FOR THE CITY OF JEFFERSONVILLE,INDIANA
RESOLUTION NO. 2022-R-
RESOLUTION REGARDING WAIVER OF NONCOMPLIANCE FOR
LEO PROPERTIES,INC.
WHEREAS,the Common Council of the City of Jeffersonville, Indiana has heretofore approved
a resolution granting tax abatement to Leo Properties, Inc.; and
WHEREAS, in order to claim the benefits of the granted tax abatement, Leo Properties, Inc. is
required to provide to the Common Council of the City of Jeffersonville, Indiana a document
denominated as a Compliance With Statement Of Benefits Real Estate Improvements (CF-1 RP),
on or before May 15 of each year; and
WHEREAS, Leo Properties, Inc. prepared a CF-1 RP but failed to file a timely application with
the Clark County Auditor's Office and the Common Council of the City of Jeffersonville,Indiana,
all as required by Indiana Code 6-1.1-12.1 et seq.; and

WHEREAS,on October ,2022, after due publication of notice thereof, a public hearing was
held on the request of Leo Properties, Inc. to now waive noncompliance of Leo Properties, Inc.'s
CF-1 RP for calendar year 2022 pertaining to tax due in calendar year 2023; and
WHEREAS,after consideration of all information received at the aforementioned public hearing,
the Common Council of the City of Jeffersonville, Indiana finds that it is appropriate to grant a
waiver of noncompliance pursuant to Indiana'Code 6-1.1-12.1-11.3.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Jeffersonville, Indiana,that:
1) Pursuant to Indiana Code 6-1.1-12.1-11.3, the Common Council of the City of
Jeffersonville, Indiana hereby waives compliance of the CF-1 RP for tax year 2022
payable 2023.
2) This Resolution shall be in full force and effect from and after its passage in accordance
with the law.
