HomeMy WebLinkAbout10-06-2003COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA October 6, 2003 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Propose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:30 P.M. on Monday, October 6, 2003. Mayor Tom Galligan, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present was City Attorney Anne Marie Galligan and Deputy Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those present to keep former City employee Rudy Broy's family in their prayers, as Mr. Broy has passed away. Mayor Galligan then asked Councilperson Ron Grooms to give the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Ron Ellis, Les Merkley, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin. Absent: Councilperson Denny Frantz. Councilperson Merkley made the motion to approve the agenda as presented, second by Council President Waiz, passing on a vote of 6-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council. Following discussion, Councilperson Merkley made the motion to approve the claims as presented, second by Councilperson Grooms, passing on a vote of 5-1. Councilperson Ellis voted against passage. PUBLIC COMMENT: Mr. Monty Snelling, candidate for Mayor, appeared before the Council to ask Council President Rob Waiz to reconsider his decision on a series of debates. Ms. Margaret Schafer appeared before the Council to request help with problems she is having with cable service for her business, Scottish Inn. She has been told cable service is not regulated; however she found the FCC allows for local regulations. She would like the Council to get involved. Councilperson Ellis asked for Attorney Galligan's opinion. Attorney Galligan believes when there is competition, such as dish October 6, 2003 2 systems, no regulation is allowed. It would be difficult for another company to make the capital investments that have been made. Councilperson Grooms said he is not sure what Ms. Schafer would like the Council to do. Ms. Schaffer reviewed other problems she has had with installation. Mayor Galligan asked Mr. Schaffer to call his office to set up a meeting with he and Mr. Bob Lilly. AGENDA ITEMS: Mr. Gayle Robinson, Director of Redevelopment, appeared before the Council to request Council approval of tax abatement compliance forms. Councilperson Grooms asked how many jobs these abatements represent. Director Robinson said the numbers are down due to the economy. There is a need to look at recruiting. Councilperson Ellis asked what percent have increased jobs. Director Robinson said it has been a good investment in the community. Councilperson Grooms appreciates the breakdown that has been provided. Councilperson Grooms then made the motion to approve the tax abatements, second by Councilperson Merkley, passing on a vote of 6-0. Director of Redevelopment Gayle Robinson appeared before the Council to request passage of Ordinance No. 2003-OR-32, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being More Particularly Described As The 17+/- Acres Bound By 12th Street On The North, By Watt Street On The West, By Tenth Street On The South, And By Mechanic Street On The East, Located Within The City Of Jeffersonville, Clark County Indiana. Director Robinson explained the area and the change requested. Councilperson Ellis asked if only the Quadrangle will be rezoned. Director Robinson answered yes. Councilperson Merkley then made the motion to pass Ordinance No. 2003-OR-32, second by Councilperson Wilson, passing of a vote of 6-0. Mr. Marvin Grant, Street Commissioner, appeared before the Council to request passage of Resolution No. 2003-R-17, A Resolution Of Additional Appropriation, explaining the need. Councilperson Merkley made the motion to pass Resolution No. 2003-R-17, second by Councilperson Conlin, passing on a vote of 6-0. Councilperson Grooms asked what paving would be done. Mayor Galligan explained the money would be used for routine paving. Agenda item #13, an Ordinance Transferring Certain Funds Within Same Department was withdrawn. October 6, 2003 3 Attorney Galligan explained Ordinance No. 2003-OR-33, An Ordinance Amending Ordinance No. 90-OR-40, Jeffersonville Municipal Code Chapter 151: Flood Plain Management. Councilperson Merkley made the motion to pass Ordinance No. 2003-OR-33 on the first reading, second by Councilperson Conlin, passing on a vote of 6-0. Ordinance No. 2003-OR-34, An Ordinance Of The City Of Jeffersonville Authorizing The Issuance Of Sewage Works And Storm Water Revenue Bonds For The Purpose Of Providing Funds To Pay The Cost Of Certain Additions, Extensions And Improvements To The Municipal Sewage Works Of Said City, Providing For The Safeguarding Of The Interests Of The Owners Of Said Bonds, Other Matters Connected Therewith, Including The Issuance Of Notes In Anticipation Of Bonds, Inconsistent Herewith, was presented for consideration. Engineer Jorge Lanz explained the projects and the estimated costs. Councilperson Conlin made the motion to pass Ordinance No. 2003-OR-34 on the first reading, second by Councilperson Grooms. Councilperson Ellis noted when the Drainage Board was passed he thought Bondenberger was to be the first project and he wants assurance that it would be first on the list. Engineer Lanz presented a document showing Bondenberger as first. Drainage Board member Tom Locke said the Board is committed to Bondenberger as gl, with the Meadows as #2. Councilperson Grooms questioned the drainage at Jefferson Mobile Home Park. Engineer Lanz said it would be taken care of. Mayor Galligan explained the projects further. Councilperson Grooms questioned the total indebtedness. Board Member Locke said he would recommend the Board use current funds for the "soft costs". Ms. Nellie Knowland asked how this would affect h~r area. Mayor Galligan said it would help. Mayor Galligan noted the City Attorney does not get any money from this bond issue as the City has a full-time attorney. Following all discussion, the motion to pass Ordinance No. 2003-OR- 34 passed on the first reading on a vote of 6-0. COUNCIL AND MAYOR COMMENTS: Councilperson Grooms said he had an opportunity to visit the Animal Shelter and learned the voucher program had been abolished, however there are about 40 spay/neuters per week. He was impressed with the shelter saying it was well organized and well run. He noted the Citizen's Advisory Board is working very well. 4 October 6, 2003 Councilperson Conlin thanked the Drainage Board for their hard work. Council President Waiz also thanked the Drainage Board for the work they do and thanked all for coming. Mayor Galligan noted the recent opening of Timothy's Restaurant as a nice addition to Jeffersonville. Mayor Galligan reminded all of the dedication of the Thomas Jefferson statue on October 24 in Warder Park. An actor will portray Thomas Jefferson at Kye's and he encourages all to come, as it is vc:u3~ impressive, entertaining and educational. Mayor Galligan said Spring Street would be closed Thursday between Willinger and Fairview for one week. There being no further business to come before the Council, the meeting was adjourned 8:35 P.M.
