULTANT for the. Services :performed under this: Agreement as follows: 1. Compensate the CONSULTANT for the Services under Appendix "A", Items .1, 2, 3, 4, 5. and- 7, . a lump sum amount in accordance with the .following schedule.: The:. The CONSULTANT is to be compensated monthly. 4. . Compensate the CONSULTANT for the contract administration and for additional services as requested in writing by the OWNER, on an hourly basis by classification, as set forth in:Attachment "D-1";:which:is attached:hereto and made an integral part hereof, plus expenses (in the case of sub-consultants, the expense plus 10%).- The CONSULTANT is to be compensated monthly. 5. Compensate the CONSULTANT for any Post Design Services provided on behalf of the: OWNER on an hourly basis by classification, as set forth.in Attachment "D-1", which is attached hereto and made an integral part hereof, plus expenses (in the case of sub- Consultants, the expense plus 10%). Post Design Services include but are not limited to' inquiries from contractors, other consultants, other agencies and shop drawing review. Post Design Services also include any additional submissions of final tracings not due to the fault of the CONSULTANT 6. . Based on the scope of work, a State Categorical Exclusion (SCE) document is anticipated for the project Coordination with INDOT-Cultural Resources Office.was conducted under previous work.. Waters of US Report:. A Waters of the U.S. Report (WOUSR) will be developed to identify jurisdictional wetlands, streams and ditches within the project area. The results of the WOUSR. will be included as part of the environmental document and will be included as part of the Section 401 and Section 404 permit application submittal. The walls'vary in height from 4' to 9'. The walls also vary in length from 25' to 375'. The proposed walls will have limestone cladding on the face and pedestrian handrail mounted on top. The work involved will be the design of the new retaining wall with a pedestrian handrail. Landscaping Design: See attached sub consultant proposal for detailed scope of work. 1. GEOTECHNICAL Geotechnical: See attached sub consultant proposal for detailed:scope.of work. PERMITS Permits: BLN will prepare the applications and documents to assist the City in obtaining - permits from various governmental agencies. It is anticipated that the following permits will be required for the project: Construction Stormwater General Permit :.. .IDEM 401. It is assumed that utilities will be impacted by the project(no reimbursements are anticipated) and utility coordination during construction will not be required. PROJECT MANAGEMENT AND MEETINGS Project Management and Meetings: BLN will meet with the City when requested or necessary for consultation or conference. It is assumed that four.(4) client coordination meetings will be required during the duration of the _Project. BLN will also provide monthly progress reports and provide assistance with the Next Level Trails Grant Reporting. BIDDING PHASE SERVICES Bidding Phase Services: BLN will furnish personnel to assist the City during the bidding phase of the Project. The anticipated services are as follows: • . The multi-use trail is proposed from the existing parking lot south of W Riverside Dr and east of the Clark Memorial Bridge/US31. The trail heads east approximately 930 connecting to the existing Greenway trail. Design responsibilities include landscape design,wayfinding signage,trail amenities and decorative pavement. design at trailhead, nodes and crossings. Landstory will provide layout and detailing of interpretive,directional and information signage, retaining walls,fences, railings and trail furnishings consistent with similar elements of the Ohio River Greenway design vernacular. The design process will follow INDOT submittal requirements and guidelines. BLN will provide City of Jeffersonville(LPA)coordination, project submittals,engineering,survey, environmental and land acquisition services. BNLwill make pertinent information available to Landstory, including reports,environmental documentation, survey and trail engineering information. BLN will supply Landstory with title block information and plan sheets. Electronic drawing submittals and coordination will be provided in AutoCad format consistent with INDOT drawing standards and submitted to BLN for inclusion in their submittals. SCOPE OF SERVICES TASK 1: FIELD CHECK PLANS(25%COMPLETE): Landstory will provide preliminary landscape architectural design and drawings necessary to submit Stage 1, field check plans for review,v and comment. The plans will be based on the LPA kick-off meeting decisions, topographic and existing conditions survey and preliminary engineering information provided by BLN. Selection of materials,finishes and products, layout plans and development of initial trail details will be included in the preliminary design plans.
